Thank you for accepting this letter regarding Naval Air Station Key West My office is
located on Rockland Key North of the Air Station by less than 3/4ths of a mile. We have
been in this location since 1991 and I have worked there since 1995_ While I have never
measured noise specifically I can tell you from 12 years of experience there has been no
significant changes. Typically there will be a group of 4 to 8 aircraft that take off over a
matter of 10 minutes and then they are gone for hours and return in a group circle over
my office and land. Depending on the wind some takeoff and landing approaches put
them directly over my office, but again only for a few minutes. There are some days there
are no aircraft at all, and others that may see three to four groups a day I am in at 6am and
typically leave by 6pm.
I must say that for the freedoms and privileges we take for granted every day I have no
issues being a neighbor of Naval Air station Key West Thank you.

Records of important discussions, negotiations, testimony, etc., with and before local officials,
boards, etc., must be maintained by the local command. Such records shall be available for inclu-

Installation Compatible Use Zone (fICUZ) are two separate
programs that help achieve health, ',sat"ety, welfare, and

with the NEPA. NAS Key West was e iminated as a home basing

however, did not address transientltraining sites for the F/A-1B

operational tempo of NAS Key West, ~he Navy was able to predict
the number and type of air operatio~s needed to support future

forecasted in the 2003 EA with actu~l numbers, the estimate is
very accurate. You also refer to ~-22 "Raptor~ training; those
operations are consistent with typ~, intensity, and setting of
other aircraft presently operating ~t NAS Key West, and are

12, 2005. This update was discuss~d publicly during Monroe
County Commission meetings as part bf the County's growth
development proce~ses on February ~3 and April 20, 2005. NAS
Key West hOsted several AICUZ work~ng meetings with local
governments and the State of Flori1a where further
recommendations were made to updat, the 2004 AICUZ study.
The 2004 AICOZ Update representJd the optimal, mOdeled,
current and future operations at K~y West. The 2007 AICUZ
Update represents revisions reques~ed through continued dialogue
with local governments and the community. The Navy was able to
aCcommodate the revisions with man~geable risk to current flight
operations. Thus, the recommendedjchanges by local government
and the community were adopted by tthe Navy on April 3, 2007.
Furthermore, since the 2007 AICUZ ~as not a significant
functional change to actual NAS Ke~ West flight operations, it
was not a major federal action sig~ifiCantly affecting the
quality of the human environment. iTMe Navy continues to strive
to be a good neighbor and has cons~stently Worked with Monroe
County and its citizens to find ways to promote compatihle land

Your con~tituent also qUestions!the noise modeling techniques
used in the 2003 EA and the 2007 A~CU2. In preparing AICUZ and
NEPA studies, the Navy uses the mo~t current models to provide

