DeSantis Deputy Clerk At the August 15,2007 BOCC Meeting, the Board granted approval and authorized execution of an Interagency Agreement between Monroe County and the State of Florida, Department of Juvenile Justice (DJJ) regarding the confidentiality of information concerning juveniles sent to each county quarterly as outlined in Rule 63G-l Detention Cost Sharing. The Agreement will also assist the DJJ to establish an identical effective agreement date for all 67 counties, Attached hereto is a duplicate original of the subject document for your handling. Thanks. cc: County Attorney File INTERAGENCY AGREEMENT THIS AGREEMENT is entered into by and between the DEPARTMENT OF JUVENILE JUSTICE ("Department") and MONROE COUNTY ("County"). WITNESSETH: WHEREAS, the 2004 Legislature enacted section 985.2155, Florida Statues (recently renumbered to 985.686), requiring that costs of juvenile detention prior to disposition be a joint obligation of the State and the County; and WHEI~EAS, the Department requires that information concerning juveniles remain confidential; NOW, THEREFORE in consideration of the following agreement, the parties do hereby covenant and agree to the foliowing: 1. The Department agrees to share juvenile information, including, but not limited to, the juveniles, name, home address, and the name and address of the juveniles' parent or guardian, with the County for purposes of determining and verifying a juvenile's county of residency. 2. The County agrees to maintain the confidentiality of any and all juvenile information it receives from the Department and to ensure that the confidential nature of this information is maintained with respect to any records and reports created or disseminated. The County also agrees that the information will be used only for the purpose for which it was provided. Modification of this agreement shall be made only by the consent of both parties and shall include a written document setting forth the modifications and signed by both parties. This agreement may be terminated with 30 days written notice to the other party. I , ' \l)f" _!)W'Jnn-d July 6, 2007 Dear Ms. Boan: Back in February 2006, the Department mailed an interagency agreement form to each county regarding the confidentiality of information concerning juveniles sent to each county quarterly as outlined in Rule 63G-I Detention Cost Sharing. At the time the agreement was written, the date of execution and the effective time period were left blank and counties completed them as they felt appropriate. Unfortunately that has created a rather inconsistent set of documents that are not easily manageable as it relates to renewals etc. Enclosed you will find a new and revised interagency agreement that has been modified to improve the effective date and period sections. The effective date blanks previously at the top of the agreement have been removed. In addition, the option for specifying an effective period has been eliminated. These options have been replaced with language in the next to the last paragraph as follows: ''This agreement shall become effective upon execution by both parties and shall remain in effect for as 'long as statute requires detention cost sharing, unless otherwise modified." Once the agreement is signed by the Department it will be considered effective and a completed copy will be returned to the county. The change to eliminate the ability to select an effective period makes the effective period for all sixty seven county agreements identical. By making the agreement in effect for as long as the detention cost sharing statute is in effect, eliminates the need for renewing the agreement at some set annual period.
