Release of Retainage to D. L. Porter
Dear Jim:
This letter will confirm our telephone conference of this date concerning the final $80,000 payment
due D. L. Porter for work on the Gato Building. This amount is currently being withheld because of
issues related to windows, glass and glazing. As I stated, issues related to windows, glass and
glazing are warranty issues and retention of these funds is not appropriate. Both D. L. Porter and
Preservation Services have demonstrated that they will not walk away from these issues and will
continue to cooperate in resolving problems as they occur. If Preservation Services is not paid, they
will be forced to take legal action.
Based on the above, it is my strongest possible recommendation that these funds be released and
final payment in the amount of $80,000 be made to D. L. Porter.
I have attached correspondence related to window leaks. My November 9, 2001 letter
recommended monitoring window leaks to determine an appropriate course of action. Yesterday,
Dent Pierce forwarded a letter to me concerning leaks at various window locations. I spoke to
Andy Morrison concerning this issue. He agreed to inspect and seal windows as appropriate and
work with me to make recommendations for appropriate repairs. I would like to schedule that work
and confirm release of the final payment at the same time.

Constructors. Inc. bring closure to the above referenced project, with respect to our subcontract
agreement. I am unaware of any valid reason for the County at this point to hold funds against
our contract. With all the documentation~ tests and meetings that have been reviewed and I or
held. no one has justified to our company why we or our subcontractor are being held l.iable for
deficiencies related to any portion of our contract work.
At tbis time, I request a fannal .response stating the Owners position with regard to the balance
held of om contract,. to allow our finn the opportunity fo closeout our contract with P~ation
Services. Inc. I will give you 7 days to arrange for the document requested before actions on the
part of our company as well as our subcontractor will be taken.

Dear Stephanie:
Enclosed are letters from Andy Morrison and Gary Loer concerning leaks at the windows. Both
Gary and Andy feel that the leaks are occurring at the operable sashes. My independent
evaluation supports their opinion. Gary notes in his letter that Monroe County purchased these
windows and, therefore, Monroe County is responsible for sealing the sashes or contacting Bliss-
Cashier about this problem and/or warranty issues.
The decision to direct purchase these windows was made when Lodge terminated their contract
in order to maintain the project schedule. This item was part of Change Order No.1, executed
concurrently with the D.L. Porter contract. During this negotiation, Preservation Services and
D.L. Porter both agreed to give up their mark-up, support costs, profit and overhead related to the
windows. Monroe County agreed to provide warehousing of windows, miscellaneous support,
and accept responsibility for damage and/or problems with the windows. This issue falls under
that category.
Andy's letter states that sealant was left with John Kipp along with instructions for sealing the
window sashes. I recommend having John do this work.

As you know, MotU'oe CoWIty has advised both you and I of an ongoing problem related to water
pene1ranon through the facility!s exterior windo~. I have investigated the problem and have
asked our subcontractor to do so as well. I believe strongly that the problem is because the
frames are not desigi1ed to be sealed at the vent locations. Attached is a copY of a letter received
from Preservation Services, Inc. (PSI), which I ask that you review.
In reading the PSI letter it appears they believe as I have previously expressed. that we have no
wananty obligations with regard to the windows leaking at the vent locations. I ask that you
verify such and advise the County so they can a.ddress. the problem themselves before serious
damage is incurred. I mean no disrespect by bowing out of this situation, but if you VIill recall it
was the County who decided to purchase these window fratnes direct so as to avoid any chatges
on behalf of our cllmpany. Since it docs in fact appear to be a frame problem, then I believe it
should be the responsibility of th~ party who purchased th~ fiames, which is in this case the
"County!

Thank you for your letter of May 28, 2002. In February when we
last took care of a number of window leaks, the operable sections
(vents) were the problem. Apparently, the vents have gaskets
which do not seal well enough to keep the water out. At that

time, we left sealant and instructions with John Kipp; ~e'said he
would be happy to deal with any ongoing problems. Since that
time John has been told by County personnel not to take such
action because of warranty issues. 1 suggest you tell the County
that no warranty issue is involved and that John should be
permitted to use the sealant to stop the gasket leaks, as
necessary.

Gary Loer has declined to provide pricing on "permanently sealing" the courtyard windows due to
the current glass issues. I concur with his position.
My letter to Dent included options for sealing the historic windows. What did you ask Gary to
price? Also, it appears that these historic windows did not leak during the recent storm. I had
indicated to Dent that the historic courtyard windows would not have as much of a problem with
blowing rain as the exterior windows, and the overhang at the roofwill provide some protection.
I recommend doing no work at this time, monitor these windows during rain storms, and make a
decision based on that knowledge. Please ask Dent to consider this course of action.