exposure contours. Navy is cogniz~nt of the fact that as new

DEFENSE REINVESTMENT GRANT AGREEMENT
THIS DEFENSE REINVESTMENT GRANT AGREEMENT (together with
any written amendment hereto that hereafter may be executed and delivered by the
parties, this "Allreement") is made and entered into as of this day of
, 20_. by and between ENTERPRISE FLORIDA, INC., a not-for-
profit Florida corporation (hW"), and FLORIDA KEYS DEFENSE ALLIANCE.
(the hGrantee").
WHEREAS, through enactment of Section 288.980, Florida Statutes. the
Legislature of the State of Florida created a grant program to assist communities
with military installations that might be adversely affected by federal base
realignment or closure actions and to encourage such communities to initiate a
coordinated program of response and plan of action in advance of future base
realignments or closures (the hGrant Proln"am''); and
WHEREAS. in partnership with the Office of Tourism, Trade, and Economic
Development of the State of Florida ("OTrED"), EFt has agreed to administer the
Grant Program; and
WHEREAS. the Grant~ is an organization eligible to receive funding under
the Grant Program: and
WHEREAS, the parties desire to enter into this Agreement, whereby the
Grantee shall be awarded grant funding under the Grant Program. as provided
herein, for the purpose or project (the "Project") described in the application that the
Grantee submitted to EFl for this purpose. a copy of which is attached hereto as
Exhibit A (the "Grant ADDlication"):
NOW, THEREFORE, in consideration of the mutual covenants contained
herein and other good and valuable consideration, the receipt and sufficiency of
which are hereby acknowledged, the parties agree as follows:
1. rnm. The term of this Agreement shall commence as of the date of
this Agreement and shall continue for 12 months (with an end date of
, 20_), upon which time EFl makes the final disbursement of funds
under this Agreement pursuant to Paragraph 7. Any extension to the term of this
Agreement is based on the availability of funds and requires the written and
mutual consent of the parties.
.2. Grant Funds, Pursuant to the terms of this Agreement, EFI shall pay
to the Grantee from the Grant Program an amount equal to the lesser of Ninety
Thousand Dollars ($90,000) or the amount actually expended by the Grantee on the
Project (in total or any part thereof, the "Grant Funds"). In consideration of such
grant, the Grantee agreea as follows:
(a) The Grant Funds shall be expended solely for the purpose of the
Project and the accomplishment of the Activities, as provided by Paragraph 4, or for
the reimbursement or the Grantee's own fundll theretofore expended for the same
purpose. The Grant Funds shall be used for the ~pecjfjc expenditures indicated on
the Project Budget, aD approved copy of which shall be attached hereto as Exhibit B
(the "Proiect Budllet") per paragraph 3 below. Unless specifically authorized in the
Project Budget, the Grantee shall not use the Grant Funds for any of the following
expenses:
(1) Salaries of the Grantee's employees;
(2) Purchase of alcohol, equipment, furniture, or fixtures;
(3) Receptions, gifts, and membership dues;
(4) Lobbying the Legislature, the Courts, or any state agency
of the State of Florida; or
(5) Administration of the Project. in excess of 10% of the
Grant F\ands.
(b) Any expenditure in connection with the Project that exceeds the
total amount of the Grant Funds shall be the sole responllibility of the Grantee.
Unless EFI otherwise agrees in its discretion, the Grantee shall be required to
complete the Project even if it must expend its own funds to do so.
3. Initial Payment. Upon EFl's receipt and approval of the Budget,
pursuant to Paragraph 2, EFI shall pay to the Grantee as an initial disbursement in
respect of the Funds an amount equal to 20% of the grant amount. Because the
initial budpt may have been revised before the contract was awarded, Contractor
must provide a revised Budget to EFI for approval.
4. lIlat.:hinlF Funds. The Grantee shall secure matching funds in the
minimum amount equal to $29,700 (33% of the Grant Funds'> The Matching Funds
shall be received from the ~ources and shall be of the types indicated in the Project
Budget. To encourage community ~upport, the term for matching funds ~hall
commence on September 1. 2004, the date upon which the contract award was
announced by the Executive Office of the Governor and OTTED. For this purpose.
the Matching Funds may consist of the following type~:

(a) -Cash Contrihutions," which may include cash contributions
from the Grantee, cash contributions from outside sourcea that are directly applied
to the Project; in"kind contribution~ from part-time or full' time personnel from
other organizations that dedicate a certain percentage of their time to the Project,
the value of which is calculated based on their regular hourly rate: or cash outlays
to directl)' support the Project through acquiring materials and supplies, buying
equipment, paying Cor staff time used to work on the Project, and paying expenses
such as travel. telephone, postage, or printing: and
(b) "In' Kind Contrihutions," which may include the reasonable
value of the partial use oC equipment, software, or staff from other divisions of the
Grantee or from participating partners: the reasonable rental value oC office space;
or the reasonable value of volunteer time and expenses, calculated based on the
value oC the work done and not the amount charged in the performance oC the
volunteer's normal occupation. For this purpose, the value oC volunteer time shall
be deemed not to exceed Corty dollars (.~ per hour.
5. Scone of Work. The Grantee shall perform and accomplish each of the
activities (individually, an "Activitv" and collectively, the "Activitieg") described in
the Schedule oC Activities attached hereto as Exhibit C (the "Schedule of
Activities"), on or beCore the respective due date of such Activity indicated in the
Schedule oC Activities. The Schedule of Activities may incorporate by reCerence the
Activities indicated in a work plan, schedule, or other document prepared by the
Grantee or any other person or entity, provided that it contains the information
required by this Paragraph 4.
6. Statu. R..00Pt. The Grantee shall deliver to EFI quarterly project
status reports that outline the Grantee's progress in completion oC the Project (each.
a "Status Renort") as Collows:
(a) The Grantee shall deliver a Status Report to EFI on or beCore
the tenth (10"') day following the last day oC each Reporting Quarter during the
term oC this Agreement. As used in this Agreement, a -ReDortiDll Quarter" shall
mean a quarter of a reporting year ending on August 31, with the Reporting
Quarters to end on November 30, on the last day oC February, on May 31, and on
.June 30.
(b) Each Status Report shall consist of no more than five (5) pages.
(c) Each Status Report shall outline the Grantee's progress in
completion of the Project during the Reporting Qual.ter for which the Status Report
is delivered, And it shall specifically include the following information:

