( - L" ("1',' ~WHEREAS, Florida Statutes provides, in F.S. l25.0l(1)(h), a a:::: _ ~.:.pow~ to: ~e Board of County Commissioners of any county to L... z ~st~lisfi, ~oordinate and enforce zoning and such business u..... regulations as are necessary for the protection of the public, and WHEREAS, it is deemed necessary to provide guidance regarding the depth of review of occupational license certifica- tion by the Planning Department, WHEREAS, in order to efficiently utilize County personnel of the Planning Department for the performance of the multitude of tasks assigned to them, now, therefore, BE IT RESOLVED by the Board of County Commissioners of Monroe County, Florida, as follows: Section 1. The Board of County Commissioners hereby directs that the depth and level of review by Planning Department personnel of occupational license certification shall be limited to: a) A certification of whether or not the zoning for the proposed business is appropriate for the activity described. b) A certification that there is, by the application, no contemplated change from by-right property usage to a minor conditional property usage or a change from a minor conditional property usage to a major conditional property usage. c) Certification that there is an actual street address verified as to where the business is located, with such certification being determined either by the Planning Department or the Code Enforcement Department. d) Certification that full and complete information is given by the applicant relative to the capacity, number of persons employed, or other contingency, as the case may be. e) Certification of appropriate Florida Statutes 509 statutory requirements for public lodging establishments and public food establishments, as defined in that statute to include F.S. 509.271. Section 2. Planning Department certification shall be denied for failure to meet criteria in Section 1, above. Section 3. The county occupational license review fee by the Planning Department is hereby reduced to $25.00. Section 4. The county Home Occupational permit review fee by the Planning Department is hereby reduced to $200.00.
