RESOLUTION NO. 395-1990
A RESOLUTION REVERSING THE DECISION OF THE
MONROE COUNTY PLANNING COMMISSION IN DENYING
BOOT KEY HARBOR PLAZA A MAJOR CONDITIONAL USE
FOR A SHOPPING CENTER AND MARINA TO BE
LOCATED ON KEY VACA. MONROE COUNTY. FLORIDA.
WHEREAS, Boot Key Harbor Plaza's application for a major
conditional use approval for a shopping center and marina on
property located at Section 10, Township 66, Range 32, Key Vaca,
South of US 1, was denied by the Planning Commission at a meeting
held on 2-15-90;
WHEREAS, the Planning Commission's decision was rendered as
a written order on 3-15-90;
WHEREAS, Boot Key Harbor Plaza timely appealed that decision
to this Board as authorized by Sec. 9.5-521, Monroe County Code;
WHEREAS, this Board has examined the evidence and record
below, heard the argument of the parties, and being fully advised
in the premises; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
The Planning Commission erred when it
determined that the major conditional use did not meet the
requirements of Sec. 9.5-65(a-i), Monroe County Code. A detailed
examination of the record below indicates that the proposed major
condi tional use ~ meet those requirements.
Therefore, the
appeal of Boot Key Harbor Plaza is granted and the decision of
the Planning Commission of 2-15-90, reduced to writing on
3-15-90, which denied the Boot Key Harbor Plaza major conditional
use application, is reversed. Any stipulated agreements made by
the applicant concerning conditions are hereby adopted and made
part of this Resolution.
Section 2.
The Clerk of the Board is hereby directed to
mail a certified copy of this resolution to the Key West office
of the Florida Department of Community Affairs.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of the Board held on