cannot reasonably be withheld:
(c) The Grantee produces sufficient documentation, as EFI may
request from time to time in its discretion, of its receipt and use of Matching Funds
in accordance with the Project Budget.
In the event one or more of the preceding conditions are not met. EFI shall provide
to the Grantee a statement that includes the reasons for which the Grant Funds are
not disbursed as requested in the Status Report. Such statement shall also include
the additional action the Grantee must accomplish before the Grant Funds will be
disbursed, which actions may include providing or agreeing to a revised Schedule of
Activities or Project Budget. Upon the Grantee's completion of such additional
actions, and EFl's reasonable approval of the same, EFI shall disburse to the
Grantee an amount equal to the amount requested for disbursement in the Status
Report or such other amount as EFI deems to be consistent with the Project Budget,
whether or not revised, wholly within EFl's discretion. The acceptance of final
payment under this Agreement, or the acceptance of final payment upon early
termination hereof, shall constitute full and complete release of EFI by the Grantee
from any and all claims, demands, and courses of action whatsoever.
9. FinD. I'rm_ Renol't. The Grantee shall submit a final project report
within fortyfive (45) days following the Grantee's completion of the Activities (the
"Final Proiect Rsoort"). The Final Project Report shall include the follOwing
information:
(a) Certification that the Project, including all of the Activities, has
been completed in compliance with the terms and conditions of this Agreement:
(b) Total amount of Grant Funds received from EFI pursuant to
this Agreement;
(d Total amount of Matching Funds received:
(d) Total amount of Project expenditures paid Or reimbursed from
the Grant Funds:
(e) Total amount of Project expenditures: and
(f') Explanation of any material changes in circumstllnces that may
affect the outcome or commercial potential of the Project.
10. Final Audit ReDOrt. Within fortrfive (45) days following the
,:ompletion of all of the Activities, the Grantee "hall cause to be prepared at the

Grantee's expense and delivered to EFJ a final audit report of an independent
certified public accountant (or a firm thereof') licensed to practice in the State of
Flol'ida, stating the professional opinion that the Grantee has complied with this
Agreement (the "Final Audit ReDort"l. In lieu of providing the Final Audit Report
in such manner, if the Grantee has an annual audit by an independent certified
public RCcountant (or a fU'm thereof) licensed to practice in the State of Florida. or if
the Grantee has a state single audit or state project'speciflC audit pursuant to
Section 215.97, Florida Statutes (the ~Florida Sinllle Audit Act"), prepared for the
fiscal year in which this Agreement concludes. the Grantee may pro\ide to EFI at
the time when such audit is completed (but not more than 120 days following the
end of such fiscal year of the Grantee) a l'eport stating the professional opinion that
the Grantee has complied with this Agreement.
11, COUDterru"":a, This Agreement may be executed in counterparts and
shall be of the same force and eft'ect as if all parties had executed one copy of the
Agreement, In addition, to facilitate completion and execution of the Agreement,
faxed signatures shall be of the same force and effect as original signatures,
12. Accountu.ll' Records, The Grantee shall maintain accounting records
that reflect the total Grant Funds received by the Grantee under this Agreement
and the total expenditure of such Grant' Funds. Such records shall be kept in
compliance with the Florida Single Audit Act and within the guidelines of generally
accepted accounting principles, procedures, and practices for a period of no less than
three (3) years follOWing the date On which EFI makes the final disbursement under
Paragraph 7 of this Agreement,
13. Florid. Sinal. Audit Aet. The Grantee acknowledges that, by entering
this Agreement, it is a "subrecipient" wiihin the meaning of the Florida Single
Audit Act, and it is subject to the provisions thereof, as well as the rules of the
Executive Office of the Governor of the State of Florida. the Comptroller of the State
of Florida, and the Auditor General of the State of Florida related thereto. For that
reason:
(a) The Grantee shall allow EFJ, OTTED. the Comptroller, Office of
the Chief Inspector General, and the Auditor General access to the Grantee's
records and the Grantee's independent auditor's working papers as necessal'}' to
comply with the requirements ofthe Florida Single Audit Act.
Ib) The Grantee shall notify EFJ if it becomes subject to a state
single audit or project-specific audit pursuant to the Florida Single Audit Act.

