MONROE COUNTY, FLORIDA, ON BEHALF OF MUNICIPAL SERVICE
TAXING DISTRICT NO.5, AUTHORIZING THE MAYOR TO

BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, that the Board of County Conunissioners, on behalf of Municipal
Service Taxing District No.5, hereby authorizes the Mayor to execute a
Reimbursement Agreement with Tavernier Volunteer Fire Department and
Ambulance Corps, Inc. concerning advanced life support ambulance service,
from a premises in Tavernier, Florida, to serve the area generally
described as being from Snake Creek north to South Bay Harbor Drive and
Lobster Lane.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe
County, Florida, at a regular meeting of said Board held on the 24th day
of January , A.D. 1990 .

REIMBURSEMENT AGREEMENT
AGREEMENT, made this day of 19_, by and
between the Board of County Commissioners of Monroe County, Florida on
behalf of Municipal Service Taxing District No.5, hereinafter "DISTRICT"
and TAVERNIER VOLUNTEER FIRE DEPARTMENT AND AMBULANCE CORPS, INC., a
not-for-profit Florida Corporation, hereinafter "FIRE AND AMBULANCE CORPS".
WHEREAS, the DISTRICT and the FIRE AND AMBULANCE CORPS desire to
provide advanced life support ambulance service from premises in Tavernier,
Florida, to serve the area generally described as being from Snake Creek
north to South Bay Harbor Drive and Lobster Lane,
NOW THEREFORE, THE DISTRICT AND THE FIRE AND AMBULANCE CORPS, agree
upon the following terms and conditions for the operation of the
above-described ambulance service:
1. The term of this AGREEMENT shall commence as of the 1st day of
October, 1989 and end on the 30th day of September, 1990.
2. All operations of the advanced life support ambulance service by
the FIRE AND AMBULANCE CORPS shall conform to the Florida Emergency Medical
Serv ices Act of 1973, as amended, and all applicable standards, rules and
regulations, including but not limited to those standards set forth in
Monroe County Code, Chapter 6. S, the Monroe County Emergency and
Non-emergency Medical Services Ordinance of 1982, heretofore adopted by
Monroe County on January 26, 1982, and any amendments thereto.
3. The FIRE AND AMBULANCE CORPS shall have on call all necessary
personnel to provide the ambulance service on a twenty-four (24) hour
basis. A combination of paid part-time or full-time employees and volunteer
personnel of the FIRE AND AMBULANCE CORPS shall be utilized to ensure that
sufficient staffing for at least one (1) advanced life support permitted
ambulance is available at all times. Part-time or full-time employees of
the FIRE AND AMBULANCE CORPS shall be compensated by the FIRE AND AMBULANCE
CORPS at an hourly wage or salary level commensurate with that of employees
in similar positions of other fire and ambulance districts within Monroe
County.
4. The DISTRICT shall reimburse to the FIRE AND AMBULANCE CORPS all
costs, charges or expenditures directly relating to the employment of the
part-time or full-time personnel described in Section 3 of this agreement on
a monthly basis and in a sum not to exceed the budgeted allocation. The
DISTRICT shall provide reimbursement of volunteer personnel of the FIRE AND
AMBULANCE CORPS in accordance with the provisions of Chapter 2, Article V,
Division 2 of the Monroe County Code.
S. The DISTRICT shall provide the existing vehicles and equipment
owned by the DISTRICT or Monroe County, per attachment A hereto, for use by
the FIRE AND AMBULANCE CORPS to provide the ambulance service. The
Emergency Medical Services (EMS) Department of Monroe County on behalf of
the DISTRICT shall provide for the general and preventive maintenance of the
vehicles and equipment according to the manufacturer's recommended
maintenance schedule and specifications as a minimum; periodic testing and
certification of applicable medical equipment and devices shall be performed

