Revised 11/06 RESOLUTION NO. A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS TO SERVE AS THE SEWER COORDINATOR FOR THE FLORIDA KEYS; PROVIDING FOR THE DEVELOPMENT OF A COMPREHENSIVE PLAN TO IMPLEMENTING ADVANCED WASTEWATER SYSTEM INSTALLATIONS; AND PROVIDING FOR AN EFFECfIVE DATE. WHEREAS, Monroe County (County) is authorized by Florida Statute Sec 125.01(1) to provide, assist in providing, and fund centralized wastewater treatment systems; and WHEREAS, State legislative authorizations of entities in the Florida Keys may be reconciled through legislation at such time as the State issues bonds or otherwise provides funding for wastewater projects; and WHEREAS, Section 6, Subsection (4), Chapter 99-395, Laws of Florida, and the County's Comprehensive Plan requires that certain wastewater treatment levels be achieved by the year 2010, which levels can best be achieved by central wastewater treatment; and WHEREAS, The Sanitary Wastewater Master Plan (the "Master Plan") for the Florida Keys was adopted by the Monroe County Board of County Commissioners on May 18, 2000; and WHEREAS, the Master Plan identified and acknowledged the benefits to Monroe County, its residents, visitors and environs from the installation of regionalized central sewer systems and identified areas and projects which should be given priority attention, referred to as "Hot Spots;" and " WHEREAS, the creation of a few regionalized central sewer systems are typically more cost effective than numerous smaller systems; and ~ WHEREAS, the creation of regionalized central wastewater treatment facilities allows for the production of economically feasible reclaimed water for reuse and wastewater recycling; and WHEREAS, it is understood that sustaining accessible and adequate water supplies are essential to the people and economies throughout the County; and WHEREAS, the governments of the United States, the State of Florida, and Monroe County have recognized the need to initiate and fund projects for the design, construction, and operation of wastewater treatment systems within Monroe County; and Wastewater Coordinator Interim Project 1 WHEREAS, Monroe County and the Florida Keys Aqueduct Authority have entered into an Inter Local Agreement and subsequent lease relationship to provide for the installation, operation and maintenance of wastewater treatment systems in unincorporated Monroe County, and WHEREAS, Monroe County and the Key Largo Wastewater Treatment District have entered into an Inter Local Agreement to provide property for a treatment plant, environmental mitigation monies, operating and construction start-up funds to complete advanced wastewater projects within the service limits of the district, and WHEREAS, grants and other funding sources from local, state and federal entities to advance the provision of wastewater treatment facilities are limited in amount and availability; and WHEREAS, recent evidence shows that the impact to Monroe County's natural reef system is far more detrimental than first speculated and the extra time necessary to complete these systems with local funding alone will cause irreparable harm to the State's environment and soon thereafter the State's economy, and WHEREAS, the State of Florida is considering bonding of at least $200 million for the construction of wastewater treatment systems within Monroe County; and WHEREAS, the State of Florida is seeking a single entity to serve as a coordinating local government entity to work with the Florida Department of Environmental Protection to develop a plan to ensure that a comprehensive cost-effective process of project implementation maximizes environmental benefits and minimizes costs, and . WHEREAS. the county has a fully functional wastewater treatment department and other staff as well as County Commissioners that have specialized skills and competencies to meet this challenge, and WHEREAS. Commissioner Charles McCoy has formal education and training in the field and local construction knowledge having designed projects throughout Monroe County and the Caribbean, and has multi-state registry, and WHEREAS, Commissioner McCoy, as Mayor of Key West enacted operation of advanced wastewater treatment systems prior to DEP and State of Florida mandates; now therefore BE IT RESOL YED by the Monroe County Board of County Commissioners that: Section 1: The County hereby expresses its support to provide wastewater treatment for the Florida Keys that is both cost effective and environmentally correct based upon current, competent engineering evaluation and recommendation. Wll8lewlller Coordinator Interim Project 2 Section 2: The County hereby commits to serve as the single government entity to coordinate and work with DEP to accomplish the Interim Project provided by the State of Florida to advance the provision of wastewater treatment facilities for the Florida Keys. Section 3: Monroe County shall function as the Florida Keys Wastewater Coordinator; and Commissioner McCoy, due to his professional background, shall chair discussions and actions of the Board of County Commissioners concerning wastewater projects and serve as the County's liaison to the Florida Department of Environmental Protection and such other governmental entities as necessary to accomplish the Interim Project. Section 4: The Board hereby commits to support in a professional manner wastewater treatment alternatives that maximize environmental benefits and minimize project and operating costs. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida at a special meeting of said Board held on the 8th day of August 2007.
