Re: FDOT Five Year Transportation Plan — FY2008-09 — FY2012-13
We have reviewed FDOT's Five Year Work Program as it relates to roads, bridges, and
enhancement projects. Listed below are projects of interest and/or changes from last year's plan.
1. Project 2504451 — Jewfish Creek Bridge —project under construction; no change from last
year.
2. Project 4056122 —Big Pine Key Turn Lanes —project schedule changed from FY2011 to
FY2010.
3. Project 2505341 —Big Coppitt 3 Lane —project still scheduled for FY2008.
4. Project 2505483 — N. Roosevelt Reconstruction —project still scheduled for FY2011;
construction to continue into FY2012; additional funds allocated.
5. Project 4137212 —Old 7 Mile Bridge Rehabilitation —project schedule changed from
FY2009 to FY2010 ($11,475,000 budgeted up from $11,247,000 last year).
6. Project 4055826 —Flexible Pavement Reconstruction in Grassy Key —project construction
still scheduled for FY2008 and will continue into FY2009; additional funds allocated.
7. Project 4055828 —Flexible Pavement Reconstruction in Plantation Key & Long Key —
project still scheduled for FY2008. Long Key portion deleted from project.
8. Project 4209111 —Bike Path from MM83.5 — MM84.8 (Windley Key) -project still
scheduled for FY2011; no change from last year.
9. Project 4180551 —Bike Path Trailhead at MM106 —project still scheduled for FY2010; no
change from last year.
10. Project 4180561 — Bike Path Fishing Platform at MM72 Channel 2 Bridge — project deleted
from work program.
11. Project 4226291 — Bike Path at South Pine Channel Bridge MM29 — project schedule
changed from FY2011 to FY2012.
12. Project 4226281 - Bike Path at Spanish Harbor Bridge MM33 - project schedule changed
from FY2010 to FY2012.
13. Proj ect 4241961 - Bike Path at Lower Sugarloaf MM 15 to 16.5 - new proj ect scheduled for

23. Project 4165201 - Bike Path along old Ohio -Missouri Bridge (MM39.1) - project still
scheduled for FY2009; no change from last year.
24. Project 4056322 - Bike Path, Ohio/Bahia Honda - MM38.7 - project schedule changed from
FY2008 to FY2009.
25. Project 4056024 - Miscellaneous bridge repair/rehabilitation - new project scheduled for
FY2010.
26. Project 2504461 - 18 Mile Stretch Reconstruction from Jewfish Creek Bridge to
Monroe/Dade Line - project under construction; no change from last year.
27. Project 4123321 - Card Sound Road/C905 Intersection - project schedule changed from
FY2011 to FY2012; ($4,357,000 budgeted down from $6,948,000).
28. Project 4163771 — Key West International Airport Terminal - $17,017,000 still scheduled to
reimburse County project in FY2008, FY2009 and FY2010.
Included in FDOT's Five Year Plan are over 38 miles of bike path projects, 30 miles of road
resurfacing projects and several bridge repair projects. Also, there is funding for planning
services, airports, transit and various other projects.

AGENDA ITEM WORDING: Approval to advertise for a Request for Proposals for the
Development, Construction and Management of Hotel(s) at Key West International Airport and

ITEM BACKGROUND: The County's objective is to provide travelers to the Keys and patrons of
these Airports with an upscale professionally managed and operated Hotel program, maximizing
economic development and income generation from the sites, to the benefit of the County.
In addition, the County is requesting that the Hotel at the Marathon location be fully integrated with
(directly accessible and physically connected to) the future Emergency Operations Center to be
constructed at the Marathon Airport Parcel, providing EOC staff and emergency personnel with
elevated parking, hotel rooms, and dining facilities during times of emergency in the County.
The attached Request for Proposals is for informational purposes only, and is subject to changes and
final review by the County Attorney's office.

