We have been in this location since 1991 and I have worked there since 1995_ While I have never measured noise specifically I can tell you from 12 years of experience there has been no significant changes. Typically there will be a group of 4 to 8 aircraft that take off over a matter of 10 minutes and then they are gone for hours and return in a group circle over my office and land. Depending on the wind some takeoff and landing approaches put them directly over my office, but again only for a few minutes. There are some days there are no aircraft at all, and others that may see three to four groups a day I am in at 6am and typically leave by 6pm. NAS Key West was e iminated as a home basing site for the aircraft, which was t~e stated purpose of the "Environmental Impact Statement (ErS) for Introduction of the F/A-1B ElF to'the East Coast of th~ United States." The ErS, however, did not address transientltraining sites for the F/A-1B ElF "Super Hornet." I " In 2003, the Navy Comp!ied with!NEPA fOr transient F/A-18 ElF operations at NAS Key West by cornp~eting an Environmental 1 Assessment (EA) for Fleet Support ~nd Infrastructure Improvements. WHEREAS, through enactment of Section 288.980, Florida Statutes. the Legislature of the State of Florida created a grant program to assist communities with military installations that might be adversely affected by federal base realignment or closure actions and to encourage such communities to initiate a coordinated program of response and plan of action in advance of future base realignments or closures (the hGrant Proln"am''); and WHEREAS. in partnership with the Office of Tourism, Trade, and Economic Development of the State of Florida ("OTrED"), EFt has agreed to administer the Grant Program; and WHEREAS. the Grant~ is an organization eligible to receive funding under the Grant Program: and WHEREAS, the parties desire to enter into this Agreement, whereby the Grantee shall be awarded grant funding under the Grant Program. as provided herein, for the purpose or project (the "Project") described in the application that the Grantee submitted to EFl for this purpose. a copy of which is attached hereto as Exhibit A (the "Grant ADDlication"): NOW, THEREFORE, in consideration of the mutual covenants contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows: 1. rnm. The term of this Agreement shall commence as of the date of this Agreement and shall continue for 12 months (with an end date of , 20_), upon which time EFl makes the final disbursement of funds under this Agreement pursuant to Paragraph 7. Any extension to the term of this Agreement is based on the availability of funds and requires the written and mutual consent of the parties. .2. Grant Funds, Pursuant to the terms of this Agreement, EFI shall pay to the Grantee from the Grant Program an amount equal to the lesser of Ninety Thousand Dollars ($90,000) or the amount actually expended by the Grantee on the Project (in total or any part thereof, the "Grant Funds"). In consideration of such grant, the Grantee agreea as follows: (a) The Grant Funds shall be expended solely for the purpose of the Project and the accomplishment of the Activities, as provided by Paragraph 4, or for the reimbursement or the Grantee's own fundll theretofore expended for the same purpose. The Grant Funds shall be used for the ~pecjfjc expenditures indicated on the Project Budget, aD approved copy of which shall be attached hereto as Exhibit B (the "Proiect Budllet") per paragraph 3 below. Unless specifically authorized in the Project Budget, the Grantee shall not use the Grant Funds for any of the following expenses: (1) Salaries of the Grantee's employees; (2) Purchase of alcohol, equipment, furniture, or fixtures; (3) Receptions, gifts, and membership dues; (4) Lobbying the Legislature, the Courts, or any state agency of the State of Florida; or (5) Administration of the Project. in excess of 10% of the Grant F\ands. (b) Any expenditure in connection with the Project that exceeds the total amount of the Grant Funds shall be the sole responllibility of the Grantee. Unless EFI otherwise agrees in its discretion, the Grantee shall be required to complete the Project even if it must expend its own funds to do so. 3. Initial Payment. Upon EFl's receipt and approval of the Budget, pursuant to Paragraph 2, EFI shall pay to the Grantee as an initial disbursement in respect of the Funds an amount equal to 20% of the grant amount. Because the initial budpt may have been revised before the contract was awarded, Contractor must provide a revised Budget to EFI for approval. 4. lIlat.:hinlF Funds. The Grantee shall secure matching funds in the minimum amount equal to $29,700 (33% of the Grant Funds'> The Matching Funds shall be received from the ~ources and shall be of the types indicated in the Project Budget. To encourage community ~upport, the term for matching funds ~hall commence on September 1. 