Hanco~ Deputy Clerk Cy DATE: January 30, 2003 At the January 15 2003, Board of County Commissioner's meeting the Board granted approval and authorized execution of an Agreement Extension between Monroe County and Synagro Southeast, Inc. for the operation and maintenance of the Marathon Airport Terminal Sewage Treatment Plant, for a period of three years, effective December 1, 2002, at a cost of $6,555.78 for the first year and an adjustment annually in accordance with the percentage change in the Consumer Price Index. Enclosed are two duplicate originals of the above-mentioned for your handling. Should you have any questions please do not hesitate to contact this office. cc: County Administrator w/o document County Attorney Finance File J AGREEMENT EXTENSION Florida Keys Marathon Airport SYNAGRO SOUTHEAST, INC., THIS AGREEMENT EXTENSION is entered into this 15th day of January, 2003, by and between the BOARD OF COUNlY COMMISSIONERS OF MONROE COUNlY, FLORIDA, hereinafter referred to as .County," and SYNAGRO SOUTHEAST, INC., hereafter referred to as "PROVIDER." WHEREAS, on May 15, 2001, the County and Provider entered into an agreement for the operation and maintenance of the Marathon Airport Terminal Sewage Treatment Plant, hereafter the original agreement, a copy of which is attached to this extension and made a part of it; WHEREAS, paragraph two of the original agreement provides for options to extend (renew) the original agreement; WHEREAS, the parties desire to extend the original agreement; now, therefore, IN CONSIDERATION of the mutual covenants and promises contained herein, it is agreed as follows: 1. Paragraph 1 is hereby amended to read as follows: 1. AMOUNT OF A6REEMENT. The Board, in consideration of the Provider substantially and satisfactorily performing the scope of services under paragraph 4, shall pay to the Provider the sum of Six Thousand Five Hundred Fifty-five and 78/100 Dollars ($6,555.78) annually, and costs not to exceed $9,000 annually, for repairs and special tasks materials and chemicals of a non- recurring nature. The amount agreed to herein might be adjusted annually in accordance with the percentage change in the Consumer Price Index for all urban consumers (CPI- U) for the most recent 12 months available. 2. Paragraph 2 is hereby amended to read as follows: 2. TERM. This Agreement shall commence on December 1, 2002, and terminate September 30, 2005, unless earlier terminated pursuant to other provisions herein. Monroe County's performance and obligation to pay under this contract is contingent upon an annual appropriation by the BOCC. 3.
