AN ORDINANCE RELATING TO MONROE COUNTY, FLORIDA;
PROHIBITING STOPPING, STANDING, OR PARKING OF
VEHICLES IN AREAS DESIGNATED BY SIGNS AUTHORIZED
BY RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS; PROVIDING FOR PENALTIES; PROVIDING FOR
TOWING AWAY AND SALE OF OFFENDING VEHICLES; PRO-
VIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 316, Florida Statutes empowers counties
to regulate or prohibit stopping, standing, or parking of vehicles
within their jurisdiction, and
WHEREAS, stopping, standing, or parking of motor vehicles
from time to time impede traffic or congest certain areas, and
WHEREAS, it is not practical to designate at one time all
such areas congested by or in which traffic is impeded by the
stopping, s tanding or parking of vehicles, and
WHEREAS, a reasonable means must be created to provide
a flexible procedure for the Board of County Commissioners to
regulate or prohibit stopping, standing, or parking of vehicles
within its jurisdiction, and
WHEREAS, the towing away and sale of vehicles is a proce-
dure authorized by Section 85.031 (3), Florida Statutes, NOW,
THEREFORE ,
BE IT ORDAINED BY THE BOARD OF COUNTY COW1ISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
It shall be unlawful and punishable as pro-
vided in Section 316.026, Florida Statutes, for any person to
stop, stand, or park a vehicle, as defined in Section 316.003 (64),
Florida Statutes, upon or alongside any street or highway desig-
nated by an official sign or signs approved and placed by resolu-
tion of the Board of County Commissioners as a street or highway
where stopping, standing or parking is regulated or prohibited.
Section 2.
The Board of County Commissioners may by
resolution designate as tow-away zones certain areas found to be
particularly congested or in which traffic is impeded by the
stopping, standing or parking of vehicles. The Board of County

BOOK
Commissioners shall direct the placing of an official sign or
signs notifying the public of any area designated by resolution
as a tow-away zone. The Sheriff and his deputies, solid waste
officers, and the Director of the Planning and Zoning Department are
authorized and directed to direct the towing away of any vehicle
parked in a tow-away zone. The owner of such a towed away vehicle
may recover possession of the vehicle by paying to the authorized
towing and storage agent the sum of twenty-five (25) dollars plus
two (2) dollars for each day after the first day for storage of
the vehicle. After forty-five (45) days, the authorized towing
or storage agent may sell any vehicle which was towed away at the
direction of the Sheriff or any of his deputies and which remains
unclaimed or for which the aforesaid towing and storage charges
remain unpaid, in accordance with the provisions of Section
85.031(3), Florida Statutes.
Section 3.
This Ordinance shall take effect upon re-
ceipt of the official acknowledgment from the office of the
Department of State acknowledging receipt of certified copy of
this Ordinance and that said Ordinance has been filed in said
office.

NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on
Tuesday, January 16, 1979, at 2:00 P.M. at the Monroe County
Courthouse Annex, Courtroom B, Key West, Florida, and on Tuesday,
January 30, 1979, at 2:00 P.M. at the Monroe County Sub-
courthouse, Plantation Key, Monroe County, Florida, the Board of