2004, the date upon which the contract award was announced by the Executive Office of the Governor and OTTED. The Grantee shall perform and accomplish each of the activities (individually, an "Activitv" and collectively, the "Activitieg") described in the Schedule oC Activities attached hereto as Exhibit C (the "Schedule of Activities"), on or beCore the respective due date of such Activity indicated in the Schedule oC Activities. The Schedule of Activities may incorporate by reCerence the Activities indicated in a work plan, schedule, or other document prepared by the Grantee or any other person or entity, provided that it contains the information required by this Paragraph 4. 6. Statu. R..00Pt. The Grantee shall deliver to EFI quarterly project status reports that outline the Grantee's progress in completion oC the Project (each. a "Status Renort") as Collows: (a) The Grantee shall deliver a Status Report to EFI on or beCore the tenth (10"') day following the last day oC each Reporting Quarter during the term oC this Agreement. As used in this Agreement, a -ReDortiDll Quarter" shall mean a quarter of a reporting year ending on August 31, with the Reporting Quarters to end on November 30, on the last day oC February, on May 31, and on .June 30. (b) Each Status Report shall consist of no more than five (5) pages. (c) Each Status Report shall outline the Grantee's progress in completion of the Project during the Reporting Qual.ter for which the Status Report is delivered, And it shall specifically include the following information: :j (b) EFI approves of the Status Report and Invoice, which approval cannot reasonably be withheld: (c) The Grantee produces sufficient documentation, as EFI may request from time to time in its discretion, of its receipt and use of Matching Funds in accordance with the Project Budget. EFI shall provide to the Grantee a statement that includes the reasons for which the Grant Funds are not disbursed as requested in the Status Report. Such statement shall also include the additional action the Grantee must accomplish before the Grant Funds will be disbursed, which actions may include providing or agreeing to a revised Schedule of Activities or Project Budget. Upon the Grantee's completion of such additional actions, and EFl's reasonable approval of the same, EFI shall disburse to the Grantee an amount equal to the amount requested for disbursement in the Status Report or such other amount as EFI deems to be consistent with the Project Budget, whether or not revised, wholly within EFl's discretion. The acceptance of final payment under this Agreement, or the acceptance of final payment upon early termination hereof, shall constitute full and complete release of EFI by the Grantee from any and all claims, demands, and courses of action whatsoever. 9. FinD. I'rm_ Renol't. The Grantee shall submit a final project report within fortyfive (45) days following the Grantee's completion of the Activities (the "Final Proiect Rsoort"). The Final Project Report shall include the follOwing information: (a) Certification that the Project, including all of the Activities, has been completed in compliance with the terms and conditions of this Agreement: (b) Total amount of Grant Funds received from EFI pursuant to this Agreement; (d Total amount of Matching Funds received: (d) Total amount of Project expenditures paid Or reimbursed from the Grant Funds: (e) Total amount of Project expenditures: and (f') Explanation of any material changes in circumstllnces that may affect the outcome or commercial potential of the Project. 10. Final Audit ReDOrt. Within fortrfive (45) days following the ,:ompletion of all of the Activities, the Grantee "hall cause to be prepared at the 5 Grantee's expense and delivered to EFJ a final audit report of an independent certified public accountant (or a firm thereof') licensed to practice in the State of Flol'ida, stating the professional opinion that the Grantee has complied with this Agreement (the "Final Audit ReDort"l. Advertisements, signs, and other promotional materials funded by this Agreement shall include reference and credit to EFI and OTTED. The Grantee shall not use the State Seal of the State of Florida. The Grantee shall not use the logos or service marks of EFJ without the prior written approval of EFl. 19. IndeDendent Contractor. The Grantee is acting as an independent contractor and not as EFl's employee in the performance of this Agreement. EXECUTIVE SUMMARY To: Julio Avael, City Manager From: David Paul Horan, Florida Keys Defense Alliance Date: Florida Defense Reinvestment Grant to the Florida Keys Defense Alliance Proiect Issue: The Florida Legislature created the Defense Reinvestment Grant Program within the Executive Office of the Governor, Office of Tourism, Trade and Economic Development to assist defense-dependent communities. These grants are designed to help communities develop economic diversification strategies, improve base efficiencies, and implement base reuse programs. The State awards grants from funds available to these efforts and authorized Enterprise