accordingly; repairs or corrective maintenance shall be performed as
qeeded. The EMS Department shall have the right to inspect the vehicles and
equipment at any reasonable time.
6. The FIRE AND AMBULANCE CORPS shall requisition equipment,
supplies and other support materials in accordance with the Monroe County
Purchasing Procedures Manual. In accordance with Section V, Paragraph A (1),
Level A purchasing authority not exceeding $1,000., the FIRE AND AMBULANCE
CORPS may directly purchase such supplies, equipment, excluding capital
outlay items, and/or services required for advanced life support ambulance
service functions and for which the DISTRICT has allocated funds in the
current budget. Purchase Order Numbers shall be requested through the EMS
Department. Or, upon receipt of proper requisition, the EMS Department shall
provide, in a timely manner, the equipment supplies and other support
materials required by the FIRE AND AMBULANCE CORPS for advanced life support
ambulance service functions and for which the DISTRICT has allocated funds
in the current budget.
7. The FIRE AND AMBULANCE CORPS shall provide a system for property
control of the veh icles and equipment owned by the DISTRICT or Monroe
County, per attachment A hereto, and used by the FIRE AND AMBULANCE CORPS
to provide the ambulance service. The FIRE AND AMBULANCE CORPS shall assist
the EMS Department in the performance of the annual inventory of the
vehicles and equipment. The FIRE AND AMBULANCE CORPS shall notify, in a
timely manner, the EMS Department of Monroe County when a repair or
corrective maintenance of a vehicle or equipment is required and shall
assist in the delivery of the affected vehicle or equipment to the
appropriate service facility. The FIRE AND AMBULANCE CORPS shall assist
the EMS Department in scheduling the vehicles and equipment for general and
preventive maintenance, and periodic testing and certification of applicable
medical devices.
8. The DISTRICT and/or Monroe County on behalf of the DISTRICT
shall provide worker's compensation insurance on the volunteer personnel of
the FIRE AND AMBULANCE CORPS.
9. The DISTRICT. and/or Monroe County on behalf of the DISTRICT
shall keep in full force and effect a policy of liability insurance on all
vehicles owned by the DISTRICT or Monroe County and used by the FIRE AND
AMBULANCE CORPS, which policy shall also provide secondary, or back-up
coverage on private vehicles only during such time as they are operated in
response to a call for the emergency services of the FIRE AND AMBULANCE
CORPS. Such period of operation shall be deemed to begin at the time a
volunteer enters a private vehicle for the purpose of responding to a call
and to end at such time as a volunteer returns to his home, or in the case
of a volunteer who makes an intermediate stop on his way to his home, to the
first location to which he drives, after the completion of his participation
in the emergency services that were the subject of the call.
10. The DISTRICT and/or Monroe County on behalf of the DISTRICT
shall provide commercial general liability insurance with minimum limits of
$300,000.00 per occurrence, $1,000,000.00 annual aggregate. The policy
shall include medical malpractice coverage on the volunteer personnel and
all paid part-time and full-time employees of the FIRE AND AMBULANCE CORPS.

The FIRE AND AMBULANCE CORPS is to be listed as named insured for all
coverages.
11. The,FIRE AND AMBULANCE CORPS shall provide worker's compensation
insurance for all paid part-time and full-time employees of the FIRE AND
AMBULANCE CORPS in compliance with Florida Statutes Chapter 440 and shall
provide for employer's liability coverage with minimum limits of $500,000.00.
12. The cost of all insurance policies required under the provisions
of Sections 10 of this AGREEMENT shall be a cost, charge or expenditure of
the FIRE AND AMBULANCE CORPS for which the DISTRICT, upon receipt of proper
invoices and other applicable documentation, shall reimburse the FIRE AND
AMBULANCE CORPS in a sum not to exceed the budgeted allocation for such
costs, charges or expenditures.
13. The FIRE AND AMBULANCE CORPS shall keep in full force and effect
a policy of liability insurance on all emergency vehicles owned by the FIRE
AND AMBULANCE CORPS and used in providing emergency services within the
DISTRICT. Said policy shall be in the amount of at least $300,000.00
combined single limit for bodily injury and/or property damage to third
persons and shall also name both the DISTRICT and Monroe County as
additional insureds. Proof of insurance in a form acceptable to the
DISTRICT shall be provided by the FIRE AND AMBULANCE CORPS.
14. Each of the volunteers of the FIRE AND AMBULANCE CORPS shall
furnish and keep in full force and effect a policy of liability insurance on
his private vehic Ie (s) in such amounts of coverage as are required under
Florida law. Proof of insurance in a form acceptable to the DISTRICT shall
be provided by each volunteer and maintained on file in the business office
of the FIRE AND AMBULANCE CORPS. The FIRE AND AMBULANCE CORPS shall
provide complete copies of all insurance policies to the DISTRICT upon
request.
15. The FIRE AND AMBULANCE CORPS, to the fullest extent permitted by
law, shall indemnify and forever hold harmless the DISTRICT and Monroe
County, their officers, agents and employees, from all claims of any sort
whatsoever that may arise from the negligence, acts or omissions of the paid
part-time and full-time ~mployees of the FIRE AND AMBULANCE CORPS.
16. The FIRE AND AMBULANCE CORPS shall contract with a Florida
licensed physician who shall serve as the Medical Director of the ambulance
service. The DISTRICT shall reimburse the FIRE AND AMBULANCE CORPS for the
cost of the Medical Director's contractual services, upon receipt of proper
invoices and other supporting documentation and in a sum not to exceed the
budgeted allocation.
17. The FIRE AND AMBULANCE CORPS shall provide proof of medical
malpractice insurance, with minimum limits of $300,000.00 per occurrence,
$1,000,000.00 annual aggregate, on the Medical Director of the FIRE AND
AMBULANCE CORPS in a form acceptable to the DISTRICT.
18. The volunteer personnel and the paid employees of the FIRE AND
AMBULANCE CORPS may, and are encouraged to, participate in emergency
medical and other emergency services related training programs provided
through the EMS Department. The cost of such participation, by the FIRE AND
AMBULANCE CORPS, shall be calculated proportionally and charged to the
DISTRICT. The DISTRICT shall provide reimbursement of certain other

