At the September 19,2007, Board of County Commissioner's meeting the Board granted
approval and authorized execution of a Public School Facilities Element County Waiver
Application Form for a waiver from the statutory requirement to adopt a Public School Facility
Element as part of the Monroe County 2010 Comprehensive Plan as per Section 163.3177,
Florida Statutes.
Enclosed is a certified copy of the above-mentioned for your handling. Should you have

Section 163.3177, Florida Statutes, requires each county and each municipality within the county to adopt a
public school facilities element, unless eligible for a waiver or exemption.
PART I
Subsection 163.3177(12), Florida Statutes, authorizes the Department of Community Affairs to provide a
waiver to a county and to the municipalities within the county if (A) the capacity rate for the all schools
within the school district is no greater than 100 percent, and (B) the projected 5-year capital outlay full-
time equivalent student growth rate is less than 10 percent.