1.0 EXECUTIVE SUMMARY
The engineering study performed on the Monroe County Gov't Center Annex has revealed that the
HV AC systems that exist in this building cannot provide pQsitive internal pressure as it relates to the
atmospheric pressure and cannot consistently provide adequate dehumidification.
The existing HVAC systems do not introduce the amount of outdoor air as prescribed by ASHRAE
standards.
The space around the existing air handling units does not allow for ease of maintenance.
The building has a vermin infestation and vermin feces exist above the ceiling spaces that also serve as
return air passageways_
The compressor - condensing unit serving the air handling system no. 4 is badly corroded and should be
replaced.
This report suggests and defines that a new outdoor pretreatment unit be installed on the roof to provide
positive pressure, adequate ventilation air, and constant dehumidification for the building.
2.0 PURPOSE OF THIS STUDY AND REPORT
The purpose of this study and report is to analyze the existing HV AC systems at the Monroe County Gov't
Center Annex, to point out existing problems, and to present recommendations that will remediate these
problems. Specific subjects considered were as follows:
1. Determine existing condition and future reliability of all HV AC systems, components, and
controls.
2. Determine existing HV AC systems ability to properly dehumidify air within facilities.
3. Determine HV AC compliance with ASHRAE standards for air parameters.
4. Determine appropriate balance of HV AC systems.
5. Determine root cause of negative pressure differentials within the facilities.
6. Determine and make recommendations to modify, repair, or replace HV AC systems and/or
components in order to obtain a fully operational HV AC system capable of maintaining appropriate
comfort levels within the facility for all building occupants.
3.0 DESCRIPTION OF THE BUILDING
The building known as the Monroe County Gov't Center Annex consists of a one story CBS structure
located at 490 63rd Street, Marathon, FI. Mile marker 48.5. This building houses Monroe County Gov't
offices. This property is located at approximately Latitude 24 degrees _ 5 minutes North and approximate
Longitude 81 degrees - 5 min. West. This area can best be described as a hot humid climate with an
outdoor ambient cooling design temperature of 93 degrees dry bulb and 78 degrees wet bulb. The
annual degree hours that the wet bulb temperature is at or greater than 66 degrees F. is 18,000 ( Air
Force manual 88-8 Figure 16) indicating that a significant problem with high moisture content will occur
and that HV AC systems must be designed to satisfactorily remove the required amount of moisture from
the air to keep the humidity levels in the building under control

4.0 SITE INVESTIGATION
This report has been written based on observations and testing made during a site visit on September 6th
' 1997. The site investigation was conducted by Mr Lee Kendrick 0 P _ E. air quality engineer , who was
assisted by Mr Luis Smith, air quality technician of EE&G . Mr John King of the Monroe County
Department explained the building and assisted in the investigation.
50 DESCRIPTION OF THE EXISTING HVAC SYSTEMS
5.1 GENERAL
The basic systems installed in this building are best described as four single zone air handling
systems each with OX coils and each served by four outdoor compressor - condensing units
5.2 BASIC EQUIPMENT
The basic equipment in this building consists of the following :
1. AIR HANDLING SYSTEM NO.1 - SERVES THE SOCIAL SECURITY OFFICES.

5.3 BASIC TEMPERATURE CONTROL SYSTEMS
Each of the four air handling systems is controlled as a single zone with a on-off thermostat
controlling the condensing unit. Dehumidification occuring only when the thennostat calls for
cooling. All units are energized on a 24hr/daY365 days per year basis.
5.4 BASIC HUMIDITY CONTROL SYSTEM
There is no positive control of the humidity in any of the 4 zones. These air handling systems do
not remove any water vapor from the air unless the zone is calling for cooling and the coil is cold .
6.0 FINDINGS
6.1 WET AND DRY BULB TEMPERATURE MEASUREMENTS
Measurements of wet and dry bulb temperature readings for the outdoor air and for the SUpply air
temperatures leaving each of the four air handlers using wet and dry bulb thermometers. The
room thermostats for each of these systems was set for full cooling for the purposes of these
tests. The purpose of this testing was to determine the ability of these systems to remove
sufficient water vapor from the air and to cool this air enough to keep the zone comfortable. The
results of these tests are shown below :

These tests indicate that air handling systems 1 thru 3 can reduce the air close to a goal of
of 60 grains/lb. Air handler #4 ,however was 17 grains/lb above the goal for keeping the
building dry. It should be pointed out that the outdoor intakes were fully blocked off at the
time of these tests. If the correct amount of outdoor had been introduced during these tests

the results would have shown considerable more moi51"ure content in the SUpply air.

