AN ORDINANCE AMENDING MONROE COUNTY ORDINANCE NO.
2-1979, THE SAME BEING AN ORDINANCE ENTITLED "AN
ORDINANCE RELATING TO MONROE COUNTY, FLORIDA; PRO-
HIBITING STOPPING, STANDING, OR PARKING OF VEHICLES
IN AREAS DESIGNATED BY SIGNS AUTHORIZED BY RESOLU-
TION OF THE BOARD OF COUNTY COMMISSIONERS; PROVIDING
FOR PENALTIES; PROVIDING FOR TOWING AWAY AND SALE
OF OFFENDING VEHICLES; PROVIDING FOR AN EFFECTIVE
DATE." BY AMENDING SECTION 1 OF ORDINANCE NO.
2..1979 TO CORRECT THE REFERENCED FLORIDA STATUTE
CHAPTER 316.026 TO REFLECT THE RENUMBERING THEREOF
I,TO FLORIDA STATUTE CHAPTER 316.655; AND TO AMEND
DEFINITION OF VEHICLES: PROVIDING FOR SEVERABILITY
FOR INVALID PORTIONS; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the health, safety and welfare of the citizens
of Monroe County requires that the enforcement of Ordinance
No. 2-1979 be accomplished in order to eliminate traffic
hazards in certain areas, and
WHEREAS, the immediate enactment of this ordinance is
necessary in order to provide for immediate enforcement of
said Ordinance No. 2-1979, NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
I. That the notice requirement required by Florida
Statutes is hereby waived.
2. That Section 1 of Monroe County Ordinance No. 2-
1979 be, and the same is hereby amended to read as follows:
"Section 1. It shall be unlawful and punishable
as provided in Section 316.655, Florida Statutes,
for any person to stop, stand, or park a vehicle,
bicycle, or moped as defined in Chapter 316,
Florida Statutes, upon or alongside any street
or highway designated by an official sign or
signs approved and placed by resolution of the
Board of County Commissioners as a street or
highway where stopping,standing or parking is
regulated or prohibited."
3. If any section, subsection, paragraph, clause,
sentence, phrase, or portion of this ordinance is for any
reason found invalid, unlawful, or unconstitutional by any
court of competent jurisdiction, such portion shall be

deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining
portions thereof. All ordinance or parts of ordinances, or
special/legal acts in conflict herewith be and the same are
hereby repealed with the effective date of this ordinance.
4. It is the intention of the Board of County Commis-
sioners that the provisions of this ordinance shall become
and be made a part of the Monroe County Code and the word
"ordinance" may be changed to "section", "article" or
other appropriate word or phrase and the sections of this
ordinance may be renumbered or relettered to accomplish such
intention; providing, however, that paragraphs 3, 4 and 5
shall not be codified.
s. This ordinance shall take effect upon receipt of
official acknowledgment by the Clerk of the Board of County
Commissioners from the Department of State that this ordinance
has been filed with the Department of State.
Passed and adopted by unanimous vote of the Board of
County Commissioners of Monroe County, Florida, this 5
