A RESOLUTION BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
ADOPTING THE AIRPORT TERMINAL SPACE
AVAILABILITY POLICY FOR AIR CARRIERS
OPERATING IN MONROE COUNTY.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, hereby authorizes the adoption of the
Airport Terminal Space Availability Policy for air carriers
operating in Monroe County, a copy of same being attached hereto.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held

Airport Space Availability Policy
There is an ever-increasing demand by commercial airlines for
ticket counter and office space in the public terminal buildings
at both the Marathon Airport and Key West International Airport.
In the interest of providing the best possible service to the
flying public of Monroe County, allocating space to the airlines
in a fair and unbiased manner, and complying with all federal
regulations concerning commercial air service, the following
cri teria is established to evaluate all prospective commercial
airline service to Marathon and Key West:
1. Terminal Space Availability- Determine the amount of existing
space available for lease. If none is available and the
prospective airline can arrange to sublease space from an
existing airline, subject to approval by the Board of County
Commission, such divided space shall be leased individually by
the County at lease renewal time. Temporary space may be
considered if the concept is unique and the space occupied does
not further aggravate an already crowded condition.
2. Determine destination airports and connecting routes to
additional airports with same airline.
3. Interline agreements- Determine if the airline is affiliated
with a major airline to provide reduced thru-fares to destination
airports outside of South Florida. These agreements also cover
baggage handling to destination airports.
4. Type Aircraft- Jet, turbo prop, or piston engine aircraft to
be used? Does the aircraft FAA dba noise rating exceed acceptable
levels? What amenities are provided-pressurization/air condi-
tioning? Lavatory? Is baggage compartmentalized or carry-on? Is
there sufficient headroom and seating arrangements?
5. Flight Crew- Does the aircraft have a co-pilot? Are flight
attendants on board?
6. Airline History- Determine what is the record of service of
the airline by checking with airports already served by this
airline. Determine the safety record of the airline. Determine
the financial status of the airline.
7. Application procedures- Airlines desiring to initiate service
to Marathon or Key West will make application in accordance with
Monroe County Airport Commercial Airline Application Procedure
Policy.

(1) Background: Since the airline industry was deregulated by
the federal government in 1978 many old established airlines have
merged with other airlines, others have gone out of business, and
new airlines are constantly being formed.
(2) Purpose: The constant change in this industry requires that
applications from airlines interested in serving public airports
owned and operated by Monroe County be carefully reviewed to
ensure all required data is current and complete.

A. Any commercial airline requesting to initiate
scheduled service to and from Key West International
Airport and/or Marathon Airport shall make an official
request in writing to Monroe County through the Board
of County Commissioners, County Administrator, Director
Community Services or the Director of Airports.
B. Upon receipt of the official request, the Director
of Airports shall determine if ticket counter and
office space is available at the requested airport.
C. If space is available, the Director of Airports
will request that an official representative of the
airline meet at the appropriate airport to examine the
facility and discuss terminal building and ramp access
requirements.
D. Background information checks will be made on all
airlines making application to Monroe County.
Information to be checked shall include:
1. The Federal Aviation Administration requires each
airline to pass "Fitness Determination" which is a
check on experience and background of the operator,
insurance, and financial responsibility. No airline
may operate scheduled service prior to the issuance of
this determination. A copy of this determination may
be obtained from FAA Fitness Determination Section,
Washington, D.C.
2. Check with Miami Flight Standards District Office
(FSDO) for a current Part 121 or Part 135 Certificate
and ensure it is valid for scheduled airline
operations. Also check with the FAA inspector assigned
to the particular airline for comments on operational
and maintenance performance.
(3) Check with FAA Regional Counsel, Atlanta, for any
enforcement procedures that may be pending against the
airline.
6. Public liability insurance - at least $10,000,000
coverage is required. Monroe County shall be named as
co-insured. Certified copies of the insurance shall be
obtained from the company for Risk Management and the
Director of Airports. The insurance company must be
licensed to do business in the state of Florida. The
company should be required to notify Monroe County of
any adjustments to or cancellation of policy.
7. A credit check or Dun and Bradstreet report.
8. The type of equipment (aircraft) to be used and
number of passenger seats.
9. The proposed airfare for the routes to be served.
10. The proposed schedule of service and number of
flights.
(5) Action:
A. All Airport Management Personnel are to follow the
instructions listed above as applicable. A checklist,
Enclosure (1), is provided to facilitate action.
