ORDINANCE NO. 035-1989 r-w; AN ORDINANCE ESTABLISHING SPECIAL ASSESSMENTS AND SERVICE CHARGES FOR GARBAGE COLLECTION RATES FOR RESIDENTIAL AND COMMERCIAL COL- LECTION SERVICE FROM JANUARY 1, 1990 THROUGH DECEMBER 31, 1990; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in accordance with the Monroe County Code of Ordinances, Chapter 8, the Board of County Commissioners of Monroe County, Florida, is to annually determine, fix and levy a special assessments and service charges for garbage collection for residential and commercial service; and WHEREAS, upon recommendation of the Manager of the Municipal Service District the rates to be charged for said service for the Fiscal Year 1989-1990, should now be determined; and WHEREAS, it is necessary for the public health, safety and general welfare of Monroe County, Florida, and its citizens that provision be made for garbage collection and disposal; now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. The service charges set forth below are hereby established and shall prevail for the Fiscal Year 1989-1990, for residential and commercial garbage collection, to-wit: 1. Service Charge for Residential Collection. In the event certain amendments to Chapter 8, Monroe County Code, are approved authorizing the levying of different rates for single family homes, mobile homes and multifamily units, then the following charges shall be in effect: 1) For each single family home - $290.00 per annum; 2) For each mobile home - $245.00 per annum; 3) For each multifamily unit - $196.00. 2. Service Charge for Commercial Establishments. For each commercial establishment as defined by the Monroe County Code of Ordinances, Chapter 8, Art. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this Ordinance shall not be included in the Code of Ordinances of the County of Monroe, Florida. Section 5. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