Florida, Inc., to administer the Defense Reinvestment Grants Program for the State. In J.uly 20M, the Florida Keys Defense Alliance (FKDA) (a local organization working with the Florida Defense Alliance) submitted two (2) grant applications to Enterprise Florida, Inc. In October, the City of Key West received a $600,000 Grant for the planning/development of access (ingress and egress) to the Truman Waterfront, Ft. Taylor State Park and the Outer Mole Pier. The FKDA received a $90,000 grant to support military/defense advocacy efforts and appropriate military facility analyses. This FKDA grant is to maximize the military need for and value of Monroe County military facilities in order to minimize potential for base closure and/or realignment. The military is the second largest economic sector of the Florida Keys economy. TIle economic impact of Monroe County defense spending reaches almost One-Half Billion Dollars annually ($463.7 Million). This does not include Coast Guard activities. Exnenditure of Funds: The FKDA is engaging RJ. Natter & Associates, LLC as an advocate and consultant to assist the City of Key West and Florida Keys with Congressional and government relations efforts. Attached is a short resume on the consultant retained by the FKDA. Approximately $78,000 of the funds will be used to compensate the consultant and the remaining funds will be used to pay expenses of the FKDA members and community leaders in attending Florida Defense Alliance meetings around the state and a meeting in early 2005 in Washington, D.C. One specific task of the consultant is to advocate the conveyance of naval properties to the City of Key West and/or Monroe County for the construction of affordable housing. Financial Issues: Invoices will be prepared by FKDA and submitted to Doug Bradshaw who will document the "local match" and then submit the invoices/documentation to Enterprise Florida, Inc. Enterprise Florida, Inc., will make direct payments to FKDA from the Grant program, equal to the lesser of $90,000 or the amount actually expended by FKDA. The FKDA is securing matching funds in the minimum amount equal to $29,700 (33% of the Grant funds). The "local match" will primarily be in-kind contributions in the fonn of dedicated volunteer time, use of equipment, software and time devoted by City staff. The Florida Keys Defense Alliance submitted their grant application for state funds on July 23. 2004. According to the Florida Division of Corporations, they only filed their corporate registration on September 17, 2004. According to page 5 of the July 23 application, the City of Key West had already committed the matching funds that you are being asked 10 approve over three months later. The application form states, "The grant funds shall be used for the specific expenditures Indicated on the Project Budget, an approved copy of which shall be attached hereto as Exhibit B: FKDA states, counter to the requirement, that the budget will be submitted with their first progress report. Paragraph 5, titled Scope of Work requires the grantee to submk a detailed Schedule of Activities, which are to be performed under the agreement. The form is to be attached to the application and labeled "Exhibit C.' As you can see, we are making little progress on spending the money (only $28,745) because of lack of in-kind services. December the grant expires and I doubt we will even have spent half the grant by that time. Enterprise FL folks are extremely concemed with this since that money could have gone to another community. If we do not spend ~, the money is lost. Add~ionally, I am not sure if you are aware, but the FKDA applied for and was awarded another $90,000 for 2006 for the same thing as the current grant. Enterprise FL called me and they are holding the grant contract from FKDA pending the City's agreement and approval on the required match. See the attached for what is required out of the City (last page of application). To my knowledge the City did not approve the funds for this project especially the $25,000 cash. Also, they are not happy that we cannot spend the original $90,000 and now we have gotten another $90,000. My question is does it make sense for the City to agree to provide in-kind services for a second grant when there is going to be a significant short fall of in-kind for the first grant? Enterprise FL has indicated that the City has the option of not executin\l the grant and allowing the grant money to be redistributed to another community that may have a greater need. ,Once the grant agreement is executed, any unspent grant money at the end of the grant term is lost and cannft be redistributed. Julio explained that Paul Clayton was attending the tirst meeting so that he could create a Mission and Goals statement for the committee. Julio mentioned to everyone that Elliot Baron and Commissioner Turner were against this but Commissioner Carmen Turner was fine with grant since the city is cooperating with the grant in a correct way. Raymond Archer passes out two handouts which one was the time sheets for time recording that Dennis Grote and Doug Bradshaw wiII review. Jay Gewin stated that the match is 29% of the expenditure which equals $29,700. David Horan stated that it could not excet.'