FAX TRANSMITTAL: PAGE 1 OF ~ F:u=:r ,-(' (jD Agreement Between United States Navy, Key West Naval Air Station and the Monroe County Board of County Commissioners with Respect to Mutual Assistance Before, During, and After Disaster '9:2 1"1 ,'\ 9 :': ~ This agreement is made and entered into between the Commanding Officer of Key West Naval Air Station, representing the United States Navy assets located in Monroe County and the Monroe County Board of County Commissioners, representing the residents and visitors of Monroe County, Florida. Recitals The residents and visitors of Monroe County, Florida and personnel of Naval Air Station, Key West share vulnerabilities that are common to all residents of the Florida Keys. It is in the interest of both parties to come to the assistance of the other in time of crisis resulting from the threat, impact, and/or aftermath of natural disaster. Protective actions taken by either party will most certainly impact the actions taken by the other. Therefore, pursuant to all applicable Federal Statutes, State Statutes, Department of Defense Directives and Instructions, local ordinances, and/or resolutions and for the purpose of: reducing the potential for loss of life resulting from the threat and/or impact of a tropical storm, hurricane, or other disaster; reducing, as is possible, the vulnerabilities of both communities to the threat and/or impact of a tropical storm, hurricane, and/or other disaster; and to provide for expedience in addressing the life safety needs that arise following the impact of a tropical storm, hurricane, or other disaster, it is mutually agreed between the two parties as follows: 1. The Monroe County Board of County Commissioners and the Commanding Officer, Naval Air Station, Key West agree to bring all available human and material resources to the assistance of the requesting party, subject to the following terms and stipulations: a. no statement in this agreement shall be construed to remove the responsibility for disaster preparedness from either party; b. all aid and assistance is confined to that area of Monroe County extending from and including the City of Key West, to and including Cudjoe Key and including all areas in between regardless of whether jurisdiction for that area falls to Monroe County or the U.S. Navy; c. Commanding Officer, Naval Air Station, Key West reserves the right to final determination in regard to compliance with Department of Defense instructions and directives; d. Commanding Officer, Naval Air Station, Key West and the Monroe County Board of County Commissioners agree to hold the other harmless for any loss, damage, personal injury, or death resulting from the provision of aid and/or assistance as stipulated in this agreement; e. Commanding Officer, Naval Air Station, Key West and the Monroe County Board of County Commissioners agree that all aid and/or assistance provided under the terms of this agreement shall be reimbursable. Reimbursement will be based on 100% of the physical costs to that party providing the service; f. the Monroe County Board of County Commissioners recognizes that the Commanding Officer, Naval Air Station, Key West, can offer no assistance unless a physical threat to life and/or property exists and no alternate source of assistance, private or public, is available; g. this agreement shall be effective upon its signing and shall remain in full force and effect until either: termination by mutual consent of all signatories, or sixty days after written notice of cancellation from one party is received by the other party. In witness thereof, the Monroe County Board of County Commissioners, Monroe County, Florida has caused this agreement to be executed by the Mayor of Monroe County with the Commanding Officer, Naval Air Station, Key West said agreement to become effective and operative upon fixing of the last signature hereto. ~- . . ~ ~ .~.aJ v..
