Please find enclosed two (2) original documents of the Professional Services Contract between
Monroe County and you to provide legal services as Hearing Officer for vested rights and hearing
use hearings for the Planning Department. The Monroe County Board of County Commissioners
on October 19,2000 approved this Contract.
Please sign both documents and return them to my attention. I will send both copies to the Clerk
for the Mayor's signature on behalf of Monroe County and return a fully executed copy to you for
your records.

Subject: Interlocal agreement on code enforcement special master
Mr. Kolhage,
Richard wanted me to run this past you. If you can answer the questions
now, we can avoid a meeting on Weds. that Belle has scheduled for us on this
issue.
Background:
Both the County and the City of Key West use Jeff Overby as the Code
Enforcement Special Master. This creates a dual office holding problem.
However, the AG has opined that a City and a County may enter into an
interlocal agreement to share a special master. The City Attorey has
drafted a proposed interlocal agreement.
Since the Special Master holds three hearings per month for the City and
only 11 per year for the County, the City would be the lead jurisdiction in
hiring the Special Master. The County would, in essence, rent the master
from the City.
The City has proposed that we send our fee made payable to the City and it
will in turn send a check in that same amount to Overby. Another
possibility is that we send our check directly to Overby.
We would like your input on the proposed arrangement to see if you have any
concerns. Additionally, Richard believes that there may be some IRS
implications as far as withholding taxes if the yearly total exceeds a
certain amount. The County currently pays Overby $24,000.00
Please advise if you have any concerns or thoughts on this matter. If this
is too complex to resolve by email, I've marked down Weds. at 10 am to meet
with you.

Enforcement Special Magistrate if you chose to continue to work as an Assistant State Attorney.
You verbally advised me yesterday that you would continue to work in the State Attorney's Office.
