A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, PROVIDING THAT THE OWNER OF ON SITE
SEWAGE TREATMENT AND DISPOSAL SYSTEM MAY PAY CONNECTION
FEES CHARGED BY INVESTOR-OWNER SEWERAGE SYSTEM IN MONTHLY
INSTALLMENTS WITHOUT INTEREST OVER A PERIOD OF TIME NOT TO
EXCEED FIVE YEARS
WHEREAS, Sec. 381.00655, Fla. Stat., requires hook-up to a central sewage system within
one year of its becoming available; and
WHEREAS, Sec. 15.5-21 Monroe County Code, requires hook-up to a central sewage system
within thirty (30) days of its becoming available; and
WHEREAS, both laws allow the BOCC to adopt a resolution providing that the owner of an
on site sewage treatment and disposal system may pay any connection fees charged by an investor-
owned sewerage system in monthly installments without interest over a period of time not to
exceed five (5) years from the date the sewerage system becomes available if the County
determines that the owner has demonstrated financial hardship; and
WHEREAS, the County Code conditions adoption of the resolution upon the approval of
Florida Keys Aqueduct Authority, Inc.; and
WHEREAS, the high cost of living in Monroe County may result in a financial hardship to the
owners of on site sewage treatment and disposal systems who are required under the
aforementioned laws to connect to the central sewerage system; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA:
Section 1. The owner of an on site sewage treatment and disposal system who is required
by law to connect to a central sewage system may pay any connection fees charged by an investor-
owned sewerage system in monthly installments without interest over a period of time not to
exceed five years from the date the sewerage system becomes available if the County determines
that the owner has demonstrated financial hardship. If an installment plan is accepted by the
investor-owned sewerage system in excess of five years, this provision providing for interest-free
monthly installments shall not apply.
Section 2. The County Administrator or his designee and the County Office of
Management and Budget are hereby empowered to make the determination of hardship and to
appoint such staff as they deem necessary to assist them in this process.
Section 3. The determination of financial hardship shall take into account the owner's
net worth, income from all sources, the liquidity of assets, the legal obligation to provide care for
others, and any other financial information deemed appropriate by the staff empowered in Section
2 above.
Section 4. This resolution shall take effect only after approval by the BOCC and the
FKAA, which approval is indicated below by the signature of the Chairman of the Board of FKAA.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida,
at a regular meeting of said Board held on the 15th day of May ,2002.
