On January 29, 1992, the Board of County Commissioners
approved and authorized execution of a License Agreement
with the Department of the Navy concerning use of the
translator tower at Sigsbee Park in Key West.
Attached is one duplicate original and one copy of the
Agreement, now executed and sealed by all parties. The
duplicate original <raised seal) should be returned to the
Government and the copy should be retained in your own
proper departmental records.

MEMORANDUM OF UNDERSTANDING
BETWEEN
COMMANDING OFFICER, NAVAL AIR STATION, KEY WEST
AND
MAYOR, MONROE COUNTY, FLORIDA
AND
EXECUTIVE DIRECTOR, DEPARTMENT OF GENERAL SERVICES, STATE OF FLORIDA"
PURPOSE: The purpose of this Memorandum of Understanding is to delineate
Naval Air Station, Key West/Monroe County/ State of Florida responsibilities
associated with installation of Navy and State of Florida antennas on the
Monroe County owned Sigsbee Park Tower; Further, this Memorandum of
Understanding provides Navy authorization for the State antenna
installations.
Note: The Sigsbee Park Tower is owned by Monroe County and located on Navy
owned Sigsbee Park. Previous agreements already cover county authorization
for the installation of state and Navy antennas on the tower. A 1991 license
agreement between Monroe County and the State Department of General Services
gave authorization for the installation of state owned antennas on the county
owned tower. This MOU provides Navy authorization for the state
installations. A 1992 license between Monroe County and the United States
of America authorized installation of Navy owned antennas on the county owned
tower.
Note: If at any future time, the government determines that the state
antennas unduly interfere with any of its activities, it shall have the
right to terminate this MOU, in whole or in part, to the extent necessary to
eliminate such interference. A similar provision concerning county antennas
is already incorporated in Easement No. N62467-85-RP-00158, dated 19 August
1985, for a fifty (50) year period.
A.. SPECIFIC PROVISIONS: Mutual responsibilities of Naval Air Station, Key
West/Monroe County/State of Florida are listed as follows:
1. All transmitters must be de-activated periodically to provide
routine maintenance. Parties should endeavor to perform such maintenance on
their systems at the same time to minimize total down-time.
2. Each party must pay for its own utility consumption.
B. OTHER PROVISIONS:
1. This Memorandum of Understanding will remain in effect so long as
Easement N62467-85-RP-00158 is in effect, or until terminated by mutual
consent.
2. Amendments, changes, and/or supplements to this Memorandum of
Understanding may be made with the mutual consent of the parties hereto. The
amendments, changes and/or supplements must be in wpiting.
