ORDINANCE NO. 026 -1988
AN ORDINANCE AMENDING MONROE COUNTY CODE
SECTION 13.5-1 CONCERNING HARRY HARRIS PARK
BY AMENDING SUBSECTION (C)(2) CONCERNING
"HOURS" AND SUBSECTION (F)(2) CONCERNING
"SCHEDULING OF ACTIVITIES"; PROVIDING FOR
SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
WITH THIS ORDINANCE; PROVIDING FOR INCLUSION
IN THE MONROE COUNTY CODE; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, it is fiscally desirable to increase fees at Harry
Harris Park to reduce operating and maintenance costs and to
provide for capital improvements, and
WHEREAS, expanded utilization of the park requires closer
control over access and use of facilities, now, therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
Section 1.
Section 13.5-1 of the Monroe County Code is
hereby amended by amending subsection (c)(2) to read as follows:
"(2) The recreation area beyond the boat ramp may be
utilized after sunset but no later than 10:30 p.m. for
organized recreational purposes on Monday through
Saturday, or special activity purposes only on holidays
or Sundays. All parking for events and activities in
the recreational area beyond the boat ramp shall be in
that area only and shall exit at the conclusion of the
event, if after sunset, through the secondary exit so
provided, but shall remain no later than 10:30 p.m."
Section 2.
Section 13.5-1 of the Monroe County Code is
hereby amended by amending subsection (f)(2) to read as follows:
"(2) Any regular softball or baseball activities
utilizing the recreation area shall schedule their
activities with the Public Works Department and/or
Parks and Recreation Director prior to the commencement
of any season."
Section 3. If any section, subsection, sentence, clause or
provision of this ordinance is held invalid, the remainder of
this ordinance shall not be affected by such invalidity.
Section 4.
All ordinances or parts of ordinances in
conflict with this ordinance are hereby repealed to the extent of
any such conflict.
Section 5.
The provisions of this ordinance shall be
included and incorporated in the Monroe County Code as an
addition or amendment thereto and shall be appropriately
renumbered to conform to the uniform numbering system of the
Code.
Section 6.
This ordinance shall take effect immediately
upon receipt of official notice from the office of the Secretary
of State of the State of Florida that this ordinance has been
filed by said Office.

Tuesday, April 19, 1988 at 3:00 P.M. at the Elks Club, Tave~nier,
Monroe County, Florida, the Board of County Commissioners of
Monroe County, Florida, intends to consider the adoption of the

Pursuant to Section 286.0105, Florida Statutes, notice is
given that if a person decided to appeal any decision made by the
Board with respect to any matter considered at such hearings or
meetings, he will need a record of the proceedings, and that, for
such purpose, he may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based.
Copies of the above-referenced ordinance are available for
review at the various public libraries in Monroe County, Florida.