Statutes. The Grantee shall cooperate with EFI regarding EFrs efforts to comply
with the requirements of Chapter 119, Florida Statutes.
16. Future M'Aintenan...., The Grantee agrees to be responsible for future
maintenance expenses and other expenses associated with the Project, if any. after
the conclusion of thili Agreement.
16. CooPdinetioll. When reasonable, the Grantee shall coordinate with
other components of the state and local development systems of the State of Florida
and avoid duplication of existing state and local services and activities provided in
Florida.
17. lnllu....nce. The Grantee represents that prior to the execution of this
Agreement, the Grantee provided EFJ a certulCate of insurance indicating that the
Grantee maintains all insurance coverage required by law (including, without
limitation, workers' compensation insurance) and such other insurance as EFI
required. Such insurance covers not only the activity of the Grantee but also acts
and omissions of the Grantee's agents, employees, and representatives.
18. PromotionAl MatariAI.. Advertisements, signs, and other promotional
materials funded by this Agreement shall include reference and credit to EFI and
OTTED. The Grantee shall not use the State Seal of the State of Florida. The
Grantee shall not use the logos or service marks of EFJ without the prior written
approval of EFl.
19. IndeDendent Contractor. The Grantee is acting as an independent
contractor and not as EFl's employee in the performance of this Agreement. The
Grantee acknOWledges that EFI is not responsible for withholding and filing
national or slate taxes or other payroll withholdings on hehalf of the Grantee. The
Grllntee further acknowledges that neither the Grantee nor the emplo)'ees of the
Grantee will participate in or receive any employee henefits. inclUding health

insurance, retirement benefits, 401(kJ plah. or worker's compensation benefits
pl'o\'ided through EFI.
20. Indemnification. The Grantee agrees to be liable for, and shall
indemnify, defend, and hold EFI, OT'fED, and the State of Florida harmless from
all claims, suits, judgments, or damages arising from the Grantee's performance of
the Activities and its other obligations under this Agreement.
21. No PIed28 of Credit. The Grantee has no authority to, and shall not.
pledge the credit of EFI, OTTED, or the State of Florida. or purport to make EFI,
OTTED, or the State of Florida a guarantor oC payment or surety for any contract,
debt, obligation, judgment, lien or any form of indebtedness.
22. Coml1lian... with Law. The Grantee agrees that all acts to be
performed by it in connection with this Agreement shall be performed in strict
conformity with all applicable local. state. and lederallaws and regulations.
23. Non-DillCl'iminatioD; Anti-Hara88ment. The Grantee shall not
discriminate unlawfully against any individual employed in the performance of this
Agreement because oC race, religion, color, sex, ph}'sical handicap unrelated to such
person's ability to engage in this work, national origin, ancestry. or age. The
Grantee shall provide a harassment.free workplace, with any allegation of
harassment to be given priority attention and action.
24. Public Entitv Crime Liat; Di8eriminttorv Veotl"!' List. To the extent
required by the Florida Statl1es 287. 134(3)(a) and section 24.4 of EFl's contract with
OTTED, the Grantee acknowledges notice of the requirements oC Sections
287.134(2)(b), Florida Statutes. To its knowledge. the Grantee has not been placed
on the discriminatory vendor list described by Section 287.1.)4. Florida Statutes. To
the extent required by Florida Statutes 287.133(2)(a) and section 25.3 of EFl's
contract with OTTED, the grantee affirms that it is aware oC the provision8 oC
Florida Statutes 287.133(2)(b). Grantee affirms that at no time has it been
convicted of a Public Entity Crime and agrees that any such conviction during the
term of this contract may result in termination of this contract.
25. Failure ofSatislactorv PerformAn~, EFl's obligation to pay the Grant
Funds to the Grantee hereunder is contingent upon EFI's receipt when due and
approval of all Status Reports, Invoices. and other reports required under this
Agreement, the Grantee's satisfactory completion 01 the Activities. and the
satisfactory performance of the Grantee's obligations under this Agreement. a"
determined hy EJ:o'1 in its reasonahle discretion. EFI may terminate this Agreement,
or renuce the amount of the Gl"Rnt Fund.., at any time for the Grantee's breach of

