Chairman Sonny McCoy called the meeting to order at 10:11 AM. Present and answering roll call, in addition to Chairman McCoy, were Mayor Mario Di Gennaro, Commissioner Sylvia Murphy, Commissioner George Neugent, and Commissioner Dixie Spehar. Also in attendance were Executive Director Mark Rosch, Office Manager Kimberly Nystrom, and members of the press and public. The first item on the agenda was approval of minutes for the meetings held on September 12, 2007, September 14, 2007, September 19, 2007, and September 21, 2007. A motion was made by Commissioner Spehar and seconded by Commissioner Neugent to approve the minutes as submitted. There being no objections, the motion carried (5/0). The next item was approval of a resolution authorizing the encumbrance of Bahama Conch Community Land Trust property located at 307 and 307Y2 Julia Street in Key West. A motion was made by Commissioner Murphy and seconded by Mayor Di Gennaro to approve the item. There being no objections, the motion carried (5/0). [Resolution 08-2007] The next item was approval to add Suncrest Landing Mobile Home Park on Stock Island to the Acquisition List for affordable housing in partnership with Habitat for Humanity of Key West and Lower Florida Keys. A motion was made by Commissioner Spehar and seconded by Commissioner Neugent to approve the item. There being no objections, the motion carried (5/0). The next item was approval to add 1225, 1227a, and 1227b Third Street and 2107, 2107 Rear, and 2109 Patterson Avenue to the Acquisition List for affordable housing in partnership with Key West Housing Authority. Mr. Rosch, Sloan Bashinsky, and Diane Beruldsen addressed the Board. A motion was made by Commissioner Spehar and seconded by Commissioner Murphy to approve the item. Roll call was as follows: Mayor Di Gennaro, yes; Commissioner Murphy, yes; Commissioner Neugent, yes; Commissioner Spehar, yes; and Chairman McCoy, yes. The motion carried (5/0). The next item was approval to accept the donation of Block 3, Lot 6, Silas Knowles subdivision on Big Pine Key for conservation. A motion was made by Commissioner Neugent and seconded by Mayor Di Gennaro to approve the item. There being no objections, the motion carried (5/0). Item Background: This acquisition is proposed pursuant to BOCC Resolution 39-2004 (the 2004 partnership agreement between the County and the Florida Department of Community Affairs), which calls for the Land Authority to purchase natural areas consisting of at least two acres of upland native habitat located outside the County -designated Conservation and Natural Area. The Land Authority has already purchased 2.31 acres within the subject natural area on the bayside of Key Largo at MM 98. The property proposed for purchase today will protect an additional 0.18 acre of the site. The property's zoning is Improved Subdivision (IS), the Tier designation is Tier 1, and the vegetation is tropical hardwood hammock. In 2005 the Land Authority entered into a contract to purchase the subject property for $22,500. However the transaction failed to close due to a title defect and the contract expired. The sellers have now agreed to conduct the legal work necessary to correct the title defect provided the purchase price is increased to $25,000. The $2,500 price increase is intended to cover a portion of the anticipated legal expenses the seller will incur correcting the defect. Staff is requesting Board approval of the new $25,000 purchase price. The Land Authority's standard purchase contract will be used in this transaction. The estimated closing costs are included in the agenda packet spreadsheet. Advisory Committee Action: On October 24, 2007 the Committee voted 3/0 to approve this item. Previous Governing Board Action: On September 28, 2005 the Board approved purchasing the subject property for $22,500. Contract/Agreement Changes: This will be a new contract. Compared to the prior contract, the purchase price will increase from $22,500 to $25,000. Staff Recommendation: Approval. Item Background: This acquisition is proposed to protect natural resources. The subject properties are all designated Tier 1 and located in environmentally sensitive areas. The total size of this acquisition will be approximately 4.8 acres. See the attached property list for details on each parcel. The Summerland Key parcel appears to lack a recorded right of access and this situation will be confirmed via a title search. In consideration of this apparent title defect, the sellers have agreed to sell all seven parcels for 115% of the 2007 tax assessed value. The Land Authority's standard purchase contract will be used in this transaction. The estimated closing costs are included in the agenda packet spreadsheet. Advisory Committee Action: On October 24, 2007 the Committee voted 3/0 to approve this item and to waive the requirement for a recorded right of access to the Summerland Key parcel.
