ORDINANCE NO. 036 -1989 AN ORDINANCE DECLARING THAT AN EMERGENCY EXISTS AND- WAIVING NOTICE BY A FOUR-FIFTH'S VOTE; AMEND- IN~ SECTION 3 OF ORDINANCE NO. 028-1988 IN ORDER TO'" PROVIDE FOR PAYMENT OF SUNCOM TELEPHONE BILL FOR MONROE COUNTY, FLORIDA, TO THE STATE OF FLORI- :~~ GENERAL SERVICES ADMINISTRATION FOR SUNCOM 6T@.EPHONE SERVICES RENDERED; PROVIDING FOR SEVER- ABcrLITY; PROVIDING FOR THE REPEAL OF ALL ORDINANC- ES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS the Board of County Commissioners of Monroe County, Florida, has determined that Ordinance No. 028-1988 pertaining to the Call Accounting System should be amended, and WHEREAS an emergency is hereby declared and notice waived by a four-fifth's vote, now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: Section 1. An emergency is hereby declared and notice waived by a four-fifth's vote. Section 2. Section 3 of Ordinance No. 028-1988 is hereby amended to read as follows: "Section 3. The Clerk of the Court for Monroe County, Florida, is hereby authorized to pay all SUNCOM telephone bills now unsupported by call accounting system documentation, provid- ing such payments are charged to Departments, Divisions and/or Agencies based on historical percentages from October 1988 through July 1989, until such time as an effective call account- ing system can be reestablished, or February 1, 1990." Section 3. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall be affected by such invalidity. Section 4. All ordinances or parts of ordinances in con- flict with this ordinance are hereby repealed to the extent of any such conflict. Section 5. This ordinance shall take effect when a certi- fied copy has been accepted by the postal authorities of the Government of the United States for special delivery by regis- tered mail to the Department of State, State of Florida.
