("') r :J: ::l<:.:c co ~ ~.' ?-' .. 0 The Monroe County Board of County Commissioners, acting through M.Onr~ C~tyeg Emergency Medical Services, hereinafter referred to as MCEMS, alfld Tavemier Volunteer Fire Department, hereinafter referred to as TVFD, has established through a grant provided by the Florida Department of Health, Bureau of Emergency Medical Services, the purchase of automatic external defibrillators for the use of TVFD members in their capacity as First Responders to cardiac emergencies. I fT1 o .." a :;:0 ;0 GENERAL 2. It is to the benefit of citizens of Monroe County that TVFD members participate in a program of providing First Responder care in the event of a cardiac emergency. This includes the use of Automatic External Defibrillators (AED) to enhance the probability of survival from cardiac arrest. 3. INSOFAR as MCEMS deems it appropriate and consonant with TVFD programs and policies, MCEMS Medical Director is responsible for reviewing and approving these TVFD members training procedures for use of the AED. The training is an add-on component with the TVFD scheduled biennial certification in Cardio Pulmonary Resuscitation (CPR) to the BLS-C or professional rescuer level under the American Heart Association (AHA) protocols. MCEMS will provide for each TVFD member who will be a participant in the AED program a training format as follows: 4. a) Provide training consistent with established BLS-C and established guidelines from the manufacturer for issued AED's. b) Coordinate with TVFD supervising staff members as determined by the TVFD Chief or his designee, to plan the assignments that may be assumed by the TVFD members during their learning experiences with MCEMS. c) Provide materials and maintain personnel records and reports necessary for the performance and documentation of TVFD members learning experience. d) Coordinate enforcement of such training requirements and performance of TVFD members with the TVFD Chief or his designee. e) Provide a methodology for data collection for Quality Assurance purposes. AUTHORITY AND CONTROL 5. It is understood by the parties to this Memorandum of Understanding (MOU) that participating TVFD members will remain under the professional and administrative controls of TVFD, and that they are, therefore, subject to the StandardS of Conduct thereof. TVFD members, while engaged in training or performing services in connection with this MOU, do so within the course and scope of a volunteer and duties as members of TVFD. 6. It is understood by the parties to this Memorandum of Understanding (MOU) that the unit(s) assigned to TVFD remain the property of Monroe County Board of County Commissioners. Any unit shall be made available for inspection as directed by the Medical Director or designee, shall not be transferred or loaned to any otHer agency or individual and notification shall be made to the Medical Director or designee if the unit(s) are taken out of service by either TVFD or MCEMS. 7. Each department member participating in the training and use of AED's in a prehospital emergency situation shall comply with the volunteer fire department Basic Life Support, Medical Director established, medical treatment protocols. MAINTENANCE 8. No additional costs are anticipated to TVFD or MCEMS. 9. Maintenance and quality assurance of the unit(s) will be the responsibility of MCEMS. Immediate notification shall be made to the Medical Director or designee, appropriate forms completed and forwarded to the Medical Director each time a unit is deemed in need of repair. LIABILITY 10. MCEMS and TVFD mutually agree to fully cooperate with the TVFD in the resolution of any claims or lawsuits involving TVFD trainees that arise out of or under the MOU. WITHDRAWAL 11. It is further understood and agreed that TVFD, upon notice from the Director of MCEMS, that further participation by a TVFD member is not desirable, TVFD will withdraw such 2 student from participation in this specific learning experience with MCEMS. Since the Tavernier Volunteer Chief or his designee retains the absolute right of control over TVFD members, may at any time, for any reason withdraw a TVFD member from participation in training pursuant to this MOU. EFFECTIVE PERIOD 12. This agreement will commence on the date of execution and will continue indefinitely or until terminated according to Paragraph twelve (12). MCEMS and the TVFD will review this agreement annually incorporating changes required by statutes, Executive Orders, or regulations. Such changes will be evidenced by a modification to this agreement or by a superseding agreement. If the parties fail to agree on any such changes, the agreement will be terminated. TERMINA TION 13. Termination may be effected by either MCEMS or TVFD, upon thirty (30) days written notice when deposited in the United States Postal Services mail, and directed to the party to whom notice is being given, at the addresses set forth below: IN WITNESS WHEREOF the parties have caused this memorandum of understanding to xecuted by their respective authorized representatives on this 26th day of 2000.