<! $40.00 an hour and aII hours are to be recorded and show specifics for all hours. ' Raymond stated that aII correspondence should go through the Port Otlice for audit purpose. David Horan stated that aII past meeting can be accounted for reimbursement and his charges for when they travel to Orlando, Pensacola and Washington. The grant, $90,000 (total project is $119,700) is being used to pay Adm. Natter for advocacy concerning Florida Keys military facilities. As we prepare the third quarterly report, it is becoming apparent that there is not enough Florida Keys Defense .Alliance and/or staff time to provide the required rnateh. As it stands now, $39,000 has been billed toward the grant with $7,835 of in-kind services for a total project to date of $46,835. This leaves $7,620 short (33% of total project is $15,455) of the match portion. The $7,620 is what is needed to make up the difference from what has been billed and what the grant is reimbursing the Florida Keys Defense Alliance. Pending a drastic increase in staff and/or Florida Keys Defense Alliance time, the City will be required to make up the match with cash. Horan: This letter is provided as a report of progress in support of our Letter of Agreement between R. J. Natter & Associates, LLC and the Florida Keys Defense Alliance (FKDA) dated 11 December 2004. For the quarter September 1 to December 2, 2005, our initiatives included the continuing combined efforts to establish a close and cooperative working relationship between the Key West community and the military neighbors within the community. Our focus has been on increasing the availability of affordable housing for government service civilians assigned to the Florida Keys military bases and adequate housing for the many people and their families who support the bases and the local economy. We also addressed the jet noise contours (AICUZ) surrounding NAS Key West and the appropriate use of State Grant money for State Infrastructure Grants. Additionally, I worked to establish a good understanding of the special challenges and opportunities associated with the military's presence in the Keys among senior Navy, DaD and State officials. The DaD and federal government decisions regarding he Base Realignment and Closure (BRAC) process is of special interest in this report in that it culminates two years of effort at the State and Community level to protect these important economic engines. The BRAC process ended during this reporting period. The decisions in BRAC, which are now law, reinforced the importance and value of the military missions and facilities located in the Florida Keys. In spite of the 180 decisions on closure and realignment across the nation, the Florida Keys were fully recognized for their importance to the nation and DOD and, as a result, were not affected. Our efforts in support of the Florida Keys Defense Alliance and the City of Key West during this quarter included two trips and a series of meetings in Key West with the FKDA Chairman and members, the Commanding Officer of NAS Key West and his staff, and a City Council official. These visits and meetings were September 11 and November 11-12. In addition, I participated in many phone discussions with these same leaders on a regular basis, addressing each of the issues of importance to the Keys and the military community. I traveled to Tallahassee at least once each month to ensure the priorities and concerns of Key West were well represented. My meetings there included the Governor and members of his staff, from the Chief of Staff to his General Counsel and members of various directorates. Meetings and calls included such issues as hurricane relief, State Grant awards, and a one-week City election postponement request due to hurricane evacuation and damage. I visited the home office of a Public-private housing Company in Philadelphia and visited with the Navy Southeast Region Commander in Jacksonville concerning Navy housing in Key West. Both visits were to ensure that the Navy Region's transition into the public private housing business will happen with the special circumstances of Key West well understood and protected by industry and the Navy, and with the intent that the ultimate contract responds to those special needs and concerns. I had meetings on two occasions with the new Chief of Naval Operations in Washington, DC, to discuss issues of importance to Key West. I also discussed by phone the housing challenges at Key West with the Senior Military Advisor to the Secretary of Defense. These meetings and calls were accompanied by a meeting in Washington, DC, with the Navy's Commander of all Navy Installations. Again, these discussions were for the purpose of ensuring that the Navy's leadership was aware of Key West's special situation.
