SUBJECT: Islamorada Conflict Resolution Meeting

On January 11, 2001, the Board of County Commissioners met with the Islamorada
Council in a conflict resolution session. One of the results of that meeting was that Islamorada
was to submit a list of proposed projects for which County funds could be utilized. That was
accomplished and the list was previously submitted to you. In order to clarify the issues, on
January 29,2001, Mayor Neugent and I met with Councilman Levy and the City Manager. The
following is a result of that session.
A decision was made to concentrate on Islamorada's priority issues as follows:
1. Land Authority - The Village would like a commitment that a certain amount
of funds will be spent within the Village. The Village is not asking that funds
be transferred to it but that over a period of time $2,341,373 be dedicated for
purchases. (Please review the attached project sheet.) Also, the Village would
like the County to continue its support for legislation allowing municipalities
to apply directly for state funding.
2. In reference to their request for road & bridge funds, which requests totaled
$1,466,000, the rationale for providing some funds is to use them on the old
County road that parallels Route 1. Improving that road is estimated at
$969,000. The other requests are discontinued. It would be necessary for the
attorneys to work out the actual legal mechanism for the County to spend
those funds.
3. Upper Keys Health Care Taxing District - Islamorada feels that it is entitled to
$1,181,000 of those funds. There was discussion concerning utilization of
some of that amount for two ambulances, capital equipment, work on EMS
facilities and two extrication devises for utilization at crash scenes. The total
is $440,000 and, if approved by the BOCC, would conclude their issues
pertaining to the Trauma District. It should be noted that the citizens of the
Village would continue to receive financial assistance, if appropriate, from the
District.

4. Unincorporated Parks & Beaches Taxing District - The MSTU-Parks, as it is
termed by the Village, includes a $751,000 fund balance. The Village is
requesting that near $128,000 be made available. After discussion, one of
four projects was deemed to have a relationship to County facilities. That is
improvement of the road and parking at the Islamorada Library for $80,000.
5. tunicipal Services Taxing Unit for Growth Management - The Village
contends that it did not receive services for taxes collected from Village
property owners to support this district after the incorporation occurred. ~The
County's position is that many of the services continued and that there were
additional activities necessary for the transition. @The Village states that the
period in question includes about $686,000 in taxes collected (a recalculation
of the $884,000 figure on your project sheet). ~e discussion concerned a
reduction of that amount by 30% to represent the continuing work the Coun
did~e result is a proposed $480,500 in tax collections to the
Village. Since attorneys were not present, it was not possible to identify a k

The discussion about these issues was reasonable and cooperative. It is our
understanding that if these can be resolved between the two Boards, the balance of the requests
will no longer need to be considered.

SUBJECT: Fund Balance Request by Village of Islamorada
Based on the documentation provided by the County Administrator, it is my understanding the
Village of Islamorada requests 12.5% or $2,341,373 as its "fair share" of the Land Authority's
9/30/98 fund balance of $18,730,981.
The fund balance figure was apparently taken from the County's 1998 CAFR report. There is
little basis for using this figure for this purpose, as it is primarily based on non-liquid assets such
as the value of property already purchased {$11 million} and the value of mortgages due in 50
years {$492,214}, rather than cash available to be spent in Islamorada.
Furthermore, when considering Islamorada's "fair share" of the fund balance, one must note that
a substantial portion of Land Authority funds come from State park surcharge revenue. There
are no State parks in Islamorada providing this revenue.
A more appropriate "fair share" basis would be the tourist impact tax revenue {the 4th cent tax on
lodging}, which is collected in Islamorada. The Land Authority's land acquisition revenue from
this source totals $12,173,271 through 9/30/98. Assuming 12.5% of this revenue came from
lodging in Islamorada, Islamorada's share of the total would be $1,521,659.
The documentation provided by Islamorada omits the Land Authority's expenditures within the
Village {$1,441,118}. Subtracting these expenditures from Islamorada's share of $1,521,659
leaves a balance of $80,541. In other words, the Land Authority's revenues and expenditures
within Islamorada have been virtually equal.
With respect to addressing the minor balance of $80,541, the Land Authority has already added
to its Acquisition List those properties nominated by the Village Council. Said properties have a
total assessed value of over $3.3 million, three of which are currently under contract for
$55,643.
