AGENDA ITEM WORDING: Discussion on capital program shortfall and direction to staff.
ITEM BACKGROUND: The capital program is approved annually by the BOCC. Due to increasing
wastewater commitments and the increased cost of large, ongoing projects the 304 budget cannot meets
its scheduled commitments. Staff is seeking direction on a project-by-project basis in order to
complete the assembly of the 2008 Capital Budget. Please see attached documents for individual
project analysis and staff recommendations.

Capital Program Analysis
City of Marathon City Hall / Monroe County Library Joint Facility (CC0605)
Present funding FY 2007 - $2.8 million
BOCC presented resolution to City of Marathon to spur decision on location and participation in
project. City of Marathon has discussed the issue. No formal response to County to date.
County applied for and was unsuccessful in securing library grant to assist with the construction ofthis
project ($500,000).
Alternatives:
1) Move funding to 2008 and reapply for $500,000 grant while working to secure site from the
City for joint project.
2) Move funding to 2008 and reapply for $500,000 grant while working to secure site for stand-
alone county facility.
3) Move funding out to 2010, directing staff to make application for grant in 2009. Continue to
work with City to determine joint-use or stand-alone facility now that we have additional time
to plan the project
4) Remove project from the budget and reallocate resources.
(Alternative #1,2 and 3 may require part, or all of the project to be financed depending on present fund
balance and expected fund income)
Staff Recommendation - Alternative #3 Move funding out to 20 10, directing staff to make
application for grant in 2009. Continue to work with City to determine joint-use or stand-alone
facility now that we have additional time to plan the project.
Marathon Courthouse Renovation (CG9810)
Present Funding FY 2007 - $ 0
Much needed renovations to the Marathon Courthouse are long overdue. County Administration met
with the Chief Judge to discuss program alternatives and to gain insight on the level of use of the
facility and concerns with the present state of the facility in meeting the requirements of the judiciary.
A certain frustration with the County regarding the pace of projects and changing priorities has
illuminated certain project issues. Case-in-point is the Freeman Justice Center project timeline.
Delays in implementing this project is causing undue hardship on the operations ofthe judiciary.
Possible project delays and even the possibility of abandoning the facility were discussed as possible
options. The Chief Judge voiced considerable concerns over this option including but not limited to
jury pool travel concerns, Circuit Court location issues, and the seating of a judge specifically for that
location. In addition, the Chief Judge shared information concerning changes that were implemented
in an effort to reduce workload at this location and other changes concerning juror selection that were
previously unsuccessful.
Staff analysis of the existing facility has raised a number of concerns as to the feasibility and
effectiveness of remodeling this facility. The 2008 proposed budget includes $1.134 million for
renovations. This amount falls woefully short of the needed funds to bring this facility up to an
acceptable standard.
Alternatives:
1) Budget $1,134,664 for remodeling offacility during FY 2008 and proceed with project.
2) Direct staff to perform or have performed an evaluation of the facility, including input from the
judiciary, to determine the feasibility and cost-effectiveness of remodeling the facility, moving
funds from FY2008 to FY2009 to allow for study, planning, and eventual recommendation to
the BOCC.
3) Move forward with the planning of a new court facility, planning in FY2009 and actual
constnlction in 2010.
4) Complete a study to decommission the facility upon the construction of a new Plantation Key
Courthouse, consolidating court activities in Key West and Plantation Key.
Funding recommendation for alternative #3 - General Obligation Bond with voter approval for the
improvement of court facilities countywide.
Staff Recommendation - Alternative #2 Direct staff to perform or have performed an evaluation
of the facility, including input from the judiciary, to determine the feasibility and cost-effectiveness
ofremodel.ing the facility, moving funds from FY2008 to FY2009 to allow for study, planning, and

Plantation KE'Y Courthouse (CGOS02)
Present Funding FY2007 - $100,000 ( Recommended to $0 in June 2007)
Present StatUiI - On-hold pending master plan completion
Development of the Plantation Key location into a new courthouse facility would be staff
recommendation ifthe BOCC should choose alternative #4 from the above discussion on the Marathon
facility.
Staff also recommends inclusion of this project into any General Obligation bond should it be put to
referendum in the future.
Alternatives:
1) Budget $1,489,698 for remodeling offacility during FY 2008 and proceed with project.
2) Direct staff to perform or have performed an evaluation of the facility, including input from the
judiciary, to determine the feasibility and cost-effectiveness of remodeling the facility, moving
funds fi-om FY2008 to FY2009 to allow for study, completion of master plan, and eventual
recommendation to the BOCC.
3) Move fi)rward with the planning of a new court facility, planning in FY2009 and actual
construction in 2010.
4) Move fimding to 2009 to allow completion of master plan, determination of remodeling job
scope and eventual recommendation to BOCC.
5) Complete a study to decommission the facility upon the construction of a new/remodeled
Marathon Courthouse, consolidating court activities in Key West and Marathon.
Funding recommendation for alternative #3 and 4 - General Obligation Bond with voter approval for
the improvement of court facilities countywide.
Staff Recommendation - Alternative #2 Direct staff to perform or have performed an evaluation
of the facility, including input from the judiciary, to determine the feasibility and cost-effectiveness
of remodeling the facility, moving funds from FY2008 to FY2009 to allow for study, planning, and

