ORDINANCE NO. 004-1989
AN ORDINANCE DECLARING THAT AN EMERGENCY
EXISTS AND WAIVING NOTICE BY A FOUR-FIFTHS
VOTE PURSUANT TO F. S. 125.66; AMENDING
SECTION 13-32 OF THE MONROE COUNTY CODE
CONCERNING MEMBERSHIP OF THE MONROE COUNTY
TELEVISION TRANSLATOR BOARD; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF ALL
ORDINANCES OR PARTS THEREOF IN CONFLICT
HEREWITH; PROVIDING FOR INCLUSION IN THE
MONROE COUNTY CODE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, an emergency has arisen and the Translator Board
for Monroe County has been unable to transact business due to its
inability to find qualified members as stated in Section 13-32 of
the Monroe County Code; and
WHEREAS, it is the desire of the Monroe County Commission to
amend Section 13-32 of the Monroe County Code; now, therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
Section 1.
An emergency is hereby declared and notice is
hereby wavied by a four-fifths vote pursuant to F.S. 125.66.
Section 2.
Section 13-32 of the Monroe County Code is
hereby amended to read as follows:
"Sec. 13-32. Membership.
The Monroe County Television Translator
Board shall consist of five (5) members, one
(1) of each of whom shall be appointed by
each member of the Board of County commis-
sioners of Monroe County. Each member shall
be a resident and elector of Monroe County
and shall possess a reputation for integrity,
responsibility, civil accomplishment, and
professional or business ability. No board
member shall receive compensation for his
services as a member of such board. At no
time shall more than two (2) members be from
an identical geographical area as represented
by reception areas formed by the Key Largo
transmitter tower coverage, the Islamorada
transmitter tower coverage, the Grassy Key
transmitter tower coverage, the Summerland
Key transmitter tower coverage, or the Key
West transmitter tower coverage. Terms of
the members of this board shall be staggered
so as to assure continuation of board activ-
ities, but in no event shall a term be longer
than three (3) years."
Section 3.
If any section, subsection, sentence, clause
or provision of this Ordinance is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.
Section 4.
All ordinances or parts of ordinances in
conflict with this Ordinance are hereby repealed to the extent of
said conflict.
Section 5.
The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 6.
This Ordinance shall take effect when a
certified copy of this Ordinance has been accepted by the postal
authorities of the Government of the United States for special
delivery by registered mail to the Secretary of State of the
State of Florida.
