Ordinance 004-1978 ORDINANCE NO. 4 - 1978 AN ORDINANCE RELATING TO MONROE COUNTY, FLORIDA AMENDING THE COMPREHENSIVE ZONING ORDINANCE THEREOF BY AMENDING MONROE COUNTY ORDINANCE NUMBERS: 1-1973, 6-1973, 5-1974, 20-1975, and 3-1977. BY AMENDING ARTICLE XLV THEREOF TO PROVIDE THAT LAND USE RESTRICTIONS OF THAT AREA OF MONROE COUNTY ADJACENT TO AND OUTSIDE THE BOUNDARIES OF THE NAVAL AIR STATION, BOCA CHICA SHALL BE DETERMINED BY THE MAP PRE- PARED BY THE U.S. NAVY KNOWN AS FIGURE C; ADOPTING SAID MAP AS PARAGRAPH 4.2.2 OF SECTION 4 OF ARTICLE XIV OF SAID ORDINANCE AND INCORPORATING SAID MAP TO BECOME A PART OF THE ZONING ORDINANCE; ADOPTING THE LAND USE OBJECTIVES MATRIX KNOWN AS FIGURE D AS PARAGRAPH 4.2.3 OF SECTION 4 OF ARTICLE XIV; BY AMENDING SECTION 5 OF ARTICLE XIV RELATING TO THE GRANTING OF VARIANCES TO PERMIT PLACE- MENT OF THE BUILDINGS AND TRAILERS IN THE AREA SHOWN ON THE FIGURE C MAP AND FIGURE D LAND USE MATRIX TO PROVIDE FOR PROCESSING OF VARIANCE DIRECTLY THROUGH THE BOARD OF COUNTY COMMISSIONERS UPON RECOMMENDATION OF THE ZONING DIRECTOR AND TO PROVIDE WAIVER OF APPLICATION FEE AND TO SET FORTH THE GUIDE- LINES TO BE USED IN DETERMINING WHETHER OR NOT SAID VARIANCE SHALL BE GRANTED AND RE- QUIRING SUCCESSFUL APPLICANTS IN CNR-3 ZONES TO USE NOISE ATTENUATING CONSTRUCTION MATERIALS AND REQUIRING SAID PERSONS TO PLACE IN THEIR DEED OR LEASE NOTICE THAT SAID PROPERTY IS LOCATED IN A CNR-3 (HIGH NOISE IMPACT ZONE); PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. That the following paragraphs, sections and articles of Monroe county Ordinance No. 1-1973, as amended, are hereby amended, deleted or added to as hereinafter set forth in the attached document pages 1-7. Section 2. Airport Zones and Land Use Restrictions. Amend to read: Section 4. CIVIL and MILITARY AIRPORT ZONES AND LAND USE RESTRICTIONS RELATING THERETO. ARTICLE XIV - Section 4, paragraph 4.1, page 14-5 now reads: "4.1 Public Civil Airport Land Use Restrictions _ Overlay Zones are hereby created and established conforming to the boundaries of the zones as defined in Section 3 of this Article and within which the following restrictions on the uses permitted by underlying districts shall apply. Amend to read: 4.1 Civil Airport Land Use Restrictions - Within the boundaries of the airport height zones set forth in Section 3 of this Article for the Key West International, Marathon Flight Strip and the Port Largo Airports, the following restrictions on uses shall apply: ARTICLE XIV - Section 4, Paragraph 4.2, page 14-5 now reads: 4.2 NAS Key West Land Use Restrictions - The AICUZ area of that portion of the County adjacent to and outside the boundaries of the NAS Key West airfield is determined from airport operation data and depicted on a map showing a combination of Composite Noise Rating (CNR) zones or other equivalent noise measurement areas and Accident Potential Zones (APZ's). The AICUZ area map prepared and furnished to the Zoning Official by the U.S. Navy shall define an overlay district in which the land use regulations provided in this section for AICUZ zones shall apply. Amend to read: 4.2 MILITARY AIRPORT ZONE LAND USE RESTRICTIONS. Privately owned property adjacent to the Naval Air Station, Boca Chica, also known as NAS, KEY WEST, shall be developed in accordance with the map prepared by the U.S. Navy known as Figure C. Said map was prepared Lf-1 -2- in conjunction with the United States Navy's Air Installation Compatible Use Zone Study (AICUZ). A true copy of said Figure C is attached hereto and made a part of this Ordinance as paragraph 4.2.2 of this section. ARTICLE XIV - Section 4 New paragraph 4.2.0 added to read: 4.2.0 The land use objectives set forth in Figure C and the accompanying Land Use Objectives Matrix set forth the Figure D was determined by evaluating the airport operations at NAS, Key West in terms of composite noise rating (CNR) zones and accident potential zones (APZ's). A copy of said Figure D is attached hereto and made a part of this Ordinance as paragraph 4.2.3 of this section. ARTICLE XIV - Section 4, paragraph 4.2.1 now reads: "4.2.1 The Land Use Objectives shown in Figure C shall be used in determining the allowable land uses for the various AICUZ Zones. Each Land Use Category was evaluated in terms of compatibility within the various AICUZ Zones. Compatibility for each land use was judged in terms of density of population, density of structures, explosion hazards, air pollution, height obstructions, accident potential zones, and composite noise rating zones. The evaluation resulted in ratings of: (1) no new development, (2) restricted new development, and (3) no restrictions. Land Use Categoires were rated as restricted new develop- ments if any activity or activities within the category were classified as incompatible. However, because not all activities within a particular category are incompatible, footnotes to Figure C are added to explain areas of concern which should be considered in evaluating a particular land use. Variances Appeals and variances of the provisions of this Article shall be in accordance with the provisions of Article V, Sections 5 and 6 of this Ordinance. No application for variance to the requirements of this Article may be considered by the Board of Adjustment unless a copy of the application has been furnished to the Florida Department of Trans- portation, Bureau of Aviation. Amend to read as follows: Section 5. Variances. Appeals and/or requests for variances from the provisions of Article XIV shall be conducted by the County Commission in accordance with Article IV of this Ordinance. The~ CommissionB~all be guided by the standards for Approval set forth in section 4 of Article IV and the standards set forth in paragraphs 6.4.1 through 6.4.4 of section 6 of Article V. In addition, theO:>untyu,umisSon shall grant no variance from Article XIV which would constitute an Airport Hazard under the provisions of Section 57 of Article VII or be prohibited under Chapter 333, Florida Statutes. Each request for variance shall be judged with consideration of the relationship of the proposed variance to the purposes and goals of the Air Installation Compatible Use Zone Study for the United States Naval Air Station at Boca Chica and the Comprehensive Land Use Plan for the County. No application for a variance to the requirements of Article XIV may be considered by the fumtyO::mmission unless a copy of the application has been furnished to the Florida Department of Transportation, Bureau of Aviation and to the Commanding Officer of the U.S. Naval Air Station, Boca Chica. In all cases where a variance for residential or other use in an area designated as a Composite Noise Rating CNR-2 or CNR-3 the variance shall be contingent upon the applicant using noise attenuating S3 -7- construction materials in the construction of said building as deemed appropriate by the County Building Official. There shall be no application fee charged for the processing of variances under this section. Upon receipt of the application the Zoning Director shall, in addition to forwarding a copy of same to the Bureau of Aviation and the Commanding Officer of the U.S. Naval Air Station,shall also make a recommendation to the Board of County Commissioners in writing as to the appropriateness of the granting of said variance under the criteria set forth in this section. s~ tj. / 'f?