7.0 ENGINEERING OBSERVATIONS
I
The following observations were made during the Engineering study:
I
1 The existing systems cannot maintain ideal temperatures in all spaces but can maintain the
temperature in the lone.
I
2 The existing systems cannot maintain desired humidity levels (45-55%) thruout the building
because there is no positive control of humidity.
3 The existing systems cannot keep the building under positive pressure
I
4 The existing air handlers are not equipped with high efficiency filters and there is no space
available to install this type of filters. Installation of high efficiency filters would also impose static
pressure requirements above the capabilities of the existing air handlers.
I
5 The existing air handlers do not have stainless steel condensate pans and the existing pans
are not fully drainable.
I
6 The existing air handlers do not have sufficient space around them to facilitate adequate
maintenance.
I
7 The air handlers are in a room that is a return air plenum. This makes air balance between
return air and outdoor air impossible.
I
8 The building does not have a positive system of outdoor air introduction. The building does
not meet the requirements of ASHRAE 62-89 which requires 20 CFM/person of outdoor air.

9 Outdoor air intakes have been blocked-off because of their undesirable location near a toilet
exhaust fan.
10 Condensing unit no. 4 requires replacement due to salt corrosion.
11 There is high percentage of computer room flooring in this building ; if there is moisture
existing in the cavity below the floor it could contribute to the higher humidities that are being
experienced.
12 Vermin feces were observed above in the air return plenum above the Ceiling near air
handler no. 2
8.0 CONCLUS IONS
1 The HV AC systems in this building are deficient in their abilty to maintain room by room
temperatures. but can control zone temperatures.

2 Replace compressor-condensing unit CU-4 with a new unit. See appendix "B" for a suggested
specification for this replacement.
3 Make a thorough inspection of the cavity under the existing computer floor. Waterproof walls
if water intrusion is determined.
4 Calibrate existing controls after new pretreatment unit is installed and made operational.
5 Provide air balance after new pretreatment unit is installed and made operational.
6 Blank -off all existing outdoor air intakes with sheet metal after the installation of the new
pretrearment unit
7 Provide pest control services to rid building of vermin.
8 Clean ceilings of all allergens ( Le vermin droppings ). after elimination of all vermin.
9. Obtain detailed design working drawings and specifications for installation of the roof mounted
pretreatment unit before proceeding. This contract documents should be signed and sealed by a
Florida registered P.E EE &G can provide this service if it is so desired.

SUBJECT: SUGGESTED SPECIFICATION FOR REPLACEMENT OF CON-
DENSING UNIT SERVING AHU-4 MONROE COUNTY GOV'T CENTER AN-
NEX 490 63rd STREET MARATHON, FLORIDA
The contractor shall provide and install a new air cooled compressor - condensing unit to replace
the existing unit that serves the air handling unit no. 4. The existing condensing unit CU-4 is
located on the ground at the Annex.. The contractor shall pay for and obtain all req'd permits.
All work shall comply with all State & Local codes and regulations
The contractor shall visit the site and become familiar with the scope of the project before submit-
ting a bid,
The contractor shall schedule all work and all down time with the Monroe County Maintenance
department
The contractor shall remove the existing unit from the setting and from the premises.. The
contractoir shall provide all required crane service.
The new unit shall be as follows:
1. "Addison" model RC , or approved equal, unit with all features as listed herein.
2. Unit shall have EER and SEER tocomply with the Florida energy code
3. Unit shall have a nominal capacity to match air handling unit #4
4. Unit shall have a single refrigerant circuit to the existing air handling unit.
5. Condensing coils shall be constructed with copper tubes and aluminum fins and the
entire condensing coil shall be "Heresite" coated. The contractor shall deliver a certificate
to the owner that the coil has been coated to " Heresite " company specifications.
6. Unit shall be modified for coastal service. F:7trame and fan guard shall be coated with"
"Oxiguard" Unit shall be assembled with stainless steel screws
7. Manufacturer shall provide ( parts only) warranty 2nd to 5th year for compressor.
8. Manufacturer shall warranty the entire unit for one year.
The contractor shall provide new unit mountings to withstand winds of 125 mph velocity.
The contractor shall provide and install all required refrigerant piping reconnections , including
complete vapor sealed pipe insulation on the suction piping.
The contractor shall provide all required electrical reconnections and control reconnections:'
The contractor shall, after completed installation, place the system in operation and demonstrate
to the owner that the unit and the system controls are operating correctly.
The contractor shall deliver an instruction manual and parts list to the owner..
