C lu -.i RBSOLU'l'ION NO. 293 - 1990 lL.. o ~ A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA RELATING TO COMPREHENSIVE LAND USE PLANNING AND PROVIDING FOR PUBLIC PARTICIPATION PROCEDURES IN THE COMPREHENSIVE PLANNING PROCESS WHEREAS, pursuant to , and in accordance with Florida statutes, Chapter 163, Part II, it is the intent of the Florida Legislature that the public participate in the local comprehensive planning process to the fullest extent possible; and WHEREAS, pursuant to county Code section 9.5-22, the Monroe county planning Commission, is responsible for the preparation and implementation of the county's comprehensive plan, as the local planning agency, in accordance with Florida statutes, Chapter 163, Part II; and WHEREAS, pursuant to, and in accordance with Florida statutes, Chapter 163, Part II, the Monroe County commission hereby declares its intent and purpose in adopting this Resolution to encourage public participation in the comprehensive planning process to the fullest extent possible before both the local planning agency and the governing body of Monroe County, Florida, and to establish procedures which shall provide for: A) Citizens Advisory Committees B) Public Participation Workshops C) Public Hearings before the local planning agency and the local governing body who shall consider and respond to public comments, D) Notification E) Dissemination of Proposals and Alternatives F) An opportunity for submission of Written comments G) Open Discussions, and H) communications Programs and Information Services NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, TO WIT: 1 A) CITIZENS ADVISORY COMMITTEES: The public shall be encouraged to participate in the comprehensive planning process through the establishment of Citizens Advisory Committees as outlined in Attachment "A", attached hereto and incorporated herein. Three Citizens Advisory Committees shall be appointed by the County Commission one for the study of Transportation issues, one for the study of Environmental issues and one for the study of Water Quality issues. Each Committee shall meet and serve in an advisory capacity to the Growth Management Division and the Local Planning Agency as directed by the County Commission. B) PUBLIC PARTICIPATION WORKSHOPS: The public shall be encouraged to participate in the comprehensive planning process through the scheduling of Public Participation Workshops as outlined in Attachment "B" attached hereto and incorporated herein. The intent and purpose of the Public Participation Workshops shall be to provide a forum for the citizens of Monroe County to share and exchange information with the Growth Management Division regarding the comprehensive planning process. Any and all information solicited and received from the public shall be considered in the preparation of the Monroe County Comprehensive Plan. C) PUBLIC HEARINGS: Public hearings shall be held by the local planning agency and the local governing body after due public notice, pursuant to the requirements of the Florida Statutes, Chapter 163, PART II, for consideration of, and action regarding adoption of the comprehensive plan. Public hearings before the Planning Commission and the Board of County Commissioners for adoption and transmittal of the revised and updated Monroe County Comprehensive Plan have been scheduled as follows: *Public hearings before the Planning Commission: July 23-31, 1990 *Public hearings before the Board of County Commissioners: August 7-22, 1990 2 D) NOTIFICATION: "Public notice" as used in connection with the phrase "public hearing" or "hearing to be held after due public notice" before the local planning agency and local governing body means publication of notice of the time, place, and purpose of such hearing at least twice in a newspaper of general circulation in the area, with the first publication not less than 14 days prior to the date of the hearing and the second to be at least 5 days prior to the hearing. Meetings other than the public hearings required by Chapter 163, Florida statutes, such as citizens Advisory Committees and the Public Participation Workshops shall be held after the provision of reasonable public notice, as directed by the County Commission. E) DISSEMINATION OF PROPOSALS AND ALTERNATIVES: The Comprehensive Plan Team of the Monroe County Growth Management Division shall make available for public inspections, any and all proposals for amendments to the comprehensive plan and any other documents prepared during the comprehensive planning process at least at the following locations: *Monroe County Growth Management Div., Jr. College Rd. Any and all written comments received shall be made a matter of public record, and shall be considered in the preparation of the Unincorporated Monroe County Comprehensive Plan. G) PROVISIONS FOR OPEN DISCUSSION: The public shall be encouraged to express their views regarding proposals relating to the adoption of amendments to the comprehensive plan during the comprehensive planning process, including citizens Advisory Committee meetings, Public Participation Workshops and Public Hearings. H) COMMUNICATIONS PROGRAMS AND INFORMATION SERVICES: Pursuant to the Comprehensive Plan's Citizen Participation Element, the County Growth Management Division shall establish and maintain a Coordination-by-Notification mailing list, which shall include affected units of local government, governmental agencies, special districts, community groups, civic associations and the general public. The Growth Management Division shall transmit to these entities, the notices and agendas of any 4 public hearings, meetings or workshops, and upon request, any minutes, preliminary drafts, final drafts and other relevant information regarding the preparation and adoption of the comprehensive plan. Any interested persons may request to be included on any mailing list, which deals with subject matter in which they are interested by contacting the Growth Management Division. These mailing lists shall be maintained by the Growth Management Division for the duration of the process for which they are developed. It is the intent of the Monroe County Board of County Commissioners that the public participation procedures outlined herein shall be substantially complied with in carrying out the comprehensive planning process. Any deviation from public participation procedures, including those outlined herein, when otherwise consistent with the requirements of law, shall not affect the validity of any official action of the governing body.
