ORDINANCE NO. 8-1978
AN ORDINANCE PROVIDING FOR REGISTRATION AND FIN-
GERPRINTING OF CERTAIN PERSONS EMPLOYED IN NIGHT
CLUBS, OR ANY PLACE OF AMUSEMENT, MOTELS, HOTELS,
ROOMING HOUSES, APARTMENT HOUSES, AND RESTAURANTS
IN THE UNINCORPORATED AREAS OF MONROE COUNTY,
FLORIDA; PROVIDING FOR EXCEPTIONS; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH
THE PROVISIONS OF THIS ORDINANCE, TO THE EXTENT OF
SUCH CONFLICT; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, deems it advisable that rules and regulations providing
for the registration and fingerprinting of certain persons em-
ployed in night clubs, or any place of amusement, motels, hotels,
rooming houses, apartment houses, and restaurants in the unincor-
porated areas of Monroe County, Florida, be adopted,
NOW, THEREFORE, BE IT RESOLVED, that in order to promote
the public health, safety and welfare of the citizens of Monroe
County, Florida, the following Ordinance is hereby enacted:
Section 1.
Registration, Fingerprinting, Registration
Fee, Required of Certain Workers.
(1) Every person employed in any night club, any place
handling liquor, beer or wine in any form, places of amusement,
motels, hotels, rooming houses, apartment houses, and restaurants
in the unincorporated areas of Monroe County, Florida, are hereby
required to register within forty-eight hours from the time of
their employment, in a book of registration to be kept by the
Sheriff of Monroe County and also be fingerprinted and photographed.
It shall be unlawful for any employer to allow any of such persons
to remain in such employment longer than forty-eight hours, unless
within such forty-eight hour period such person shall have regis-
tered and shall have been fingerprinted and photographed as here-
inbefore required. Every person shall pay directly to said Sheriff

of Monroe County such fee as is customarily charged for finger-
printing and photographing by the Sheriff of Monroe County.
(2) Identification cards shall be issued to each person
registering under the preceding section which identification card
shall be valid for a period of twenty-four months; provided, how-
ever, that the holder thereof shall personally present the same
at the Monroe County Sheriff's Office for revalidation at the con-
clusion of the first twelve months of such period.
(3) The sum of Three Dollars ($3.00) shall be paid for
each such identification card or renewal thereof. Said sum is
designated as a fee for services to the Sheriff as provided by
Florida Statutes Chapter 30.51.
Section 2. Exception~. The following persons shall be
exempt from the provisions of this ordinance:
(1) All minors under age 18 whose parents or guardians
live in the City of Key West or County of Monroe and are register-
ed voters.
(2) All musicians who are members of the Key West Local
Federation of Musicians.
(3) Any person who has been a registered voter of either
the City of Key West or the County of Monroe for more than 2 years.
Section 3. All ordinances or parts of ordinances, resolu-
tions or parts of resolutions, rules and regulations in conflict
with the provisions of this Ordinance, are hereby repealed to the
extent of such conflict.
Section 4. If any section, sub-section, sentence, clause
or phrase of this Ordinance is, for any reason, held to be invalid,
such decision shall not affect the validity of the remaining por-
tions of this Ordinance. The County Commission hereby declares
that it would have passed this Ordinance irrespective of the fact
that anyone or more sub-sections, sentences, clauses or phrases
be declared invalid.

This Ordinance shall take effect October 1,
1978.