Emergency Operations Center - Marathon (CP9902)
Present Funding FY2007 - $50,000
Grant Awarded for EOC Facility - DCA - (exact amount being verified)
The County was awarded a grant to construct a new EOC facility. Staff has discussed and recommends
construction of the facility at the Marathon Airport due to the logistical advantage ofthe location and
that the County already owns the parcel.
Staff has partidpated in visioning sessions with a consultant in anticipation of the planning and
construction ofthis facility. Facility and overall space requirements have been outlined/determined.
The grant award is far less than the expected total cost to construct a new EOC.
A hotel developer who would like to construct a hotel on airport grounds recently approached the
county. Any such construction must be competitively awarded and any structures built would be the
property of Monroe County. The interest in constructing a hotel at the airport in conjunction with our
EOC needs is 1m opportunity that the county should explore.
The original concept for the EOC included sleeping and cooking facilities to support EOC operations.
These amenitks add greatly to the construction cost of the EOC and could be located as part of the
hotel as a way to reduce direct costs to the County and provide amenities beyond what were planned
for the EOC facility.
As you know, the hotels are the first to evict tourists when an evacuation order is given. The rooms at
the hotel could be utilized by EOC staff between shifts. In addition, the EOC and hotel would share
common parking as a way to preserve green space, reduce drainage requirements and reduce
construction and maintenance costs.
County staff is prepared to issue a RFQ to seek a firm to construct and flag a hotel for Marathon
airport.
Staff Recommendation - Direct staff to issue two separate Requests For
Qualifi(:ations/Request for Proposals in order to contract the construction of a joint hotellEOC
facility. Hotel to be constructed under a lease arrangement yet to be negotiated. Staff to move
forward with the EOC design and cost analysis for future consideration by BOCC along with
proposed hotelier.

Docket is the bi-weekly calender call for all active criminal cases. Each defendant
must appear with his attorney. Generally one or more family members of each
defendant also appear either in support or to see and briefly visit with the defendant.
Ifa negotiated plea is heard, most pleas are heard at docket, the victim(s) or arresting
officer may also be present. In summary, for each defendant at docket sounding,
there may be as many as five people at the court at that time, along with the Judge,
two bailiffs, two clerks and a court reporter.
County Wide Traffic Citations (infractions and criminal) are 40,000 per year.
Therefore, with 12.8% of the county population, the Marathon Courthouse handles
25% of all traffic infractions. Traffic Citations (infractions and criminal) are the
greatest revenue generator for the court system.
Each prisoner is transported from jail with a driver and met by the two court bailiffs
for security. More deputies are used if there is an unusually large number of prisoners
or a 'high profile' of violent prisoner.

THE COMMISSIONERS OF MONROE COUNTY SHOULD CONSIDER
THE FOLLOWING FACTORS BEFORE VOTING ON THE FATE OF
THE MARATHON COURTHOUSE:
. The Sixteenth Judicial Circuit is NOT merely another agency of Monroe County.
Courts playa vital role in civilized societies, and the Florida Constitution protects individuals'
access to them.] In addition, the Constitution protects courts' structural integrity, in part by
establishing the judiciary as a sovereign, coequal branch of state govemment.2
· The Chief Judge of the Sixteenth Judicial Circuit created the Marathon Courthouse
in the exercise of constitutionally delegated authority.
The Florida Constitution provides that "a circuit or county court may hold civil and criminal
trials and hearings in any place within the territorial jurisdiction of the court as designated by the
chief judge of the circuit."} Chief Judge Overby duly exercised the constitutional authority of his
office in 1994 and created the Marathon Branch Courthouse.4
· Monroe County must as a matter of constitutional and statutory law continue to
fund the Marathon Courthouse.
Both Florida constitutional and statutory law require Monroe County to "fund. . . the cost of
construction or lease, maintenance, utilities, and security of facilities for the trial courts. . . .,,5
Monroe COlmty's financial obligation is a continuing one.6

· Th~, Sixteenth Judicial Circuit has the power to protect itself from any intrusions on
its sovereignty by Monroe County.
As part of a coequal branch of government, the Sixteenth Judicial Circuit Court has "the inherent
power to protect [itself] in the performance of assigned duties and functions.,,7 The Circuit's
"claims to courthouse space necessary to the performance of official court functions are
paramount.,,8 In Chief Judge of the Eighth Judicial Circuit v. Board of County Commissioners,9
for exampk, a county commission adopted a resolution that reassigned circuit and county court
space without the courts' approval. The Florida Supreme Court held that absent approval of the
affected courts, the county resolution could stand only if the county met its strong burden of
proving before a judicial officer "a lack of any reasonable necessity for continued court use of
t ,,10
presen space.
· The interests of Monroe County, the Sixteenth Judicial Circuit, and the public in
genl~ral will best be served if County officials deliberate with Circuit officials, in the
spirit of cooperation, regarding the best methods of resolving the County's issues.
The commission in Board of County Commissioners unilaterally attempted to relocate court
space. The courts in that case responded to the county's actions by unilaterally attempting to
protect their sovereign interests. As the Florida Supreme Court very accurately recognized, with
cooperation the dispute between the two bodies might not have become as heated and drawn out
as it did:
When administrative views between two governmental branches conflict. . . the public
interest will best be served by the public officials of each branch resolving differences in
the spirit of cooperation, recognizing the duties, obligations, and responsibilities ofthe
other. Only when that is not possible should a court proceeding commence which affords
an opportunity for all interest parties to be heard. II