26. Availabili~ of Grant Funds, EF1's obligations under this Agreement
are contingent upon the continued availability to EFI of legislatively appropriated
fund~ from the Grant Program that mal' be used in support of this Agreement. In
the en'nt the funds on which this Agreement is dependant are withdrawn. this
Agreement may be terminated at EFI's option and EFI has no further liability to
the GRANTEE be}'ond that already incurred by the termination date and within
the limits of unpaid grant funds which were not withdrawn. In the event of a state
revenue shortfall. the total grant may be reduced accordingly. OTTED shall be the
final determiner of the availabilit}' of any lunds.
27. Contract ManallBr. EFI'll Grant Coordinator. Mimi Kartsonakis. shall
act as the Contract Manager to ensure compliance with all of the terms and
provisions of this Agreement,
28. Notices. All notices between the parties provided for herein shaU be b}'

30. JurilIdictioll. With respect to ita interpretation, construction, effect,
performance, enforcement, and all other matters, this Agreement shall be governed
by, and be consistent with, the whole law of the State of Florida, both procedural
and substantive. Any and all litigation arising under this Agreement shall be
brought in the appropriate State of Florida Court in Orange County, Florida. If any
provision of this agreement is deemed to be invalid, it shall be considered deleted
hsrefrom and shall not invalidate the remaining provisions. In any action to
enforce the terms ofthis Agreement, the prevailing party shall be entitled to recover
reasonable attorney's fees and costs as deemed just and proper.
31. l\frvliA...Uon. This Agreement may be modified only upon the written
and mutual consent of both parties.
32. CoIDDlet.e ^-_t. This Agreement, with all exhibite hereto,
constitutes the entire agreement between the parties and supersedes all
agreements representations, warranties, statements, pl'Omisea and understandings.
whether oral or written, with respect to the subject matter, and neither party shall

statements, promises, or understandings not specifically set forth in this

The Monroe County School system receives apprOlcimately 5350.000
per year in military PlLOT (payments in lieu of taxes) funds and
impact fees.
In addition to the funds received by the public school system.
numerous military personnel and their dependents attend Florida Keys
Community College and the NAS Key West extension of SI. Leo
University.
The Florida Keys has a substantial military presence. which
complements all aspects of our business and civic life. Military
dependants are highly sought after as employees of local businesses.
Our military economic impact is second only to our primary economic
engine oftourism.
The economic impact of our military presence is estimated at One Half
Billion Dollars per year.

KcysiMonroe County are inlegral to our national defense related interests. Naval
Air Stalion Key West suppo"S the premier air anack training range in the eastern
half of our country - the proximity of the range to the runways allows combat
training to begin within 2-3 minutes of take-ofT and we have the highest
percentage of fair weather flying days of any United States combat training
facility. Key West port/harbor access is presently being dredged and by 2006. we

will accommodate port \'isits by all Naval and Coast Guard vessels except aircraft
carriers and nuclear submarines, Coast Guard Group Key West is the "point" of
the Coast Guard's "spear" on all Homeland Security functions, including drug and
alien interdiction. safety and security of human life and property, protection of
marine resources and maintenance of aids to navigation, We also are the home of
the John F, Kennedy Special Forces Dive Training Facility. This facility provides
dive training and special operations training to all of our military serv'ices. One of
our strongest points is that Key West is the home of the Joint Interagency Task
Force, a true purple/joint command composed of all military branches: Navy,
Coast Guard, FBI, CIA, DEA, etc.
9. Communitv SUD-port and Involvement:
The Key West Military Affairs Committee (MAC) has existed for nearly SO years.
It is an organization of local civilian and military leaders that meet once a month
to discuss issues of joint interest. Outstanding military service members are
recognized and presented their awards at the MAC meetings. The Navy League
has been active since World War II and conductsjoims activities with MAC.

The Florida Defense Alliance was eslablisbcd by the governor 10 prolect Florida navy basis &om

(BRAC) and Realignment Act of 1990.

