ORDINANCE NO. 12 -1980
AN ORDINANCE OF THE COUNTY OF MONROE, FLORIDA,
PROVIDING THAT THE CODE OF ORDINANCES, COUNTY
OF MONROE, FLORIDA, BE AMENDED BY REVISING
SECTION 11-2(b) OF SAID CODE; PROVIDING FOR
A FEE OF UP TO FIFTY DOLLARS ($50.00) FOR
THE TOWING OF A VEHICLE PARKED IN A TOW-AWAY
ZONE; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
That Section 11-2(b) of the Code of Ordi-
nances of the County of Monroe, Florida, be amended so that
such section shall read as follows:
"Section 2(b) Tow-away zones authorized; reclaim-
ing of towed-away vehicles.
The board of county commissioners may by reso-
lution designate as tow-away zones certain areas
found to be particularly congested or in which
traffic 1S impeded by the stopping, standing or
parking of vehicles. The board of county commis-
sioners shall direct the placing of an official
sign or signs notifying the public of any area
designated by resolution as a tow-away zone.
The sheriff and his deputies, solid waste officers,
and the director of the planning and zoning de-
partment or his designees are authorized and
directed to direct the towing away of any vehicle
parked in a tow-away zone. The owner of such a
towed-away vehicle may recover possession of the
vehicle by paying to the authorized towing and
storage agent a sum not to exceed fifty dollars
($50.00) plus two dollars ($2.00) for each day
after the first day for storage of the vehicle.
After forty-five (45) days, the authorized towing
or storage agent may sell any vehicle which was
towed away at the direction of the sheriff or

any of his deputies and which remains unclaimed
or for which the aforesaid towing and storage
charges remain unpaid, in accordance with the
provisions of Section 85.031(3), Florida Statues."
Section 2.
That all ordinances or parts of ordinances
ln conflict with this ordinance are hereby repealed.
Section 3.
This ordinance shall take effect upon
receipt of the official acknowledgment from the Department
of State acknowledging receipt of certified copy of this
ordinance and that said ordinance has been filed in said
office.

Florida, the Board of County Commissioners of Monroe County,
Florida, intends to consider the adoption of the following
