A RESOLUTION OF THE BOARD OF COUNTY COm1IS-
~SIONERS OF MONROE COUNTY, FLORIDA, REMANDING

WHEREAS,
Seanic Corporation applied to the Planning
Commission for a modification to their approved major development
known as Captain's Cove for the redesign of the original forty-
six (46) townhouses located on part of tract 5, Matecumbe Sandy
Beach Subdivision, Lower Matecumbe Key, MM 75, Section 20,
Township 64S, Range 36E, and
WHEREAS, in Resolution No. 11-90 the Planning Commission
determined that they no longer had jurisdiction over the matter
because the applicant requested a modification to a major
development under Article VII of the previous Monroe County Code,
and they, therefore, could not grant the relief that was sought,
and
WHEREAS, Seanic Corporation then timely perfected this
appeal, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
Section 1. This Board, having examined the record below,
and otherwise being fully advised in the premises, hereby finds
that based upon and subject to a verification of the genuineness
of former Resolution No. 261-1987, that the finding is that the
Planning Commission has jurisdiction to act as the Zoning
Commission and should further entertain whatever pending matters
the appellant's attorney may bring before them as may relate to
the Captain's Cove proj ect; therefore, this appea 1 is hereby
remanded to the Monroe County Planning Commission.
Section 2. The Clerk of the Board is hereby directed to
forward a certified copy of this Resolution to the Department of
Community Affairs.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of the Board held on
the 8th day of May, 1990.
