A RESOLUTION CONFIRMING THE ADMINISTRATIVE
BOUNDARY INTERPRETATION OF THE PLANNING
DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY
INTERPRETATION NUMBER 61, LOTS 2, 3 & 4,
BLOCK B, SHERYL SUBDIVISION *2, SECTION
11, TOWNSHIP 66 SOUTH, RANGE 32 EAST,
TALLAHASSEE MERIDAN, KEY VACA, MARATHON.
WHEREAS, the property described in the Planning Department
Report of May 29, 1990, Lots 2, 3 & 4, Block B, Sheryl
Subdivision *2, Marathon Key, containing the C & S Bank (formally
Marine Bank) was correctly zoned BU-2S under the Zoning Code in
effect prior to September 15, 1986; and
WHEREAS, the current Land Use district boundaries were placed
in error with the adoption of the September 15, 1986 Land Develop-
ment Regulations, and therefore the subsequent maps were also in
error, as they did not follow the previous demarcated commercial
boundary;
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA THAT:
The administrative decision of the Planning Director in Land
Use District Map Boundary Interpretation Number 61 dated May
29, 1989, which recommends approval to designate Lots 2, 3 & 4,
Block B, Sheryl Subdivision *2 as Suburban Commercial is hereby ac-
knowledged and found to be in conformance with the standards set
forth in Section 9.5-3(m), Monroe County Code, and therefore ap-
proved.
The Clerk of the Board is hereby directed to forward a certi-
fied copy of this resolution to the Florida Department of Communi-
ty Affairs.

Recommended Action:
Monroe County Planning Department recommends that the Board of County
Commissioners allow the requested boundary line adjustment so that Lots
2,3 & 4, Block B, Sheryl Subdivision #2 be included in the existing
Suburban Commercial (SC) Land Use District.
Background:
The four lots under the banks ownership were platted as a portion of
Sheryl Subdivision #2 on February 4, 1958. In 1959 a structure was
built as a bowling alley on portions of lots 2, 3 & 4. The bowling
alley continued in operation until the latter part of 1985 when the
property was acquired by Marine Bank. On July 25, 1986, the bank re-
ceived a building permit (B 12140) to remodel the existing building into
a data processing center. The estimated cost of remodeling was $300,000.
The four (4) lots currently owned by C & S were zoned RU-1 and BU-2 in
1973. In 1983 the property owners, David C. and Pamela L. Quiring re-
quested a zone change (6zbjl0-83) on all four (4) lots from RU-1/BU-2 to
BU-2S, which action would make their bowling alley a conforming use.
The requested zone change was approved unanimous vote of the Zoning
Board. When the county was rezoned in 1986 (effective date: 15, Septem-
ber 1986), lot 1 was zoned Suburban Commercial (SC) and Lots 2, 3 & 4
were zoned Improved Subdivision (IS)
Findings of Fact:
1. The current application was filed by Marine Bank, but that institu-
tion has since been purchased by Citizens and Southern Bank of Atlanta,
Georgia, dba C & S Bank;
2. The bank owns and occupies a building, that is situated on lots 1,
2, 3 & 4, Block B, Sheryl Subdivision, as a data processing center;
3. The subject property is listed as lots 2, 3, & 4, Block B, Sheryl
Subdivision #2;
4. Lot 1 is located in a Suburban Commercial (SC) land use district;
5. Lots 2, 3, & 4 are located in an Improved Subdivision (IS) land use
districts;
6. All four (4) lots were previously zoned BU-2S;
7. The existing building was built as a bowling alley in 1959 and con-
tinued as such until the latter part of 1985;
8. Marine Bank purchased the property in September 1985;
9. Marine Bank obtained a building permit in July 1986 allowing remodel-
ing of the bowling alley into a data processing center;
10. On September 15, 1986 the County rezoned the BU-2S zoning on lots 2,
3 & 4 to Improved Subdivision (IS);
11. The subject property has had contiuous commercial use since 1959
either as a bowling alley or an office building, except for the relative-
ly short period of time between the closing of the bowling alley and the
purchase/remodeling/opening of the data processing center;
12. The County biologist, Pat McNeese, in her evaluation states that
"there are apparently no environmental considerations involved with this
boundary determination as the subject property and immediate adjacent
areas are fully developed;
13. The subject property is adjacent to and contiguous with the Suburban
Commercial land use designations that fronts on US #1;
14. The Existing Condition Maps incorrectly show the area as residential;
15. The map signed by Charles Pattison used the Existing Conditions Map
as basis to establish boundaries and thus is in error;
16. The Existing Conditions Maps, and the map signed by Charles Pattison
is imprecise and require interpretation to establish correct location of
boundaries;

