PLANNING COMMISSION RESOLUTION NO. 48-1990
WHICH DENIED AN ADMINISTRATIVE APPEAL
CHALLENGING THE ISSUANCE OF A BUILIDNG PERMIT
TO REPLACE A MOBILE HOME ON CERTAIN REAL
PROPERTY ON UPPER MATECUMBE KEY.

WHEREAS, Planning Commission Resolution No. 48-1990 denied
the administrative appeal of Roy J. and Jean D. Murphy
challenging the legality of the issuance of a building permit for
a replacement mobile home issued to Joseph Bauer for Lot 2, Sec.
32, Township 63S, Range 37 East, Upper Matecumbe Key;
WHEREAS, the Murphys timely perfected an appeal of Planning
Commission Resolution No. 48-1990 to this Board;
WHEREAS, the Board has examined the record below, heard the
argument of the parties, and no error having been made to appear;
now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
Section 1. The appeal of Roy J. and Jean D. Murphy of

Planning Commission Resolution No. 48-1990 is hereby denied and
the decision of the Planning Commission affirmed.
Section 2. The Clerk of the Board is hereby directed to

forward a certified copy of this Resolution to the Key West field
office of the Florida Department of Community Affairs.