ARTICLE I. GENERAL OVERVIEW
This is a request by the Board of County Commissioners of Monroe County Florida, hereinafter
referred to as the "County," for the submission of sealed proposals for the construction,
management and operation of two hotels; one located at Key West International Airport, Key West,
Florida and the other at Florida Keys Marathon Airport, Marathon, Florida (hereinafter referred to
as the "Airports").
Upon selection of the preferred Proposer(s), the "County" and preferred Proposer(s) shall negotiate
the terms and conditions related to the hotels at the "Airports" and, if successful, may enter into an
agreement (s) (hereinafter referred to as "Agreement"). This request is extended only to experienced
parties, which meet the minimum qualifications as outlined under Article VII entitled MINIMUM
QUALIFICATIONS OF PROPOSER(S).
The "County" has available two sites: Parcel I located at Key West International Airport
(approximately 84,550 square feet / 1.94 acres) and Parcel II, located at Florida Keys Marathon
Airport. (approximately 107,800 square feet / 2.47 acres) as attached hereto. Proposals may be
submitted for the development and use of either parcel or both parcels. Parcel II is also the site of a
future emergency operations center.
The selected Proposer(s) will be required to comply with all applicable Equal Employment
Opportunity laws and regulations of the State of Florida and the United States of America. The
attention of prospective Proposer(s) is also called to the policy and goal of the "County" to have
Disadvantaged Business Enterprises (hereinafter referred to as "DBE"), participate in all contracts
to the maximum extent possible. All persons are invited to submit proposals without regard to race,
color, religious creed, age, marital status, national origin, sex, sexual orientation, mental retardation
or physical disability including, but not limited to, blindness unless it is determined by the "County"
that such disability prevents performance of the work involved.

Sealed proposals must be submitted according to the format outlined under Article III
entitled PROPOSAL CONTENT and be received at the above, no later than 3:00 p.m ,
2007. The proposals are subject to the conditions and specifications contained in this Request for
Proposals.
The "County" intends to select the preferred Proposer(s) who is, in the opinion of the
"County," the best qualified and who submitted a proposal(s) which describes certain experience
and qualifications to ensure quality customer service, at the "Airports," optimizes economic
development and income generation from the sites and represents a feasible development project at
the "Airports" with the "County."
The "County" will review all proposals submitted and selected in order of their respective
qualification rankings, for possible interviews and negotiations. Should the "County" be unable to
negotiate an agreement with the preferred Proposer(s), it may choose to either select from the
remaining Proposer(s), based on the next highest rankings, or re -solicit.
The "County" reserves the right to reject any and all proposals, without recourse.
The selected Proposer(s) will be given fifteen (15) business days from the date of receipt of
the final mutually acceptable Agreement, to review and sign the document. If, by the end of that
period, the "County" has not received the executed Agreement along with the necessary
certificate(s) of insurance, corporate resolution and all other affidavits and certificates as required
by the "County" from the selected Proposer(s), the "County" may, at its option, rescind the
selection, and proceed with the selection of another Proposer(s). In such event, the previously
selected Proposer(s) shall have no recourse against the "County."
The "County," at its sole discretion, shall have the right to rescind without prejudice its
selection and cancel all negotiations and terminate the proposal process at any time prior to the
"County's" execution of the final Agreement, without recourse by the selected Proposer(s).
ARTICLE II. REQUEST FOR PROPOSAL
The Board of County Commissioners (BOCC), of Monroe County, Florida will consider proposals
which are not intended to be nor will be accepted as bids, but only as proposals, from interested
Proposer(s) for the Development, Construction and Management of two Hotels at Key West
International and Florida Keys Marathon Airport, Monroe County, Florida.
The "County" will enter into an Agreement with the selected Proposer(s) for no less than 25 years;
with a mutually agreed upon option term(s) dependent on the nature of the Proposal. Any such
option shall be based on the selected Proposer(s)'s performance and compliance with all Agreement
terms and conditions during the initial term.
All proposals in response to this RFP are to be sole property of Monroe County, and the "County"
reserves the right to use any part of any proposal. Proposer(s) are encouraged not to include in their
proposals any information that is proprietary, as all material associated with this procurement
process are subject to the terms of State laws defining freedom of information and privacy, and all
rules, regulations and interpretations resulting from those laws. All Proposer(s) may identify any
part of their proposal as proprietary or confidential. However, any Proposer(s) that identifies any
part of their proposal as proprietary or confidential shall have the sole burden of defense if
challenged at the Freedom of Information Commission. All Proposals shall remain valid for a

