Thursday, May 27, 1999
Marathon, Florida
A Town Hall Meeting of the Monroe County Board of County
Commissioners convened at 7:00 p.m., on the above date, at the
Marathon Government Center. Present and answering to roll call
were commissioner Shirley Freeman, Commissioner George Neugent,
Commissioner Nora Williams and Mayor Wilhelmina Harvey.
Commissioner Mary Kay Reich was absent. Also present were Danny
L. Kolhage, Clerk; James T. Hendrick, County Attorney; James
Roberts, County Administrator; County staff, members of the press
and radio; and the general public.
All stood for the Invocation and Pledge of Allegiance.
Mayor Harvey introduced the Board of County Commissioners,
the Clerk of the Court and the County Attorney. the County
Administrator introduced staff members present.
The following individuals addressed the Board:
Ralph Tallent discussed water run-off. Don Horton, Director
of the Building Department/Building Official, addressed the Board
concerning Mr. Tallent's concerns.
Margaret pierce addressed recreation.
Fred Schmidt addressed the difficulties he is having
obtaining a permit to rebuild a mobile home destroyed by
Hurricane Georges. This matter was referred to the Building
Department.
Charles E. Kanter discussed FEMA regulations and the 18 mile
stretch.
Rich Fortmann, representing the Marathon Community Council,
discussed the Marathon community Marina and thanked the
Commission and staff for their assistance.
Jeff Laning discussed water testing and water quality
issues. George Garrett, Marine Resources Director, addressed the
Board.
Mavis Anderson discussed the Urban Greenways project, Lower

Keys Bike Trail Project, funding for scenic routes and the 18
mile stretch.
Ken Carter discussed the proposed FEMA Rule. James T.
Hendrick, County Attorney, addressed the Board concerning the
County's jurisdiction regarding FEMA regulations.
Joan Mowery, President of Gulfstream Shores Homeowners
Association, addressed the Board concerning the translator and
tourism.
Paula Morrow discussed the translator, FEMA flood
regulations and the Key Largo Library improvements.
Louis caputo, representing citizens Against Incorporation of
Key Largo, discussed the accessibility of County government to
the citizens.
Glenn Robinson discussed wastewater treatment.
Mark Andre discussed the Vacation Rental Ordinance.
Bicycle Joanie discussed FEMA, downstairs enclosures and
trailers.
Frank Greenman discussed town meetings, moderate and low
income housing and the effect of the removal of downstairs
enclosures on ROGO calculations.
Marie Shinkevich discussed the number of dwelling units on
properties zoned for single family residences and the effect of
illegal workers on the housing demand.
Eugene Shinkevich discussed water degradation, water quality
and cesspit replacements.
H.T. Pont in discussed the county's denial of his beneficial
rights, the lack of County jurisdiction beyond the high water
line, the Habitat Conservation Plan, the Tortugas "no-take" zones
and jurisdiction issues.
Barry Patterson discussed stormwater runoff, improvements to
US1 by the Florida Department of Transportation, FEMA regulations
as they apply to commercial vs. residential development, and
billboards.
The commission expressed their satisfaction with the conduct
of the Town Meeting and thanked everyone present for
participating.

County Administrator Jim Roberts discussed the membership
and responsibilities of a Blue Ribbon Committee on Affordable
Housing and recommendations the Board deems appropriate. (At the
May 12, 1999 BOCC meeting, the Board postponed this item and
requested that it be heard at this meeting.)
Mr. Roberts indicated that Commissioner Reich was nominating
Bill Lowey of Summer land Key and DeWayne Kemp of Summer land Key
as her appointments to the Committee. commissioner Freeman
indicated she was not prepared to make her appointments at this
time. commissioner Neugent appointed Bill Daniels, Jr., of
Marathon, and Mike Cinque, of Marathon. Commissioner Williams
appointed Ken Carter and Peter Rosasco, and Mayor Harvey
appointed Norma Jean Sawyer and Donald Craig.
Mr. Hendrick presented a draft letter the County
Administrator had been asked to forward to the Department of
community Affairs concerning affordable housing. It was agreed
that this matter would be reviewed by Commissioner Williams as
the Land Use liaison.
There being no further business to come before the Board,
the meeting was adjourned.
