Funding. All services performed under this agreement"" ':-s;tall.-be(") rendered reimbursable to either party. ~ ~ ~ ~ . ....., 0 3. Manpower. No additional manpower is required to implement this agreement. 4. Administrative Terms. The residents of Monroe County, FL and personnel of NAS Key West share vulnerabilities that are common to all residents of Monroe County. It is in the interest of both parties to assist in time of crisis resulting from the threat, impact, and/or aftermath of a natural or manmade disaster. a. The following terms are mutually agreed upon by NAS Key West and Monroe County: (1) Reduce the potential and vulnerability for loss of life as a result of the threat and/or impact of a disaster, either natural or manmade. (2) Waive all claims against the other party for compensation of any loss, damage to property, personal injury or death occurring as a result of this agreement. (3) Aid and assistance is confined to that area of Monroe County extending from and including the City of Key West, to and including Cudjoe Key and all areas in between. (4) Rendering of assistance under this agreement shall not be mandatory, however the party receiving the request for assistance shall immediately inform the requesting service if service can not be provided. b. Commanding Officer, Naval Air Station Key West reserves the right to final determination in regard to compliance with Department of Defense instructions and directives. c. The Monroe County Board of County Commissioners recognizes that the Commanding Officer, Naval Air Station Key West, can offer no assistance until: (1) A physical threat to life and/or property exists and no alternate source of assistance, private or public, is available. (2) The Senior Official of Monroe County Emergency Management Division requests emergency assistance for Urban Search and Rescue, Hazardous Materials mitigation, and military support to include: (a) Exact mission to be assigned in accordance with the detailed plans and procedures. (b) Type and number of assets being requested, to include vehicles, equipment and personnel. (c) Use of facilities, airfield, or other base infrastructure. d. Effective date. This MOA shall become effective on the date of the last signature. e. Review. This MOA shall be reviewed annually by both parties to determine the need for continuation, modification, or termination. f. Termination. This MOA may be terminated at any time by mutual consent of both parties upon providing 90 days advance written notification. 5.