period of 180 days beyond the deadline for submission and may be extended beyond that time by
mutual agreement.
ARTICLE III. OBJECTIVES OF THE "COUNTY"
The "County's" objective is to provide travelers to the Keys and patrons of these "Airports" with an
upscale professionally managed and operated Hotel program that will demonstrate the Proposer(s)'s
ability to market and promote programs to obtain maximum patronage, while also maximizing the
economic development of, and income generation to the "County," consistent with good business
practices. The commitment to quality is intended to extend to every component of the design,
construction and management of the Hotel program from the design, to the professionalism of the
employees servicing the public. The Proposer(s)'s experience and knowledge, reputation and
financial strength and any other matter that, in the BOCC's sole opinion, affects the ability of the
Proposer(s) to maintain and operate the program to benefit the "County" will be major factors in
selecting a Proposer(s).
The "County's" objective is also to provide accommodations for an emergency operations center to
be constructed on Parcel II in Marathon. The hotel is to have adequate elevated parking for EOC
personnel and hotel operations. Any existing parking that is eliminated due to construction must be
recreated. Hotel rooms and dining facilities shall be made available for EOC staff during times of
emergency. The hotel must be directly accessible to the EOC during times of emergency, and
physically connected to the EOC.
The BOCC reserves the right, at its sole discretion, to request additional information which it or its
staff may consider important; to reject any and all proposals; to postpone or to cancel the
solicitation at any time prior to the written execution of the Agreement and to negotiate the final
terms and conditions of the Agreement with the selected Proposer(s). Additionally, the "County"
reserves the right to reject any and all proposals for any reason whatsoever, and to terminate this
process at its sole discretion, when deemed to be in the best interest of the "County," at any time
prior to the written execution of a formal Agreement.
ARTICLE IV. PROPOSAL CONTENT
Proposer(s) is expected to submit "General Information," "Technical Information," "Financial
Information" and "Other Related Information" as indicated below. Proposals are to address the key
areas separately for each site.

Part A. GENERAL INFORMATION
Nine (9) copies [two (2) signed originals and seven (7) complete copies] of the proposal
must be submitted and must contain the following information:
Executive Summary
Give a brief synopsis outlining the major points of the proposal including the concept(s)
to be developed by the Proposer(s) within the hotel site, improvements and level of
investment to be made by the Proposer(s), operational plans, and financial proposal.
2. Narrative Description
Outline the substance of the proposal and highlight the strengths of your firm and how
they can be used to develop the hotel site. You are encouraged to be innovative and
consistent within sound business practices.
The Narrative Description must detail the following:
Proposed Concept(s) — Proposer(s) shall state the hotel brand / franchise to be
developed. Proposer(s) shall represent and provide evidence that they possess all rights
necessary to develop such hotel brand / franchise at the "Airports." As the hotel brand /
franchise will be part of the criteria used to evaluate proposals, the selected Proposer(s)
will not be permitted to change the proposed brand / franchise. It is the "County's"
desire that only hotels that are nationally recognized for offering high quality business
and leisure facilities and amenities are to be developed at the "Airports." Proposer(s)
should incorporate evidence of such details in their proposals; this may include, but is
not limited to, the number of franchises presently in operation in the United States, total
sales, market share data, graphics of existing and proposed facilities and amenities, or
any other date the Proposer(s) deems appropriate for consideration.
Additionally, the Proposer(s) shall identify the retail, food and beverage concepts and
brands to be developed within the Hotel. Proposer(s) must demonstrate they possess all
of the rights and privileges necessary to develop the concepts being proposed.
Specifically identify any subleases or franchise agreements required or in place with the
Proposer(s) for such concepts or brands. The "County" will be relying on these
representations for the evaluation and selection process and no changes will be permitted
during agreement negotiations or development of the hotel site without the "County's"
written approval.
3. Management Company
If Proposer(s) plans to utilize a management company please identify the management
company and include background information, experience and financial information.
4. Experience Statement
Enumerate in detail the duration and extent of your business experience with the
emphasis related to the development, operation and management of hotel service.

