At the December 13,2000, Board of County Commissioners meeting the Board granted
approval of a Lease Purchase Agreement between the Lower and Middle Keys Fire and
Ambulance District Board of Governors of Monroe County and Banc One in the total amount of
$923,054 to purchase three fire trucks through the "piggybacking" bid of Lake County, Florida,
District 6 portion $625,985 for two trucks. Copy enclosed for your handling.
At the January 17, 2001, meeting the Board adopted Resolution 002-2001 authorizing
Monroe County to enter into equipment (fire truck) leases and granted approval and authorized
/execution ofa Contract between Monroe County and Pierce Manufacturing Inc., in support of the
Lease Purchase Agreement with Banc One Leasing Corporation (which was approved at the
December 13,2000 meeting). Copy of subject Resolution and a duplicate original of the Contract
for your handling.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNlY, FLORIDA AUTHORIZING MONROE COUNTY TO ENTER INTO
EQUIPMENT (FIRE TRUCK) LEASES. . ,
WHEREAS, the principal amount expected to be financed is $923,054,00;
WHEREAS, Monroe County is a political subdivision of the State of Florida and is duly
organized and existing pursuant to the Constitution and laws of the State of Florida;
WHEREAS, pursuant to applicable law, the Monroe County Board of County Commissioners
(BOCC) is authorized to acquire, dispose of and encumber real and personal property, including,
without limitation, rights and interest in property, leases and easements necessary to the functions
or operations of Monroe County,

WHEREAS, the BOCC hereby finds and determines that the execution of one or more
lease-purchase agreements ("Equipment Leases") in the principal amount not exceeding the amount
stated above for the purpose of acquiring the property ("Equipment") to be described in the
Equipment Leases is appropriate and necessary to the functions and operations of Monroe County.
WHEREAS, Banc One Leasing Corporation ("Lessor") shall act as Lessor under said
Equipment Leases; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA:
Section 1. The Mayor of Monroe County, acting on behalf of Monroe County, is hereby
authorized to negotiate, enter ,into, execute, and deliver one or more Equipment Leases in
substantially the form set forth in the document presently before the BOCC, which document is
available for public inspection at the office of the County Administrator. The Mayor, acting on
behalf of Monroe County, is hereby authorized to negotiate, enter into, execute, and deliver such
other documents relating to the Equipment Lease as the Authorized Representative deems
necessary and appropriate. All other related contracts and agreements necessary and incidental to
the Equipment Lease are hereby authorized.
Section 2. By a written instrument signed by the Mayor, said Mayor may designate
specifically identified officers or employees of the County to execute and deliver agreements and
documents relating to the Equipment Lease on behalf of the County.
Section 3, The aggregate original principal amount of the Equipment Leases shall not
exceed the amount stated above and shall bear interest as set forth in the Equipment Leases and
the Equipment Leases shall contain such options to purchase by the County as set forth therein.
Section 4. Monroe County's obligations under the Equipment Leases shall be subject to
annual appropriation or renewal by the BOCC as set forth in each Equipment Lease and Monroe
County's obligations under the Equipment Leases shall not constitute a general obligation of Monroe
County or indebtedness under the Constitution or laws of the State of Florida,
Section 5. As to each Equipment Lease, Monroe County reasonably anticipates to issue
not more than $10,000,000 of tax-exempt obligations (other than "private activity bonds" which
are not "qualified 501(c)(3) bonds") during the fiscal year in which each such Equipment Lease is
issued and hereby designates each Equipment Lease as a qualified tax-exempt obligation for
purposes of the Internal Revenue Code of 1988, as amended.

at a regular meeting of said Board held on the 17th day of January , 200 1

increased COSlll incurred by first party because of future changes in or additions to said DOT or NPPA srandard.. will be
passed along to the customer as an addition to the price set furth below.
Fourth. The said appaIllrus and equipment shall be ready for delivery from Appleton,
Wisconsin, within about 210-240 days after the reccipt and acceptance of this contract at
the first party's office at Appleton, Wisconsin, delays due to strikes, failures to obtain chassis, materials, or other causes
beyond its control not preventing. and shall be delivered to said party of
the second part at Monroe County, FL

second party and to give its employees the necessary instructions in the opeRtion and handling of said apparatus.
Sirth. The second party hereby purchases and agrees to pay for said apparatus and equipment, the sum

Net payment is due upon acceptance at Pierce Manufacturing Inc., Appleton, Wisconsin, unless otherwise speci1ied
herein. If deferred payment arraogemems are made, such arrangements shall be in writing. and second party's obligation

RE: Lake County Fire Apparatus Contract
Attached is the complete Lake County Contract No. 99-150 which permits Lake
County, FL to purchase various specified and unspecified apparatus per the pricing
structure bid on June 24, 1999. This contract is renewable for up to five (5) years.
See attached pages 1 of 9 for conditions attached. The formula is 4% over dealer
cost on the base vehicle and 10% on vehicle options and equipment per page 1 of the
Lake County Bid Sheet. This contract applies to the complete line of Pierce
apparatus. We are willing to extend the same terms and condition per Lake County
Bid 99-150
All handling, transportation, and delivery costs would be included in the base
vehicle cost from Pierce Manufacturing Inc.
We could also provide prices paid on similar units by other municipalities as
additional price justification. The following municipalities have accessed this
contract for various models of Pierce tire apparatus.