Date: Florida Defense Reinvestment Grant to the Florida Keys Defense Alliance
Proiect Issue: The Florida Legislature created the Defense Reinvestment Grant
Program within the Executive Office of the Governor, Office of Tourism, Trade and
Economic Development to assist defense-dependent communities. These grants are
designed to help communities develop economic diversification strategies, improve base
efficiencies, and implement base reuse programs. The State awards grants from funds
available to these efforts and authorized Enterprise Florida, Inc., to administer the
Defense Reinvestment Grants Program for the State.
In J.uly 20M, the Florida Keys Defense Alliance (FKDA) (a local organization
working with the Florida Defense Alliance) submitted two (2) grant applications to
Enterprise Florida, Inc.
In October, the City of Key West received a $600,000 Grant for the
planning/development of access (ingress and egress) to the Truman Waterfront, Ft.
Taylor State Park and the Outer Mole Pier. The FKDA received a $90,000 grant to
support military/defense advocacy efforts and appropriate military facility analyses. This
FKDA grant is to maximize the military need for and value of Monroe County military
facilities in order to minimize potential for base closure and/or realignment.
The military is the second largest economic sector of the Florida Keys economy.
TIle economic impact of Monroe County defense spending reaches almost One-Half
Billion Dollars annually ($463.7 Million). This does not include Coast Guard activities.
Exnenditure of Funds: The FKDA is engaging RJ. Natter & Associates, LLC as
an advocate and consultant to assist the City of Key West and Florida Keys with
Congressional and government relations efforts. Attached is a short resume on the
consultant retained by the FKDA. Approximately $78,000 of the funds will be used to
compensate the consultant and the remaining funds will be used to pay expenses of the
FKDA members and community leaders in attending Florida Defense Alliance meetings
around the state and a meeting in early 2005 in Washington, D.C. One specific task of
the consultant is to advocate the conveyance of naval properties to the City of Key West
and/or Monroe County for the construction of affordable housing.
Financial Issues: Invoices will be prepared by FKDA and submitted to Doug
Bradshaw who will document the "local match" and then submit the
invoices/documentation to Enterprise Florida, Inc. Enterprise Florida, Inc., will make
direct payments to FKDA from the Grant program, equal to the lesser of $90,000 or the
amount actually expended by FKDA. The FKDA is securing matching funds in the
minimum amount equal to $29,700 (33% of the Grant funds). The "local match" will
primarily be in-kind contributions in the fonn of dedicated volunteer time, use of
equipment, software and time devoted by City staff.
Recommendation: ] understand that City staff recommends that the City Commission
support the FKDA grant supporting military/defense advocacy efforts.

The Board of Directors of Last Stand opposes Resolution L "Authorizing a City match in the
amount of $29,700.00 for a $90,000.00 Enterprise Florida Community Oefense Reinvestment
Grant 10 the Florida Keys Defense Alliance."
The description of the project Is vague and lacks any specificity or measurable performance
standards. The application does not include required documentation regarding the budget or
scope of work. The grantee was not in legal existence at the time.the application was submitted.
The matching fund request for nearty $30,000 participation from the city should require a contnact
for seNices. Such a contnact may violate Key West Ordinance 2-796, which states, "All purchases
of commodities and contractual seNices when the estimated total cost thereof shall exceed
$20,000.00 shall be awarded by the city commission through the process of competitive. sealed
bidding or competitive request for proposals except as otherwise provided in this division."
The Florida Keys Defense Alliance submitted their grant application for state funds on July 23.
2004. According to the Florida Division of Corporations, they only filed their corporate registration
on September 17, 2004. According to page 5 of the July 23 application, the City of Key West had
already committed the matching funds that you are being asked 10 approve over three months
later.
The application form states, "The grant funds shall be used for the specific expenditures Indicated
on the Project Budget, an approved copy of which shall be attached hereto as Exhibit B: FKDA
states, counter to the requirement, that the budget will be submitted with their first progress
report.
Paragraph 5, titled Scope of Work requires the grantee to submk a detailed Schedule of
Activities, which are to be performed under the agreement. The form is to be attached to the
application and labeled "Exhibit C.' FKDA states, counter to the requirement, that they will submit

While on its face. the application does not appear to comply wkh the requirements of Enterprise
Florida. it would refiect poorly on the city to obligate in-kind seNices without knowledge of the
seNices required, specific activities to be performed and measurable guidelines to indicate that
the city Is receiving a just value in exchange for its investment
In the past, the Qty has retained an experienced consultant when faced with base closure Issues.
However, the upcoming 2005 round of base closures are already announced and the entire Slate
of Florida has no threatened closures by any branch of the military.
The request for the matching funds and the grant itself appears totally unwarranted and its
inclusion on the consent agenda without an executive summary is disturbing.