Also, enumerate in detail the pertinent experience and duties of all persons who will be
directly involved in the development and management of the hotel.
5. Agreement Term
Describe the proposed base term of the lease and all option terms requested. The
"County" anticipates that the term of the agreement will reflect the level of initial
investment made by the Proposer(s) and an amortization period for the proposed
development and financing plan.
Part B. TECHNICAL INFORMATION
The Proposer(s) shall include the following information:
1. Total number of rooms, broken down by room type (single, suite, etc.);
2. Total floor area of hotel;
3. Number of proposed parking spaces, elevated and at grade;
4. Square feet of retail space, and food and beverage space to be developed including
proposed concepts and brands;
5. Square feet of meeting/conference room areas to be developed;
6. All amenities to be included (swimming, spa and exercise facilities etc.);
7. Access improvements (if any);
8. Provide conceptual plans of each proposed development including a site plan, floor
plans, and elevation drawings. Include the EOC footprint.
9. Identify how the proposed facility will interface with the EOC at Parcel H in Marathon.
Include the footprint of the EOC building on the site plan. Describe how the hotel and
elevated parking will be used during EOC operations.
10. Operational Plans - Detail all aspects of your planned supervision, maintenance and
operation of the "Airports" business program. Specific items to be addressed include, at
a minimum, the following:
i. A description of the strategies for accomplishing the "County's" goal of
creating an upscale hotel at the "Airports."
ii. A demonstrated sensitivity to the needs of the "Airports," to continue
throughout the term of the Agreement.
iii. Your plan to involve Disadvantaged Business Enterprises in the management
and operation of the services, including a copy of your firm's affirmative
action plan to be incorporated in your responsibilities as a Contractor at the
"Airports."
iv. A description of marketing and promotional strategies for use in operations,
with an emphasis on measures designed to obtain maximum patronage.

Part C. FINANCIAL INFORMATION
1. Total estimated development cost of each site broken down into primary cost elements
including:
i. Design, engineering, permits and inspection;
ii. Hotel building construction;
iii. Access roads/ drives/ parking; and
iv. Fixtures, furniture and equipment
2. Financing plan for the proposed development and provide evidence of financing
capacity.
3. Investments — Provide an itemized estimate of the investment required to develop the
concept as described above including an estimated opening date from agreement
execution. All improvements and equipment become property of the "County" when
installed in the Hotel Concession space.
4. Provide the total estimated number of permanent employees and associated salary
broken down into primary categories including management, administrative, retail
service, food and beverage service, cleaning and maintenance. Provide the "County"
with proposed work -schedules, staffing levels, and monthly costs. The "Airports"
facilities are subject to statutory Standard wage rates for certain service workers.
5. The Proposer(s) shall pay rent to the "County" each month based upon an annual
guarantee or a percentage of gross receipts from hotel operations, whichever is greater,
provided by the Proposer(s). A percentage of gross receipts shall be proposed for retail
sales, food and beverage sales, room rentals and all other sales. The minimum annual
guarantee and percent of gross receipts shall be stated separately for each site to be
developed for each year of the agreement.
Gross receipts shall be defined as all monies paid or payable to the hotel operator, its
franchisees or sub- concessionaires derived from sales arising from the conduct of
business at the "Airports." This shall include the gross sales price of all food, beverage,
retail, room and other sales made at the "Airports" by the hotel operator, its franchisees
or sub -concessionaires, and all charges or other fees charged by the hotel operator on all
sales made by the hotel operator, its franchisees or sub -concessionaires, at all "Airports"
locations, whether for cash or credit without deduction for credit cards discounts,
whether the same shall be paid or unpaid. Gross Receipts, however, does not include:
• Any and all retail sales taxes, excise taxes or related direct taxes upon the consumer
and collected by the hotel operator in the course of making such sales.

