code prior to September 15, 1986; and
WHEREAS, the current Land Use district boundaries were placed
in error with the adoption of the September 15, 1986 Land Develop-
ment Regulations, and therefore the subsequent maps were also in
error, as they did not follow the previous demarcated residential
boundary;
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA THAT:
The administrative decision of the Planning Director in Land
Use District Map Boundary Interpretation Number 58 dated March
27, 1990, which recommends approval is hereby acknowledged and
found to be in conformance with the standards set forth in Section
9.5-3(m), Monroe County Code, and therefore approved.
The Clerk of the Board is hereby directed to forward a certi-
fied copy of this resolution to the Florida Department of Communi-
ty Affairs.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe
County, Florida, at regular meeting of said Board held on the 18th
day of April, A.D., 1990.

Recommended Action:
Patricia Hennessy is requesting a boundary determination for Mate's
Beach subdivision, Block 1, Lots 92 & 93, located on County Road, Little
Torch Key. Ms. Hennessy requests that the two lots be changed from
Native district (NA) to the Improved Subdivision (IS) district.

Background:
Only three lots in Block 1 of Mate's Beach subdivision are in the Native
district. One lot is the most westerly lot in the block, the other two
are the lots owned by Ms. Hennessy. All other lots in Block 1 are in
the Improved Subdivision land use district.
Prior to September 1986, the lots were zoned (GU) General Uses.'
The lots comply with the purpose of the
lawfully established lots prior to the
development regulations.

Both lots 92 & 93 are scari fied lots created years ago by dredge and
fill methods. There is an older house on lot 93. This lot is devoid of
vegetation except for a few mature Coconut palms. Ninety five percent
of lot 92 is vegetated with exotic pest species Brazilian Pepper. A few
specimens of the native species Buttonwood, Black bead, and Seagrapes
occur on the lot. The saw cut canal bank is vegetated with Buttonwoods.
Neither of the lots reflect the purpose or intent of the Native Area
(NA) land use district. It appears that the NA boundary line was incor-
rectly drawn and it is recommended that lots 92 & 93 be changed to the
Improved Subdivision (IS) land use designation.
Findings of Fact:
1. Lots 92 & 93 are located in a subdivision that was ,lawfully estab-
lished prior to the adoption'of the current land development regula-
tions and the current land use district maps.
2. Lots 92 & 93 comply with the purpose of the Improved Subdivision
district.
3. Lots 92 & 93 do not reflect the purpose or intent of the Native Area
Land Use District.
4. The Land Use District maps signed by Charles Pattison are in error,
because thi s lots do not meet the purpose of the Native Area Land
Use District.

Boundary Determination for Ms. Patricia Hennessy
I) INTRODUCTION
Patricia Hennessy is requesting a boundary determination for
Block 1, lots 92 & 93, Mates Beach subdivision, located on Coun-
ty Road, Little Torch Key.
II) PROJECT DESCRIPTION.
Ms. Hennessy request s that the two lots be changed from the
Native Land Use District to the Improved Subdivision Land Use
District.
III) STAFF REVIEW
Only three lots in Block 1 of Mate's Beach Subdivision are in
the Native land use district. One lot is the most westerly lot
in the Block, the other two are lots owned by Ms. Hennessy. All
the other lots in Block 1 are in the Improved Subdivision dis-
trict.
The lots comply with the purpose of the improved subdivision and
were lawfully established lots prior to the adoption of the cur-
rent land development regulations.
Both lots 92 & 93 are scarified lots created years ago by dredge
and fill methods. There is an older house on lot 93. This lot
is devoid of vegetation except for a few mature coconut palms.
Ninety five percent of lot 92 is vegetated with the exotic pest
species Brazilian Pepper. A few specimens of the native species
Buttonwood, Black bead, and seagrapes occur on the lot. The saw
cut canal bank is vegetated with Buttonwood.
Neither of the lots reflect the purpose or intent of the Native
Area (NA) land use district. It appears that the NA boundary
line was incorrectly drawn and it is recommended that lots 92
and 93 be changed to the Improved Subdivision (IS) land use des-
ignation.
The following findings were made during review:
1. Lots 92 & 93 are located in a subdivision that was lawfully
established prior to the adoption of the current land devel-
opment regulations and the current land use district maps.
2. Lots 92 & 93 comply with the purpose of the improved subdivi-
sion district.
3. Prior to September 1986, the lots were zoned GU.
4. Lots 92 & 93 do not reflect the purpose or intent of the
Native Area land use district.
IV) RECOMMENDATION
The planning staff and the biologist agree with Ms. Hennessy's
request.