This is not the Infrastructure grant for the roadways which is being delayed by the Navy,
but the grant that pays for Adm. Natter to do whatever. It is the grant that David Paul
Horan submitted to Enterprise FL committing the City to a $27,000 match that had not been
authorized.

decided not to move forward on. He indicated that he had support from the Mayor and votes

Attacred is a form that I have developed with the help of Dennis and Margaret that will aid in the tracking. Please print
out the form and keep it somewhere on your desk. If you spend anytime on the grant or have an expense because of
the grant, please record it on the form and make copies of any backup (receipts). With each quarterly report that I
prepare (first being Feb 28), I will ask for copies of the tracking sheets. If you have already worked on the grant and
can recall your hours, please go ahead and record them The starting date of the in-kind funds was September 1, 2004.

Julio,
Attached is the latest quarterly report for the FL Keys Defense Alliance (FKDA) Community Defense Grant. As
you can see, we are making little progress on spending the money (only $28,745) because of lack of in-kind
services. December the grant expires and I doubt we will even have spent half the grant by that time. Enterprise
FL folks are extremely concemed with this since that money could have gone to another community. If we do not
spend ~, the money is lost.
Add~ionally, I am not sure if you are aware, but the FKDA applied for and was awarded another $90,000 for 2006
for the same thing as the current grant. Enterprise FL called me and they are holding the grant contract from
FKDA pending the City's agreement and approval on the required match. See the attached for what is required
out of the City (last page of application). To my knowledge the City did not approve the funds for this project
especially the $25,000 cash. Also, they are not happy that we cannot spend the original $90,000 and now we
have gotten another $90,000.

we are concemed with is the last page which states the following:

The City of Key West has committed to provide local match that exceeds the mln of 1 :3 to ensurs that the
FL Keys Defense Alliance has the rssources necessary to adequately advocate on behalf of Its military
Installations, missions, and Interests, and to conduct military facility analyees (as appropriate)
The City of Key West and the FL Keys Defenee Alliance will match the requested grant through In-kind
Investment of salaries of City Employees, the Chairman of the Key West Military Affairs Committee, and
members of the FL Keys Defense Alliance. In addition to substantial In-kind Investments, the City of Key
West has committed a minimum of $25,000 to support BRAC related expenses and local efforts to
preserve and expand the FL Keys military presence.

Please see email below. I have received clarification from Enterprise that on the new $90,000 ($117,000 total
project) Community Defense Grant that was awarded to the FL Keys Defense Alliance, that the City would be
responsible, once agreement is executed, for a 30% match (or $27,000). The match can be in-kind or cash.
Originally I had brought to your attention that the grant application called for the in-kind match plus a minimum
$25,000 cash contribution. The $25,000 did not get put in the grant agreement and is not required.
The grant application indicates the purpose is to promote DoD economic growth in the FL Keys, protect region
DoD investments, and improve quality of life for region military members and their families.
This is very similar to the first grant for $90,000 ($119,700 total project - $29,700 City Match) that was awarded to
the FL Keys Defense Allianc13. That grant expires next month and to date $28,745 (of the $90,000) has been
spent (this represents $9,485 of in-kind services for total project of $38,230).
My question is does it make sense for the City to agree to provide in-kind services for a second grant when there
is going to be a significant short fall of in-kind for the first grant? Enterprise FL has indicated that the City has the
option of not executin\l the grant and allowing the grant money to be redistributed to another community that may
have a greater need. ,Once the grant agreement is executed, any unspent grant money at the end of the grant
term is lost and cannft be redistributed. This is what will happen with unspent money from the first grant.
Enterprise FL is await\n~ direction from the City.

Defense Infrastructure Grant has been approved for an award. J have asked that an
agreement between Enterprise Florida, Inc and the City of Key West be negotiated
authorizing the transfer of state funds to be applied toward the project costs of up to
$600,000 for Ingress/egress road construction and improvements.
It is the intent of the Florida Defense Infrastructure Grant Program to provide funds to
qualified applicants for the purpose of supporting local infrastructure projects deemed to

installations, including projects supporting base use diversification and base re-use
strategy in the State of Florida. CrrED awards grants from funds available, a total of

Julio opened the meeting and everyone introduced themselves.
Julio explained that Paul Clayton was attending the tirst meeting so that he could create a
Mission and Goals statement for the committee.
Julio mentioned to everyone that Elliot Baron and Commissioner Turner were against this
but Commissioner Carmen Turner was fine with grant since the city is cooperating with
the grant in a correct way.
Raymond Archer passes out two handouts which one was the time sheets for time
recording that Dennis Grote and Doug Bradshaw wiII review.
Jay Gewin stated that the match is 29% of the expenditure which equals $29,700.
David Horan stated that it could not excet.'<! $40.00 an hour and aII hours are to be
recorded and show specifics for all hours. '
Raymond stated that aII correspondence should go through the Port Otlice for audit
purpose.
David Horan stated that aII past meeting can be accounted for reimbursement and his
charges for when they travel to Orlando, Pensacola and Washington.