• The amounts of any gratuities paid or given by patrons or customers to employees of
the hotel operator.
• Receipts from the sales uniforms or clothing to employees of the hotel operator.
• Franchise fees or rent paid by franchisees or sub -concessionaires to the hotel
operator shall not be included in the hotel operator's Gross receipts. Franchisees and
sub -concessionaires, however, shall not deduct the amount of such franchise fee or
rent payments from their Gross Receipts
• Cash or credit refunds to customers on transactions (not to exceed the actual selling
price of the item returned) otherwise included in Gross Revenues.
• Receipts with respect to any sale where the subject of such sale or some part thereof
is thereafter returned by the purchaser and accepted by the hotel operator, but only to
the extent of any refund actually granted or adjustment actually made, either in the
form of cash or credit, may me taken as a deduction from Gross Receipts that were
previously reported and paid to the State, or local taxing authority. However, said
deduction must be clearly identified in the monthly report of Gross Receipts in which
month the refund or adjustment was actually issued.
The rent due under the agreement shall be net to the "County." The hotel operator
shall be responsible for all expenses associated with its development, use and
occupancy of the "Airports" including, but not limited to, utilities, taxes and
insurance, any cost to comply with applicable federal, state and local governmental
regulations, and all other costs incurred in the financing, development and operation
of the hotel and associated facilities and services.
The "County" shall not be responsible for payment of any expenses associated with
any project undertaken in response to this RFP.
6. Service Pricing - The "County" and the successful Proposer(s) will agree on fair product
or service pricing language to be included in the forthcoming Agreement document.
Proposals should include suggested relevant pricing provisions to be included in the
Agreement.
7. Surety Information - If you or any of your partners or corporate officials has ever had a
bond or other form of surety cancelled or forfeited, attach a statement naming the
bonding company, date, amount of the bond or other form of surety and reason for such
cancellation or forfeiture.
Part D. OTHER RELATED INFORMATION
1. The "County" reserves the right, during the selection process, to interview any and/or all
the Proposer(s) and to request any additional information which the State may consider
important to its decision.

2. The selected Proposer(s) will be required to comply with the laws of the United States of
America, the policies, practices, regulations and laws of the State of Florida, and Monroe
County, and any other statutory agencies.

4. Any person or entity desiring to submit a proposal shall be responsible for the
examination of the terms and conditions of the Request for Proposals and all documents
describing or relating to the facility upon which the Agreement rights and obligations are
to be granted. The Proposer(s) shall judge for themselves all of the circumstances and
conditions affecting their proposal. Failure on the part of any Proposer(s) to make such
an examination and to investigate thoroughly shall not be grounds for any declaration
that the Proposer(s) did not understand the conditions of the Request for Proposals.
5. The selected Proposer(s) agrees to perform the services proposed as an independent
operator and not as an agent or employee of the "County."
6. The selected Proposer(s) warrants that it has not employed or retained any company or
person other than bona fide employees or consultants working solely for the selected
Proposer(s) to solicit or secure the Agreement and that it has not paid or agreed to pay
any company or person any fee, commission, percentage, brokerage fee, gift or any other
consideration contingent upon or resulting from the award or making of the Agreement.
For breach or violation of the above stipulation, the "County" shall have the right to
annul the Agreement without liability or, at its discretion, to deduct from the agreed price
or consideration or otherwise to recover the full amount of such fee, commission,
percentage, brokerage fee, or contingent fee.
7. The selected Proposer(s) warrants that it did not receive unauthorized information from
any "County" employee regarding this Request for Proposal.
ARTICLE V. EVALUATION CRITERIA
The "County" at a minimum will evaluate all proposals according to the following criteria.
Technical qualification and experience of Proposer(s)'s team, from design
through management;
2. Integration of EOC on Parcel II;
3. Total investment in each site;
4. Financing plans and financing capacity;
5. Annual guarantee and percent of gross receipts;
6. Estimated jobs and salaries at each site;
7. Reasonableness of all estimates included in the proposal;
8. Completeness of the proposal as requested in this RFP;
9. Expected gross sales at the "Airports" and revenue to the "Airports";
10. Proposer(s)'s plan of operation including services offered and staffing;
11. Proposer(s)'s commitment to Civil Rights, DBE participation;
12. Proposer(s)'s demonstrated capabilities to provide satisfactory service;
13. Ability to obtain and provide all necessary state licenses and certificates.
ARTICLE VI. MINIMUM QUALIFICATIONS OF PROPOSERS)
All Proposer(s) must present evidence that they have a minimum of five years experience in
successfully completing large scale commercial development projects and will have the necessary
organization and financial resources to perform according to the obligations of the Agreement. All
Proposer(s) must also present evidence that they possess the necessary rights, title and interests to
develop and operate all brands and franchises included in the proposal. Proposer(s) must also have
on staff (or contracted) professional leadership with a minimum of five years experience in the
management and operation of hotels of the type and quality included in the proposal. Airport
experience is preferred.

