AGENDA ITEM WORDING: Resolution by BOCC to certify that Habitat of
Humanity of the Upper Keys, Inc., complies with County rules and ;regulations. This
Resolution will enable Habitat for Humanity of the Upper Keys, Inc., to apply for
participation in the State of Florida's Community Improvement Act of 1980.
ITEM BACKGROUND: Florida Statute 220.183, known as the Community
Improvement Act of 1980, allows various organizations, if qualified, to apply for certain
tax credits. One of the items required for the application is a resolution from local
government stating that the organization complies with the rules and regulations of the
local government. Both Habitat for Humanity of the of Key West and Lower Florida
Keys, Inc, and Habitat of Humanity of Marathon, Inc,. have asked for and have received
similar resolutions.
PREVIOUS RELEVANT BOCC ACTION: Resolution 155-2001 and Resolution 474-
2001 relating to Habitat for Humanity of Key West and the Lower Florida Keys, Inc, and
Habitat of Humanity of Marathon, Inc., received similar resolutions in 2001.

WIREREAS, in order to qualify for the benefits of the State of Florida's Community
Improvement Act of 1980 Habitat For Humanity of the Upper Keys, Inc. must
comply with local plans and regulations; and
I2E, AS, Habitat for Humanity of the Upper Keys, Inc. is a specific program
designated to offer home ownership to low-income residents in an effort to avoid
further decline in affordable housing; and
WHEREAS, the Community Improvement Act of 1980, Florida Statute 220.183(3)
requires a resolution from the local government unit in which the applicant is located
certifying that the project is consistent with local plans and regulations: and
{ REAS, it is in the public interest of the citizens of Monroe County that
Habitat for Humanity of the Upper Keys, Inc. continues to provide low income
housing for eligible residents; now therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
SECTION 1. Habitat for Humanity of the Upper Keys, Inc. complies with
all local plans and regulations for the improvement of the eligible areas, as
designated by the Board of County Commissioners of Monroe County, Florida.
SECTION 2. This Resolution shall be forwarded to the State of Florida,
Department of Community Affairs, to enable Habitat for Humanity of the Upper
Keys, Inc. to participate in the State of Florida's Community Improvement Act of
1980.

SECTION 3. This Resolution shall take effect upon its passage and
publication as required by law.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe
County, Florida, at a regular meeting of said Board held on the day of March,
2008.