training related expenses for the volunteer personnel of the FIRE AND
AMBULANCE CORPS as provided for in Section 2-221, Monroe County Code.
Travel expenses directly related to training activities shall be
reimbursable by the DISTRICT in accordance with applicable laws, rules and
regulations. The FIRE AND AMBULANCE CORPS shall submit requests for
approval to travel to the EMS Department in proper form and at least two (2)
weeks (minimum) in advance of the expected departure date. The FIRE AND
AMBULANCE CORPS shall assist the EMS Department in making such travel
arrangements, if and when necessary.
19. The FIRE AND AMBULANCE CORPS shall provide pre-hospital
ambulance service within their designated service area, and mutual aid and
interhospital transfer services upon request and in accordance with
applicable laws, rules, regulations and standards.
20. The FIRE AND AMBULANCE CORPS shall have the authority, if it so
desires, to set user fees to be charged for secondary transport ambulance
service with the approval by majority vote of the DISTRICT Board, as
provided for in Section 2-238( d) Monroe County Code, and the FIRE AND
AMBULANCE CORPS shall have the sole authority to render statements to
patients for services rendered by the ambulance service. The FIRE AND
AMBULANCE CORPS shall have the sole authority to determine the procedures to
be used in the collection of user fees for the secondary transport ambulance
service. The institution of a lawsuit or any other legal procedure shall be
strictly at the discretion of the FIRE AND AMBULANCE CORPS. For the
purpose of this AGREEMENT, secondary transport ambulance service shall mean;
transportation of a patient by ground ambulance to a destination other than
Mariners Hospital, Plantation Key, Florida. The FIRE AND AMBULANCE CORPS
may provide compensation on an hourly basis, for volunteer personnel, only
for the time actually spent in performing secondary transport ambulance
services. All user fees collected by the FIRE AND AMBULANCE CORPS for the
secondary transport ambulance service shall be used exclusively for
providing compensation on an hourly basis, for volunteer personnel and
related administrative costs.
21. The FIRE AND AMBULANCE CORPS shall provide monthly financial
statements of the operation of the ambulance service by line item expense
accounts. The DISTRICT shall reimburse the FIRE AND AMBULANCE CORPS monthly
for said expenses as provided for in this AGREEMENT.
22. The DISTRICT budget, as adopted, per Attachment B hereto,
provides funding for other costs, charges or expenditures necessary or
incidental to the operation of the ambulance service contemplated within
this AGREEMENT, which have not been previously enumerated herein. The EMS
Department on behalf of the DISTRICT shall be responsible for providing the
necessary accountability and controls for these funds.
23. The DISTRICT shall provide to the FIRE AND AMBULANCE CORPS a
monthly trial balance of the DISTRICT's funds so as to maintain concurrency
and awareness of budgeted appropr iation and expendi tures; detailed
expenditure reports shall be provided upon proper request.
24. The FIRE AND AMBULANCE CORPS shall submit to the EMS Department,
on a monthly basis, for the purposes of statistical analysis and supporting
documentation for grants, a detailed operational report, including, but not

