RESOLUTION NO. 459-2002
A RESOLUTION BY THE MONROE COUNTY
BOARD OF COUNTY COMMISSIONERS
EXTENDING THE SECOND ALLOCATION
PERIOD IN 2002 OF NON-RESIDENTIAL
FLOOR AREA TO NOVEMBER 15, 2002,
LIMITING THE APPLICATIONS TO 2,500
SQUARE FEET OR LESS AND MAKING
11,000 SQUARE FEET AVAILABLE FOR
ALLOCATIONS.
WHEREAS, Policy 101.3 of the Monroe County Year 2010 Comprehensive Plan
(2010 Plan) requires Monroe County to regulate non-residential development to maintain
a balance of land uses; and
WHEREAS, Section 9.5-124 Non-residential rate of growth ordinance
(NROGO), approved by the Board in September 2001, provides for an allocation point
system for non-residential floor area, which maintains the ratio of 239 square feet of non-
residential floor area for each residential unit developed as required in the 2010 Plan.
WHEREAS, residential development has continued since implementation of the
Plan in January 1996 and by December 2000 had equaled the non-residential permits
issued before January 1996; and
WHEREAS, the amount of non-residential floor area available through July 2002
for allocation in NROGO is 44,300 square feet; and
WHEREAS, the Board of County Commissioners in Resolution #317-2001
provided that the first allocation of non-residential floor area be limited to twenty-two
thousand, one hundred and fifty (22,150) square feet and that amount be made available
in two allocations, the first allocation of eleven thousand, one hundred and fifty (11,150)
square feet and the remainder to be held in reserve for the second allocation.
WHEREAS, the first annual allocation date was approved for January 1, 2002;
extended to February 1, 2002, and then to August 31, 2002 and the second allocation date
was approved for July 1, 2002.
WHEREAS, the approved allocation and award of NROGO has been delayed
because the Department of Community Affairs approval of NROGO has been challenged
and awaiting a Formal Administrative Hearing since March of2002.
WHEREAS, the Planning Director did not request the Board to allocate non-
residential floor area for the second allocation period of July 1, 2002, because the appeal
had extended the first allocation period and submittal deadline to August 31, 2002.
WHEREAS, applications for non-residential floor area for allocation awards in
2000 exceeded the 11,150 square feet of floor area available for the first allocation period
which ended August 31, 2002.
WHEREAS, the Planning Director recommends that the second allocation period
for 2002 be for eleven thousand (11,000) square feet, that applications be limited to 2,500
square feet or less of floor area and that the application deadline be extended to
November 15, 2002.
NOW THEREFORE; be it resolved by the Board of County Commissioners of
Monroe County, Florida, that the second allocation period is extended to November 15,
2002, that the applications are limited to 2,500 square feet or less in size, and that eleven
thousand (11,000) square feet non-residential floor area is available for allocation.