NOTICE OF PROPOSED CONSTRUCTION OR ALTERATION
§77.13 Construction or alteration requiring notice. §77.15 Construction or alteration not requiring notice.
(a) Except as provided in §77.15, each sponsor who proposes any of the
following construction or alteration shall notify the Administrator in the form
and manner prescribed in §77,17.
(1) Any construction or alteration of more than 200 feet in height above the
ground level at its site.
(2) Any construction or alteration of greater height than imaginary surface
extending outward and upward at one of the following slopes:
(i) 1 DO to 1 for horizontal distance of 20,000 feet from the nearest point of
the nearest runway of each airport specified in paragraph (a)(5) or this
section with at least one runway more than 3,200 feet in actual length,
excluding heliports.
i) 50 to 1 for horizontal distance of 10,000 feet from the nearest point of
the nearest runway of each airport speed in paragraph (a)(5) of this
section with its longest runway no more than 3,200 feet in actual length,
excluding heliports.
(M) 25 to 1 for a horizontal distance of 5,000 feet from the nearest point of
the nearest landing and takeoff area of each heliport specified in paragraph
(a)(5) of this section.
(3) Any highway, railroad, or other traverse way for mobile objects, of a
height which, if adjusted upward 17 feet for an Interstate Highway that is part
of the National System of Military and Interstate Highways where
overcrossings are designed for a minimum of 17 feet vertical distance, 16
feet for any other public roadway, 10 feet or the height of the highest motile
object that would normally traverse the road, whichever is greater, for a
private mad, 23 feet for a railroad, and for a waterway or any other traverse
way not previously mentioned, an amount equal to the height of the highest
mobile object that would normally traverse it, would exceed a standard of
paragraph (a)(1) or (2) of this section.
(4) When requested by the FAA, any construction or alteration that would
be in an instrument approach area (defined in the FAA standards governing
instrument approach procedures) and available information indicates It might
exceed a standard of Subpart C of this part.
(5) Any construction or atleration m any of the following airports (including
heliports):
(i) An airport that is available for public use and is listed in the Airport
Directory of the current Airman's Information Manual or in either the Alaska
or Pacific Airman's Guide and Chart Supplement
(n) An airport under construction, that is the subject of a notice or proposal
on file with the Federal Aviation Administration, and except for military
airports, it is dearly Indicated that airport will be available for public use.
(A) An airport that is operated by an armed force of the United States.
(b) Each sponsor who proposes constrrcton or alteration that is the subject
of a notice under paragraph (a) of this section and is advised by an FAA
regional office that a supplemental notice is required shall submit that notice
on a prescribed form to be received by the FAA regional office at least 48
hours before the start of construction or alteration.
(c) Each sponsor, who undertakes construction or alteration that is the subject
of a notice under paragraph (a) of this section shall, within 5 days after that
construction or alteration reaches its greatest height, submit a supplemental
notice on a prescribed forth to the FAA regional office having jurisdiction over
the region involved, if—
(1) The construction or alteration is more than 200 feet above the surface
level of its site; or
(2) An FAA regional office advises him that submission of the form is
required.