INTRODUCTION
This is an application by C & S Bank (formerly Marine Bank) for a
boundary line determination in which the bank asserts that the
County erred in zoning a parcel of land, which the bank owns and
occupies as a data processing center, as Improved Subdivision
(IS). It is the banks contention that the property should have
been designated Suburban Commercial (SC) since the subject proper-
ty is contiguous to an existing Suburban Commercial (SC) Land Use
District. The banks ownership comprises four (4) lots, one of
which (lot 1) presently has an SC land use district designation
and the remaining three (3) (lots 2, 3 & 4) have a LUD designa-
tion of IS.
LEGAL DESCRIPTION
The subject property is described as lots 2, 3 & 4; block B;
Sheryl Subdivision #2. Lots 1, 2 & 3 comprise Real Estate #339920
(Alt. key #1417530), and lot 4 is listed as RE #339950 (Alt. key
#1417564). All parcels are located in Section 11, Township 66
South, Range 32 East, Tallahassee Meridian, Key Vaca, Florida.
SITE DESCRIPTION
All four (4) of the lots are presently being occupied and used by
the bank in conjunction with their data processing center. All of
lot 1 and the north 1/2 of lot 2 is utilized as a parking lot.
The south 1/2 of lot 2 and lots 3 and 4 are occupied by a single
story remodeled bowling alley. The building has outside dimen-
sions of approximately 140 ft. x 74 ft., for a total area of
10,360 sq. ft.
PROPERTY HISTORY

existing building into a data processing center. The estimated

ZONING HISTORY
The four (4) lots currently owned by C & S Bank were zoned RU-1

FINDINGS OF FACT

center;
12. The County biologist, Pat McNeese, in her evaluation
states that "there are apparently no environmental con-
siderations involved with this boundary determination as
the subject property and immediate adjacent areas are
fully developed";
13. The subject property is adjacent to and contiguous with
the Suburban Commercial land use designation that fronts
on U. S. # 1 .
EVALUATION
Based upon the preceding findings of fact it would appear that
the County did in fact err in the zoning of lots 2, 3 & 4, block
B, Sheryl Subdivision #2 as Improved Subdivision (IS) since the
property is adjacent to a Suburban Commercial (SC) LUD; has been
in continuous commercial use since 1959; was zoned for commercial
use by the County in 1983; and in 1986 the County permitted exten-
sive interior remodeling of the existing structure so that it
could be used as a data processing center.

It is the recommendation of the staff of the Monroe County Plan-
ning Department that the Board of County Commissioners allow the
requested boundary line adjustment such that the Land Use Designa-
tion on lots 2, 3 & 4, block B, Sheryl Subdivision *2 be changed
from Improved Subdivision (IS) to Suburban Commercial (SC).

property who objected. ~ich placed the 4/5 rule in order, a motion was made by
Mrs. Johnson~ to hear this case, and not send it back to Marathon to be heard. This .
motion was seconded by Miss Sunderland. Roll call was taken, and the motion passed
unamiously to bear this case.
After discussion. a motion was made by Mrs. Johnson. to approve this request
pursuant to Section 19-75 (c) (1) of the Monroe County Code. This motion was
secQpded by Miss Sunderland. Roll call was taken. and the motion carried unamiously
to approve this request.

address this matter. Also. that the shoreline protection zone be indicate on the
map as submitted by the applicant. The motion carried unamious1y, to hold this

INTRODUCTION
The applicant' s building is located on the referenced property, ,.
which is shown on the Monroe County Land Use District Maps to be
located within the Improved Subdivision (IS) land use district.
The The adjacent property to the north (Lot 1) is located within
the Suburban Commercial (SC) land use district. The applicant is
requesting that this line be moved 'to the south so that the refer-
enced property is also included within the SC district.
SITE DESCRIPTION
A site inspection of the referenced property was made on May 1,
1989. There is an existing building on the referenced property
which appears to be a office building. The apparant uses of the
adjacent properties are as follows:
north: office building
south: single family homes
east: apartment building and single family homes
west: apartment building, car repair and gas station
EVALUATION
There are apparantly no environmental considerations involved
with this boundary determination as the subject property and
immediate adj acent areas are fully developed. Therefore, the
planning department must determine whether an error in mapping
was made based on the use of the property.
RECOMMENDATION
It is recommended that this boundary determination be made by the
Planning Department based upon the use of the property and that
the Environmental Resources Department will fully concur with
thier recommendation.
