AN ORDINANCE RELATING TO MONROE COUNTY, FLORIDA;
CONTROLLING THE SPEED LIMIT AT WHICH WATERCRAFT
OR VESSELS CAN BE OPERATED UPON THE WATERWAYS OR
CANALS WITHIN MONROE COUNTY BY DESIGNATING BY
SIGNS AUTHORIZED BY RESOLUTION OF THE BOARD OF
COUNTY COMMISSIONERS; PROVIDING FOR PENALTIES;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 125 and Chapter 371.59, Florida Statutes,
empowers counties to regulate the operation and conduct of all
watercraft or vessels of any kind plying or using the waterways
within the County, and
IVHEREAS, the regulating of the speed of watercraft within
the waterways of the County is required to protect the health,
safety and welfare of its residents, and
WHEREAS, it is not practical to designate at one time all
such waterways in which the speed of watercraft should be regula-
ted, and
WHEREAS, a reasonable means must be created to provide a
flexible procedure for the Board of County Commissioners to regu-
late watercraft or vessels within its jurisdiction, now, therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
It shall be unlawful and punishable as pro-
vided in Section 125.69, Florida Statutes, for any person to
operate a watercraft or vessel upon the waterways or canals of
Monroe County in excess of the speed limit as designated by an
official sign or signs approved and placed by resolution of the
Board of County Commissioners.
Section 2.
The Board of County Commissioners may by
resolution designate speed zones on waterways or canals found to
be particularly congested or in which the speed of traffic should
be controlled. The Board of County Commissioners shall direct
the placing of an official sign or signs notifying the public of

any waterway or canal designated by resolution as a speed zone,
setting forth thereon the maximum speed which a watercraft or
vessel can be operated. The Sheriff and his deputies, the Florida
Marine Patrol, and officers of the Department of Public Safety
are authorized and empowered to arrest any person operating a
watercraft or vessel in excess of the speed limit posted.
Section 3.
This Ordinance shall take effect upon re-
ceipt of the official acknowledgment from the office of the
Department of State acknowledging receipt of certified copy of
this Ordinance and that said Ordinance has been filed in said
office.

NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on
Tuesday, September 26, 1978, at 1:00 P.M. at the Monroe County
Sub-Courthouse, Plantation Key, Monroe County, Florida, and on
Tuesday, October 3, 1978, at 1:00 P.M. at the Monroe County
Courthouse Annex, 500 Hhitehead Street, Key West, Monroe County,
Florida, the Board of County Commissioners of Monroe ~ounty,
Florida, intends to consider the adoption of the following County
Ordinance:
