ITEM BACKGROUND:
Monroe County entered into a Consulting Agreement with Commonwealth Consulting Corporation in
January of 1999 and an Extension Agreement in January of 2000 which provides that the Consultant
may perform tier one services on Growth Management issues. This Agreement provides for tier two
consulting services on Growth Management issues in the effort of obtaining Federal funds for
wastewater treatment facilities in the Florida Keys.

WASTEWATER CONSULTING AGREEMENT
This Agreement is entered into on this the . day of May, 2000, by and
between MONROE COUNTY (County), 0 political subdivision of the State of Florida, and
COMMONWEALTH CONSULTING CORPORATION (Consultant).
WHEREAS, the Agreement between the parties dated January 14. 1999, land
extended on January 19. 2000) provides that the Consultant may perform tier two services
only upon the parties I mutual agreement: and,
WHEREAS, the County desires that the Consultant perform tier two services to assist in
obtaining Federal funding for wastewater treatment facilities in the Florida Keys; now,
therefore:
In consideration of the mutual promises. covenants and benefits set forth below. the
parties agree as fOllows:
1. Pursuant to the Agreement between the parties dated January J 4, 1999, copy
of which is attached and incorporated into this Agreement, the Consultant sholl perform tier
two consulting services os a port of an effort to obtain Federal funds for wastewater
treatment facilities in the Florida Keys. The Consultant shall perform the wastewater
consulting services at the direction of the County Administrator.

EXTENSION OF CONSULTING AGREEMENT
This Extension Agreement is entered into by and between Monroe County, a political
subdivision of the State of Florida, and Commonwealth Consulting Corporation. The
parties agree as follows:
1) The Agreement between the parties for the term commencing on January 1,
1999 and ending on December 31, 1999, is hereby extended from January 1, 2000
through December 31. 2000. This extension is authorized by paragraph two of the original
Agreement dated January 14. 1999, which is attached hereto and incorporated into this
extension agreement.
2) On Growth Management issues. the compensation level will stay at Tier 1.
3) Except for the term extension and 2). above, all other respects of the January 14,
1999 Agreement remain in full force and effect.

CONSULTING AGREEMENT
This Agreement is entered into this ~ day of January, 1999, by and between
Monroe County (County), a political subdivision of the State of Florida, and
Commonwealth Consulting Corporation (Consultant). The parties agree as follows:
1. SCOPE OF CONTRACT: Consultant will assist County providing
government relations, planning and public relations support with respe t~m=e~
relating to the Department of Defense, including base, c;losure, base re-u@ d ~e:;;

In performing this Agreement. Consultant shall comply will all applicab~~. & ~

2. TERMS: This Agreement is intended to be for a period of one year,
commencing on January 1, 1999 and ending on December 31, 1999. At the end of this
period, County shall have the option to extend the Agreement, subject to a renegotiation
of terms. During the course of this Agreement, should either party seek to terminate this
Agreement, it shall so state, in writing. Termination shall be effective 60 days after receipt
of said written notice of termination.
3. FEES: As it is anticipated that the level of effort necessary to perform this
Agreement will vary depending on the County's requested services, a two-tiered fee
structure will apply. Progression from Tier. 1 to Tier 2 will occur only upon mutual
agreement of County and the Consultant:
Tier 1 - Preliminary efforts of the Consultant on behalf of County may require
only monitoring and liaison with the Executive and Legislative bra~ches of the
federal govemment. In return for the performance of Tier 1 services,' County
agrees to compensate Consultant $1,200 per month payable monthly in arrears.
Payment shall be made in U. S. dollars by check.
Tier 2 - However, it may be that a more vigorous and sustaijd ceffabo~

In addition to such fees, County shall reimburse the Consultant's expens~ tr~1 ~

Agreement. It is anticipated that Consultant will be required to travel to Monroe Cot5Mty
several times during the course of this Agreement. All travel must be approved by
County Administrator in advance.
Further, Consultant understands and agrees that if this Agreement should be terminated
for any reason, payment of all expenses and fees incurred to the termination date will be
made within 30 days of such termination.
4. MISCEUANEOUS PROVISIONS:
a) Governing Law: This Agreement shall be governed by the laws of the State
of Florida, both as to interpretation and performance. Venue for any litigation arising
under this Agreement must be in a court of competent jurisdiction located in Monroe
County, Florida.
b) Notice: All notices provided for herein ~tiall be sent by certified mail,
