AGENDA ITEM WORDING: Discussion and approval to add Old Settlers Park of Tavernier to
the list of parks open to dog exercising on leach restraints, by the Tavernier Community
Association. Association also requests that waste bags be placed at the park for ease of pet

ITEM BACKGROUND: Historically, the Old Settler's Park has been a popular place for regular
dog walking by neighborhood residents. Residents would like to see this convenient local park
reopened for dog walking. Attached is a copy of the letter and resident signatures.
PREVIOUS RELEVANT BOCC ACTION: Ord. #037-2000 Prohibition of dog-walking in most County
Parks.

the members voted to request the county to add Old Settlers Park to the lost of parks friendly to
domesticated animaJs. They are aware that pets must be restrained in ~TTJe fashion to meet the
county's leash laws.
The membersbip further requeSf.S that Some sort of 'pick-up' matcrials be provided for pet
owners in order to make it easy for them to police their animals,

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, AMENDING SEC. 3-7(5) AND SEC. 13.5-
5, MONROE COUNTY CODE, IN ORDER TO PROHIBIT ALL DOMESTIC
ANIMALS, EXCEPT .,NIMALS THAT ASSIST DISABLED PERSONS,
FROM ALL MONROE' COUNTY FACILITIES, PARKS AND BEACHES,
EXCEPT THAT PART OF STOCK ISLAND LOCATED WITHIN THE CITY
OF KEY WEST AND ALL COUNTY ANIMAL SHELTERS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF All
ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR
INCORPORATION INTO THE MONROE COUNTY CODE OF
ORDINANCES; AND PROVIDING AN EFFECTIVE DATE

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA:
Section 1. See. 3-7(5), Monroe County Code, IS hereby' amended to read as
follows:
(5) (a)It is unlawful ror a dog OWner or keeper to allow an unleashed dog
upon any school grounds.
(b) It is unlawful for a dog oWner Or keeper, either Willfully Or
negligently. to permit the dog, to derecate upon any private property
without the permiSSion or the owner. A dog Owner or keeper is required to
remove the dog.s reces from any school grounds or any private property
upon which the dog is not permitted to defecate.
(c) Except for animals that assist disabled persons, domestic animals are
prohibited from all county parks and beaches not SpeCified in subsection d)
No person may cause or allow any domestic animal (of whatever sIZe) other
than an animal that assists a disabled person to be brought to, or remain
on, any county park or beach, with the exceptions of parks and l}.eaches

(d) Pets are permitted to be taken to Key Largo Park in Key Liit~n~
Sombrero Beach Park in Marathon, subject to pet-friendly park rea<idio~

If this subsection (5) is Violated, the department is authorized tP'remo~
the animal or. in ItS discretion, to order the owner or keeper to d&sd'o T~
OWner or keeper shall immediately remove any excrement deposited by the
animal. Failure to do so immediately shall constitute an additional violation
of this section.

~ectlQnj See. 13.5-5, Monroe County Code IS hereby amended by the addiUon
of the following:
(m) Except for animals that assist disabled persons, all domestic animals
are Prohibited from all county parks other than Key Largo Park in Key Largo
and Sombrero Beach Park In Marathon. No person may cause or allow, any
domestic animal (of whatever Size) other than an animal that assists a
disabled person to be brought to, Or remain on, any county park other than
Key Largo Park and SO~brero Beach Park.

(n) All pets at Key largo Park and Sombrero Beach Park are Subject to
the following regulations:
(i) Pets must be leashed on a leash no greater than 8 feet long,
unless and while in the water and wet sand area of Sombrero Beach
Park.
(ii) Owners must clean up after pets and properly dispose of waste.
(iii) Pets exhibiting aggressive behavior Or creating a nuisance must
be immediately removed from the park.
Section 3. If any Section, sUbsection, sentence, clause Or prOVIsion of this
ordinance is held invalid, the remainder of this ordinance shall not be affected by such
invalidity.
Section 4. All ordinances or parts of ordinances In confiict with this ordinance
are hereby repealed to the extent of said Conflict.
Section S. The provisions of this ordinance shall be Included and incorpOrated in
the Code of Ordinances of the County of Monroe, Florida, as an addition Or amendment
thereto, and shall be appropriately renumbered to conform to the uniform numbering
system of the Code.
Section 6. This ordinance shall take effect immediately upon receipt of official
notice from the Office of the Secretary of State of the State of Florida that this ordinance
has been filed with said Office.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida,
at a regular meeting of said Board held On the 14th day of June, 2000.
