Resolution 040-1990 Planning Department RESOLUTION NO. 040-1990 A RESOLUTION CONFIRMING THE ADMINISTRATIVE BOUNDARY INTERPRETATION OF THE PLANNING DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY INTERPRETATION NUMBER 47, LOT 38, BLOCK 5 CUTTlffi.OAT HARBOR ESTATES, CUDJOE KEY WHEREAS, the property described in the Planning Department Report of November 22, 1989, Lot 38, Block 5, Cutthroat Harbor Estates, on Yardarm Road presently vacant, zoned Suburban Residen- tial since 1986; and WHEREAS, the current Land Use district boundaries were placed in error with the adoption of the September 15, 1986 Land Develop- ment Regulations, and therefore the subsequent maps were also in error, as they did not follow the previous demarcated residential boundary; NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: The administrative decision of the Planning Director in Land Use District Map Boundary Interpretation Number 47 dated November 22 , 1989, which recommends approval is hereby acknowledged and found to be in conformance with the standards set forth in Section 9.5-3(m), Monroe County Code, and therefore approved. The Clerk of the Board is hereby directed to forward a certi- fied copy of this resolution to the Florida Department of Communi- ty Affairs. Background: The applicant has requested a boundary determination for the referenced lot. Based on the application the property owner is requesting the determination, not on community character, but to allow bui lding of a single family home. The lot is platted in the Cutthroat Harbor Estates subdivision. On February 28, 1986 the area was zoned Suburban Residential (SR), bordered by Improved Subdivision (IS) to the south, and Native (NA) on the east and west. The January 19, 1988 revi sion shows the lots maintained the Suburban Residential land use designation. According to our records there have been no changes within the area of the lot in question. Findings of Fact: Lot 38 appears to more closely fit the criteria and purpose of the Subur- ban Residential land use district than an Improved Subdivision land use district, not only by definition but by the present community character of the area. Throughout the history of the land in this file, the prop- erty has always been Suburban Residential which, upon review by both the planner and biologist, best fits the character and purpose of the dis- trict. Based on the application the property requesting the determination, not on community character, allow building of a single family home. The lot is platted in the Cutthroat ,Harbor Estates subdivi- sion. On February 28, 1986 the area was zoned Suburban Residen- tial (SR), bordered by Improved Subdivision (IS) to the south, and Native (NA) on the east and west. The property is presently located within the Suburban Residential (SR) land use district. An Improved Subdivi- sion (IS) boundary line runs along the southern edge of this lot. The applicant feels that the IS boundary line should be moved north to include lot 38 so that a single family residence can be built. SITE DESCRIPTION: Lot 38 is a vacant lot characterized by the following native species: Poisonwood, Buttonwood, Blackbead, Maidenbush, Key thatch, Silver thatch, Spanish stopper, Long-Stalked stopper, Myrsine and Necklace pod. Poisonwood, Buttonwood and thatch palm species appear to be dominant. The lot is density vegetated and no exotic species were noted. The area in which this lot is located is designated as Salt Marsh/Buttonwood and tropical Hard- wood Hammock on the 1985 aerial photographs. There is an existing Single Family Residence that appears to occupy two lots (lots 37 & 36). ists on lot 40, to the south. The street Yardarm road, which is an unpaved, gravel road. ( (- that adjacent lots in this SR land use district would be subject to boundary changes. Furthermore, since the majority of the lots in the area are vacant, the purpose of designating the area SR in the first place would be defeated if the existing boundary lines were altered. Taking into consideration the 1985 aerial photo- graphs, the existing conditions on the lot, and the areas present community character, this lot clearly reflects the intent and purpose of the SR land use district. RECOMMENDATIONS: It is recommended that the IS/SR boundary is correct and the lot 38 retain it's SR land use district designation. Boundary.Det mp
