Resolution 346-1980RESOLUTION NO, 346 -1980 WHEREAS, THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, has received an application from Wilbur'M, Mead, and WHEREAS, in compliance with State Statute, it is necessary as part of the permitting procedure to read the following Biological Assessment into the Record, as follows; The Applicant proposes to; Fill a tide pool (photo 1) which has become stagnant due to natural filling of the single circulation culvert, (Photos 2 & 3) This area is the landward extent of resort property and adjacent to boat mooring area. Impact of this project will be the removal of a source of water which may have a low D.O. The activity will require 1200 cubic yards of fill placed waterward of .'l.H.�►. The pool has become stagnant as a result of clogging in the water circulation culvert. Observed in the tide nool were snapper, grunt, Cassiopia and the venetation ualimeda so., Syringodium filiforme, and a reddish -brown algae. The Syrinaodium was heavily epiphytized with this algae and algal "scum" was seen floating on the water surface and along the shoreline. The applicant reported an offensive oder coming from the pool and fish kills during the summer. RECOMMENDATION: Approval with stipulation that fish and other marine fauna are removed prior to filling. DER biosurvey attached. V &AN SECRETAnY Re: Monroe County, Filling, Tide Pool, File No. 44-33202=5E Dear Mr. Mead: As we advised you on August 4, 1980 your application is incomplete without local approval, pursuant to Section 253.124, Florida Statutes, for filling waterward of 1 e existing mean/. ordinary 'nigh water line. Please submit the enclosed copy of our biological corents together with your permit application to the Board of County Ccmrsissioners/City Ccuncil or their authorized pe^fitting authority. Section 253.124, Florida Statutes, -states that the county co=ission/city council ". . .shall have in hand the (biological) report and findings thereof." It further states, "Toe report shall be read into the record and duly considered at the same meeting at which the board of county commissioners or otter authorized body takes final action on the -application for permit." You will need to obtain a copy of the minutes of the meeting or an appropriate indication of the local approval. This letter, resolution or copy of the minutes should be sent to this office.
