MEMORANDUM OF UNDERSTANDING
AGREEMENT BETWEEN THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS
(MCBOCC) AND THE SIXTEENTH JUDICIAL CIRCUIT OF FLORIDA (LLSJC)TO
PROVIDE PHYSICAL SPACE FOR THE HOUSING OF THE MABATHON CPURT~OUSE

This is a memorandum of understanding in which th~~on~ c~nty

space in the Marathon Public Library to accommoda;e; th~cur['ent
and future Law Library materials collection cur~nflY Lecat4d in
the Marathon Courthouse. The purpose of this memo~andu~of C~
understanding is to provide conditions whereby theLaw(Libr~y
materials, located in the Marathon Courthouse, are mor~rea'dily
and generally accessible to legal professionals and the public at
large. The general terms described below will form the basis for

will annually review and evaluate the conditions of this

i.ELIGIBLE USERS: This law materials collection will be generally
available and accessible to all of the citizens of Monroe
County.
2.LIBRARY RESOURCE~: The Sixteenth Judicial Circuit of Florida
will provide, at no cost to the Monroe County Board of County
Commissioners, all of the furniture (shelving), equipment
(computer), and book and nonbook materials, (including software
and discware), relative to its Marathon sited law library
to establish a publicly accessible law library in the Marathon
Public Library. In addition, the LLSJC will provide for all
material updates regardless of format at no cost to the MCBOCC
library facility located in Marathon, Florida. The MCBOCC, in
turn, agrees to provide sufficient floor space in the
Marathon Public Library to accommodate the law library
collection within reasonable limits. Reasonable limits is
defined as follows:
1. Floor space sufficient to house no more
than five hundred (500) bound book volumes.
2. Floor space sufficient to house one (1)
networkable computer with a cd-rom drive and
required software and discware.
3.STAFF TRAIN~NG REQUIREMENTS: The MCBOCC agrees to provide
library personnel to maintain and keep current the law library
collection housed in the Marathon Public Library. The SJCF
agrees to provide the initial training in the maintenance and
update requirements of the law library collection.
4.STAFFING REQUIREMENTS: The Marathon Public Library staff
provides only basic reference support relative to patron/user
inquiries; for example, the location of the collection in
general, a listing of the law collection materials, explanation
of the shelf order, etc. No specific legal questions will be
answered nor opinions given with regard to patron/user
inquiries.
5.COLLECTION CLASSIFICATION AND PROCESSING: The MCBOCC will
accept existing shelflists (inventory), classification and
cataloging from SJCF for those materials which will
constitute the initial law library collection to be placed in
the Marathon Public Library. MCBOCC agrees to provide for the
cataloging, classifying and processing of these materials, in
keeping with current MCBOCC approved library policies,
procedures and accepted practices, when in a reasonable time
period. After the commencement of this agreement and the
physical establishment of the law library collection onsite at
the Marathon Public Library, MCBOCC agrees to catalog, classify
and process all newly acquired materials that are assigned to
this collection by SJCF, in keeping with MCBOCC approved
policies, procedures and accepted practices. The above services
will be provided at no cost to SJCF.
6.MATERIALS USE RESTRICTIONS: MCBOCC will impose no restriction
on the user of the law library collection housed in the
Marathon Public Library other than those currently established
for general public use of the libraries resources by the Monroe
County Board of County Commissioners and the procedures and
rules covering library defined reference materials. SJCF agrees
to the existing policy and procedural rules and whatever MCBOCC
rules that may be adopted in the future.
7.ADMINISTRATION: Representatives of the Monroe County Boeard of
County Commissioners and the Sixteenth Judicial Circuit of
Florida will hold regularly scheduled discussions, regarding
the operation of the agreement and its purposes, policy and
procedural matters, and any other issues relevant to the law
library collection and the public. The representatives will
routinely inform their administrations as to the progress and
needs of the law library service, such as significant policy or
procedural changes in collection requirements, staffing, and
other related issues.
8.LOST OR DAMAGED MATERIALS: The cost to replace lost or damaged
law library collection materials will be negotiated between the
parties on a case by case basis.
9.HOURS OF ACCESSIBILITY: The MCBOCC agrees to provide for full
access to the law library collection, located in the
Marathon Public Library during the library's normal operating
schedules, which are as follows:
a.Monday and Wednesday
b.Tuesday, Thursday,
lO:OOam to 8:00pm
Friday and Saturday
c.Sunday
10:00am to 6:00pm

IO.TERMINATION: This agreement is subject to termination at the
decision of the highest administrative authority of either
party. A decision to terminate the agreement will require a
minimum of sixty (60) days notification, in writing, by the
party initiating termination to the other party.
II. COLLECTION RELOCATION: Should there be a decision to
terminate this agreement, all law library collection
materials, furniture and equipment will return to the
of the Sixteenth Judicial Circuit of Florida. The
conditions of the relocation will be negotiated at the
time of notification of termination of this agreement.
