RESOLUTION NO. 126- 1990
A RESOLUTION CONFIRMING THE ADMINISTRATIVE
BOUNDARY INTERPRETATION OF THE PLANNING
DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY
INTERPRETATION NUMBER 53, PARCEL IN KEY
VACA, MARATHON, NEAR 22ND STREET
WHEREAS, the property described in the Planning Department
Report of January 19, 1990, a parcel in Key vaca, Marathon, near
of 22nd street, presently vacant, was zoned Multiple-family Resi-
dential District (RU-3), prior to September 15, 1986; and
WHEREAS, the current Land Use district boundaries were not
placed in error with the adoption of the September 15, 1986 Land
Development Regulations, and therefore the subsequent maps were not
in error, as they did follow the previous demarcated residential
boundary;
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA THAT:
The administrative decision of the Planning Director in Land
Use District Map Boundary Interpretation Number 53 dated January
19 , 1990, which recommends approval is hereby acknowledged and
found to be in conformance with the standards set forth in Section
9.5-3(m), Monroe County Code, and therefore approved.
The Clerk of the Board is hereby directed to forward a certi-
fied copy of this resolution to the Florida Department of Communi-
ty Affairs.

Denial this request could not be accomplished through a boundary determi-
nation.
Background:
The applicant is requesting a boundary determination for the referenced
property located on U. S. 1 in Marathon. It appears from the strip map
that the property is made up of three parcels (RE#102410, 102440, and
10243) . These parcels are presently located wi thin two land use dis-
tricts, Improved Subdivision (IS) and Suburban Commercial (SC).
The change is requested for the rear of parcels 102410 and 102440 which
are presently located within the IS district. The applicant would like
a portion of this area to be include wi thin the Native Area (NA) dis-
trict.
This would cause:
a) the front approximately 200 feet of the property (including parcel
#10243 which has the existing conch house on it) to remain in the SC
district.
b) The next approximately 150 feet south of this would remain in the IS
district.
c) The remaining southerly portion of the property would be change to
NA. There is presently no NA district adj acent to the parcel or
within the immediate vicinity.
The si te consists of a filled disturbed area in the front, vegetated
mainly with grasses and invasive exotic plants. South of this is a
mangrove wetland and open water. The area to the east is occupied by
single family houses (22nd street), to the west is vacant wetland proper-
ty rln the rear and existing businesses on U.S.l.
Findings of Fact:
The following findings were made during review:
Since there is no NA district in the area, this change would not involve
simply the redrawing of boundary lines. It is felt that the mangrove
area should have been included within the NA land Use District and this
could perhaps be treated as a mapping data error and changed as a map
amendment.
However, the filled area would not normally be included within the NA
district since it does not meet the stated purpose of the district as
stated in Section 9.5-210 of the Monroe County Land Development Regula-
tions. It would be more appropriate to handle such a change as a map
amendment.

Re Boundary Determination: ~Spisiak application for acreage

I) INTRODUCTION
The applicant is requesting a boundary determination for the refer-
enced property located on U.S.l in Marathon. It appears from the
strip map that the property is made up of three parcels (RE#s 102410,
102440, and 10243). These parcels are presently located within two
land use districts, Improved Subdi vision (IS) and Suburban Commercial
( SC ) .
The change is requested for the rear of parcels 102410 and 102440
which are peresently located within the IS district. The applicant
would like a portion of this area to be included within the Nati ve
Area (NA) district.
This would cause:
a) the front approximately 200 feet of the property (including
parcel #10243 which has the existing conch house on it) to
remain in the SC district.
b) The next approximately 150 feet south of this would remain in
the IS district.
c) The remaining southerly portion of the property would be
changed to NA. There is presently no NA district adjacent to
the parcels or within the immediate vicinity.
II) PROJECT DESCRIPTION
The site consists of a filled disturbed area in the front, vegetated
mainly wi th g'rasses and invasi ve exotic plants. South of this is a
mangrove wetland and open water. The area to the east is occupied by
single family houses (22nd Street), to the west is vacant wetland
property in the rear and existing businesses on U.S. 1.

III) STAFF REVIEW
The following findings were made during review:
Since there is no NA district in the area, this change would not in-
volve simply the redrawing of boundary lines. It is felt that the
mangrove area should have been included wi thin the NA land use dis-
trict and this could perhaps be treated as a mapping data error and
changed as a map amendment, or as a scrivener's error.
However, the filled area would not normally be included within the NA
district since it does not meet the stated purpose of the district as
stated in Section 9.5-210 of the Monroe County Land Development Regula-
tions. It would be more appropriate to handle such a change as a map
amendment.
IV) RECOMMENDATION
DENIAL--this request could not be accomplished through a boundary
determination.

RECOMMENDATION
It is recommended that the mangrove portion of the property be
which is presently within the IS district be treated as a
map error and that it be included within the NA land use dis-
trict. It is also recommended that inclusion of any part of the
disturbed portion of the property should be considered a map
change, more appropriately handled through the map amendment
process.