No person is required to notify the Administrator for any of the following
construction or alteration:
(a) Any object that would be shielded by existing structures of a permanent and
substantial character or by natural terrain or topographic features of equal or
greater height, and would be located in the congested area of a city, town, or
settlement where it is evident beyond all reasonable doubt that the structure so
shielded will not adversely affect safety in air navigation.
(b) Any antenna structure of 20 feet or less in height except one that would
increase the height of another antenna structure.
(c) Any air navigation facility, airport visual approach or landing air, aircraft
arresting device, or meteorological device, of a type approved by the
Administrator, or an appropriate military service on military airports, the location
and height of which is fired by its functional purpose.
(d) Any construction or alteration for which notice is required by any other FAA
regulation.
§77.17 Form and time of notice
(a) Each person who is required to notify the Administrator under §77.13 (a)
shaft send one executed form set of FAA Form 7460-1, Notice of Proposed
Construction or Alteration, to the Manager, Air Traffic Division, FAA Regional
Office having Jurisdiction over the area within which the construction or alteration
will be located. Copies of FAA Form 7460.1 may be obtained from the
headquarters of the Federal Aviation Administration and the regional offices.
(b) The notice required under §77.13 (a)(1) through (4) must be submitted at
least 30 days before the earlier of the following dates —
(1) The date the proposed construction or alteration is to begin.
(2) The date an application for a construction permit is to be filed,
However, a notice relating to proposed construction or alteration that is subject
to the licensing requirements of the Federal Commurkationns Act may be sent to
the FAA at the same time the application for construction is filed with the Federal
Communications Commission, or at any time before that filing_
(c) A proposed structure or an alteration to an existing structure that exceeds
2,000 feet in height above the ground will be presumed to be a hazard to air
navigation and to result in an inefficient utilization of airspace and the applicant
has the burden of overcoming that presumption. Each notice submitted under
the pertinent provisions of this part 77 proposing a structure in excess of 2,000
feet above ground, or an alteration that will make an existing structure exceed
that height, must contain a detailed showing, directed to meeting this burden.
Only in exceptional cases, where the FAA concludes that a dear and compelling
showing has been made that it would not result in an inefficient utilization of the
airspace and would not result in a hazard to air navigation, will a determination
of no hazard be issued.
(d) In the rase of an emergency involving essential public services, public
health, or public safety that required immediate construction or alteration, the 30
day requirement in paragraph (b) of this section does not apply and the notice
may be sent by telephone, telegraph, or other expeditious means, with an
executed FAA Forth 7460-1 submitted within five (5) days thereafter. Outside
normal business hours, emergency notices by telephone or telegraph may be
submitted to the nearest FAA Flight Service Station.
(a) Each person who is required to notify the Administrator by paragraph (b) or
(c) of §77.13, or both shall send an executed copy of FAA Form 7460-2, Notice
of Actual ConstnrAon or Alteration, to the Manager, Air Traffic Division, FAA
Regional Office having jurisdiction over the area involved.

