Please consider this document as a formal and final notice of non-payment on the above listed
project.To date the amount owed is 36,644.93 and dates back to August 07.The terms of the
contract were"net 30 days from date of Invoice"This amount represents the entire fire alarm
system and has basically been STOLEN from my company.We had to use monies from other
areas to pay the factory for the equipment we supplied for this project.Overholt Construction,as
the GIC on this project,has the duty to make sure all sub contractors get paid,and has fallen short
on that obligation.Since they have obtained their CO on this project,seeing to It that the low man
on the totem pole gets paid is not of their concern.
Being excepted to waft almost a solid year for monies rightfully due my company is ridiculous.We
are a material supplier and are not subject to retalnage and will not wait for our payment any
longer.If payment of the above listed amount Is not received within 7 days,we will be Ming a
claim against the payment bond on this project as stipulated in the Notice to Owner drawn on this
project.
