Presentation of settlement agreement in Monroe County v. D.C.A., DOAH 06-2856.
ITEM BACKGROUND:
The County challenged DCA's disapproval of Ordinance 15-2006, which authorized density bonuses
for affordable housing units measuring no more than 750 square feet. Legal staff have negotiated a
proposed resolution of the dispute which would allow for approval of the ordinance provided that the
Comprehensive Plan is clarified to better spell out the densities involved. At this writing, the details of
the settlement agreement are being refined so no documentation is available to attach as backup. This
summary shall serve as a place holder on the agenda.
PREVIOUS RELEVANT BOCC ACTION:
On 7/19/06, the Board authorized filing a challenge to DCA's Final Order disapproving the ordinance.