Alteration is a change to an existing structure such as the addition of a side mounted antenna, a change to the marking and lighting, a
change to power and/or frequency, or a change to the height. The nature of the alteration shall be included in ITEM #21 "Complete
Description of Proposal".
Existing would be a correction to the latitude and/or longitude, a correction to the height, or if filing on an existing structure which has never
been studied by the FAA. The reason for the notice shall be included in ITEM #21 "Complete Description of Proposal".
ITEM #4. If Permanent, so indicate. If Temporary, such as a crane or drilling derrick, enter the estimated length of time the temporary
structure will be up.

hundredth of a second if known. Latitude and longitude derived solely from a hand-held GPS instrument is NOT acceptable. A
hand-held GPS is only accurate to within 100 meters (328 feet) 95 percent of the time. This data, when plotted, should match the site
depiction submitted under ITEM #20.
ITEM #11. NAD 83 is preferred; however, latitude and longitude may be submitted in NAD 27. Also, in some geographic areas where NAD
27 and NAD 83 are not available other datums may be used. It is important to know which datum is used. DO NOT LEAVE BLANK.

• For transmitting stations, include maximum effective radiated power (ERP) and all frequencies.

Airport Security and Identification
Development, Construction, and Management of Hotels
at
Key West International Airport
Florida Keys Marathon Airport
Overview
Key West International and Florida Keys Marathon Airports are restricted by federal
regulations in the release of sensitive, security -related information pertaining to airport
security provisions. This section will provide general information only which, even
though of only a general nature, may change significantly in the event of terrorist
activities throughout the world. There is no way to predict future requirements that will
be placed on airports in an effort to protect the traveling public.
Development
Major concerns during the development of a facility in this area would be maintenance of
vehicular traffic flow and vehicle inspection lanes as well as terminal accessibility by
passengers (vehicle and pedestrian).
If contiguous to terminal and terminal support facilities, security and operational issues
will be substantial during all phases of development.
Designs must incorporate access to existing under and aboveground utilities. This
includes access for removal and installation of mechanical systems associated with the
utilities. Additionally, provisions should be made to ensure air intakes are from a non -
accessible area, away from the airfield, existing loading dock area, or general -public
accessible areas.
Windows facing the airfield or allowing even a partial view of the airfield should not be
able to be opened.
Emergency exits may not provide access onto any portion of the air operations area
(AOA).
Roof access points must be controlled through the existing air security system.
Additional, more specific, information will be provided to the successful developer.
Provide for proper ventilation of any contained parking area located under the hotel
structure, as well as proper lighting.
Closed-circuit television system, tied -in to the airport's main system will need to be
supplied by the developer.
Meet requirements of Federal Aviation Regulation (FAR) Part 77 — Objects that Affect
Navigable Airspace; federal/lighting/glare study; FAR Part 139 — certification of Airports
which governs airfield operations.
Fire detection and prevention systems employed should be monitored by the airport and
compatible with the existing systems.
Construction
Access points into the construction area will be required to be connected and controlled
by the airport through existing access control system. The airport will work with the
successful developer to determine a site plan to ensure compliance with all federal and
state security requirements.
Through the construction process, vehicular access must be maintained for normal airport
operations including access to the existing loading dock and all of the underground
utilities located in this area. Any work affecting the terminal roadway system will need
airport administration review/approval and may require work to be performed off hours.
Due to the proximity of the site to the airfield, the successful developer and the
construction management team will be required to work closely with airport
administration and airport operations. Many issues including security access, dust
control, use of cranes, maintenance of clear zones to the security fence line, impact of
construction on other tenants, etc. will require constant communication and coordination.
This site has the potential of causing a great deal of disruption to operations at the airport
and may, at times require such flexibility as work hour changes to accommodate aircraft
operations, work restrictions due to weather or other unforeseen circumstances, the
successful developer must be willing to remain flexible and able to respond 24 hours per
day.
Parking for construction personnel will require approval.
Construction trailers and material lay down areas will need to be approved by airport
administration. Due to limited space and airfield proximity, the contractor selected should
assume that these areas may be remote to the actual construction site.
Management
Security badges may be required for many hotel employees and Hotel management must
be willing to remain flexible and implement necessary changes 24 hours per day.
Airport administration may impose restrictions for equipment installed on the roof of the
facility. Hotel management must obtain permission prior to installation of same.
Access to the roof will be restricted to properly badged personnel and hotel management
must ensure proper procedures are followed for this type of access. More specific
information will be provided to management.
During elevated US Homeland Security threat levels, requirements for facilities located
in close proximity to aircraft operations will be modified. Management will be required
to comply with whatever changes are imposed or risk substantial monetary penalties. The
airport will commit to working closely with management to minimize impacts while still
maintaining the highest level of airport security for the traveling public.
Inspections of the fire suppression and detection systems will be required to be inspected
routinely and record of same forwarded to airport administration. Inspections of certain
components of the systems may be required to be inspected more frequently than code
requires.
