'-. . l._ -l u- ~ WHEREAS, on August 18, 1987, the Board of County Commis- sioners created, by Ordinance No. 031-1987, a municipal service taxing unit known as the Cross Key Waterway Special Lighting District, and WHEREAS, Section 165.051, F.S. provides certain procedures to be followed when it is desired to dissolve a special district, and WHEREAS, it is desired to hold a referendum on whether to dissolve the special district, and WHEREAS, it is desired to bring the question of dissolution to a vote of the electors on August 8, 1989, and WHEREAS, time is of the essence because the Supervisor of Elections needs time to prepare the ballots, now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: Section 1. An emergency ordinance is declared, and notice of intent to consider such ordinance is waived by a four-fifths vote. Section 2. The Supervisor of Elections is directed to publish notice of the special election once a week for four successive weeks immediately preceding the election in a newspaper of general circulation in the district. Section 3. The district shall be considered dissolved if a simple majority of the qualified voters approve. Section 4. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder shall not be affected by such invalidity. Section 5. All ordinances or parts thereof in conflict with this ordinance are repealed to the extent of the conflict. Section 6. This ordinance shall take effect on August 8. 1989, contingent upon the approval of a majority of the electors voting in the referendum. The referendum shall be held on August 8, 1989, and the question posed on the ballot shall be in substantially the following form: DISSOLUTION OF SPECIAL DISTRICT Shall the Cross Key Waterway Special Lighting District, created by Ordinance No. 031-1987, be dissolved? Yes No If this ordinance is approved by the voters in the referen- dum required by this section, the Florida Department of Revenue shall be notified within ten days of August 8, 1989. Section 7. A copy of this ordinance shall be sent by special delivery registered mail to the office of the Secretary of State, State of Florida, but such posting shall not alter the referendum requirement of Section 6.