limited to, the total number of service responses and patients transported,
by appropriate categories, and average response times; such reports shall be
submitted-in a format approved by Monroe County. The FIRE AND AMBULANCE
CORPS shall utilize the current County approved standardized run report.
25. The FIRE AND AMBULANCE CORPS shall be accountable to the Monroe
County EMS Director, or his designee, as required by this AGREEMENT. The
EMS Director or his designee shall have the authority and responsibility for
coordination and control of all Emergency Medical Services resources during
disasters, major emergencies and other major incidents requiring the
response of multiple agencies and/or resources. The EMS Department shall
provide administrative and technical assistance to the FIRE AND AMBULANCE
CORPS in matters relating to the operation of the ambulance service.
26. Monroe County shall provide for an exclusive central
communications system for the dispatching of all emergency and non-emergency
calls within the service area. Said system shall consist of the ambulances
used by the FIRE AND AMBULANCE CORPS, the hospitals within the county, the
central dispatch centers of the county, and the two-way radios installed in
the ambulances used by the FIRE AND AMBULANCE CORPS. The central
dispatchers of the county shall have the unqualified right to coordinate and
dispatch all ambulances of the FIRE AND AMBULANCE CORPS and to receive
immediate confirmation of the status and location of all ambulances, whether
such ambulances are in service or not. It is hereby recognized and
acknowledged that the right of the central dispatchers to dispatch and
confirm status is paramount in order to effectively coordinate the provision
of both emergency and non-emergency ambulance service within Monroe County,
and that failure of the FIRE AND AMBULANCE CORPS to respond immediately and
accurately to the directions and inquires of the central dispatchers shall
be a severe violation of the terms of this AGREEMENT.
27. The DISTRICT may terminate this AGREEMENT at any time during its
term if the FIRE AND AMBULANCE CORPS defaults under any of the provisions
specified herein, or violates any standard specified in this AGREEMENT, or
violates any other law, regulations or standard applicable to furnishing of
ambulance service in Monroe County. In such event, the Administrator of the
County shall furnish the FIRE AND AMBULANCE CORPS written notice of any such
default or violation and the FIRE AND AMBULANCE CORPS shall have thirty (30)
days from receipt of said notice to correct or remedy such default or
violation. If such violation is not corrected or such default is not
remedied within said thirty (30) day period, or is of such nature that is
can not be corrected or remedied, this AGREEMENT shall be considered void.
The FIRE AND AMBULANCE CORPS may terminate this AGREEMENT without cause by
giving sixty (60) days written notice indicating their desire to terminate
same.
28. Notice under this AGREEMENT shall be given to the DISTRICT by
sending written notice to the Office of the County Administrator, Public
Service Building, Wing II, Key West, Florida 33040 and notice shall be
given to the FIRE AND AMBULANCE CORPS by sending written notice to the
President of the Tavernier Volunteer Fire and Ambulance Corps, Inc., Post
Office Box 301, Tavernier, Florida 33070.

29. Upon request of the DISTRICT, the FIRE AND AMBULANCE CORPS
shall submit a proposed budget appropriations request, by line item account,
for the forthcoming fiscal year. When deemed necessary by both parties, the
DISTRICT shall consider a budget appropriations request for remounting or
replacement of ambulances provided to the FIRE AND AMBULANCE CORPS by the
DISTRICT. The FIRE AND AMBULANCE CORPS shall be involved in the
specification writing, monitoring all phases of manufacturing and
recommending acceptance of remounted or replacement ambulances to be used by
the FIRE AND AMBULANCE CORPS. The EMS Department shall assist the FIRE AND
AMBULANCE CORPS in applying for grants for the ambulance operation.
30. In the event of unforeseen circumstances, such as illness,
injury or other cause of absence of the regular paid part-time or full-time
employees of the FIRE AND AMBULANCE CORPS, the FIRE AND AMBULANCE CORPS
shall make every reasonable attempt to temporarily employ personnel to
maintain sufficient staffing as to ensure the uninterrupted provision of
advanced life support ambulance services within the DISTRICT. The cost of
such temporary employees shall be a cost of the FIRE AND AMBULANCE CORPS as
provided for in Section 3 of this AGREEMENT and shall be reimbursable by the
DISTRICT as provided for in Section 4 of this AGREEMENT. The EMS Department
shall assist the FIRE AND AMBULANCE CORPS in attempting to obtain such
temporary employees.
31. In circumstances in which the FIRE AND AMBULANCE CORPS are
unable to immediately respond an advanced life support permitted ambulance
to a request for ambulance service, regardless of reason, the FIRE AND
AMBULANCE CORPS shall immediately respond a medical first response unit and
request through the central dispatch center for an advanced life support
mutual aid response from the nearest adjacent service provider.
IN WITNESS WHEREOF, the parties hereto have executed this AGREEMENT as
of the date first above written.