Community Defense Grant - Lack of In-kind Services
As you recall, the City agreed to a 33% ($29,700) match for the Community Defense Grant that
was awarded to the Florida Keys Defense Alliance. The grant, $90,000 (total project is
$119,700) is being used to pay Adm. Natter for advocacy concerning Florida Keys military
facilities.
As we prepare the third quarterly report, it is becoming apparent that there is not enough Florida
Keys Defense .Alliance and/or staff time to provide the required rnateh. As it stands now,
$39,000 has been billed toward the grant with $7,835 of in-kind services for a total project to
date of $46,835. This leaves $7,620 short (33% of total project is $15,455) of the match portion.
The $7,620 is what is needed to make up the difference from what has been billed and what the
grant is reimbursing the Florida Keys Defense Alliance.
Pending a drastic increase in staff and/or Florida Keys Defense Alliance time, the City will be
required to make up the match with cash.

Dear Me. Horan:
This letter is provided as a report of progress in support of our Letter of Agreement between R. J.
Natter & Associates, LLC and the Florida Keys Defense Alliance (FKDA) dated 11 December
2004.
For the quarter September 1 to December 2, 2005, our initiatives included the continuing
combined efforts to establish a close and cooperative working relationship between the Key
West community and the military neighbors within the community. Our focus has been on
increasing the availability of affordable housing for government service civilians assigned to the
Florida Keys military bases and adequate housing for the many people and their families who
support the bases and the local economy. We also addressed the jet noise contours (AICUZ)
surrounding NAS Key West and the appropriate use of State Grant money for State
Infrastructure Grants. Additionally, I worked to establish a good understanding of the special
challenges and opportunities associated with the military's presence in the Keys among senior
Navy, DaD and State officials.
The DaD and federal government decisions regarding he Base Realignment and Closure
(BRAC) process is of special interest in this report in that it culminates two years of effort at the
State and Community level to protect these important economic engines. The BRAC process
ended during this reporting period. The decisions in BRAC, which are now law, reinforced the
importance and value of the military missions and facilities located in the Florida Keys. In spite
of the 180 decisions on closure and realignment across the nation, the Florida Keys were fully
recognized for their importance to the nation and DOD and, as a result, were not affected.
Our efforts in support of the Florida Keys Defense Alliance and the City of Key West during this
quarter included two trips and a series of meetings in Key West with the FKDA Chairman and
members, the Commanding Officer of NAS Key West and his staff, and a City Council official.
These visits and meetings were September 11 and November 11-12. In addition, I participated in
many phone discussions with these same leaders on a regular basis, addressing each of the issues
of importance to the Keys and the military community. I traveled to Tallahassee at least once
each month to ensure the priorities and concerns of Key West were well represented.
My meetings there included the Governor and members of his staff, from the Chief of Staff to his
General Counsel and members of various directorates. Meetings and calls included such issues as
hurricane relief, State Grant awards, and a one-week City election postponement request due to
hurricane evacuation and damage.
I visited the home office of a Public-private housing Company in Philadelphia and visited with
the Navy Southeast Region Commander in Jacksonville concerning Navy housing in Key West.
Both visits were to ensure that the Navy Region's transition into the public private housing
business will happen with the special circumstances of Key West well understood and protected
by industry and the Navy, and with the intent that the ultimate contract responds to those special
needs and concerns.
I had meetings on two occasions with the new Chief of Naval Operations in Washington, DC, to
discuss issues of importance to Key West. I also discussed by phone the housing challenges at
Key West with the Senior Military Advisor to the Secretary of Defense. These meetings and
calls were accompanied by a meeting in Washington, DC, with the Navy's Commander of all
Navy Installations. Again, these discussions were for the purpose of ensuring that the Navy's
leadership was aware of Key West's special situation.
I hope this summary appropriately summarizes our work during this quarter in support of the
Florida Keys Defense Alliance and the City of Key West.
