ITEM BACKGROUND: FKAA performed a wastewater collection system alternatives analysis
and developed guidelines for extending central sewer to previously designated "cold spot" areas. Two
public meetings with residents from the service area were held in December 2008. Comments from
citizens have been considered and incorporated into the proposed 2009 update to the Master Plan.
PREVIOUS RELEVANT BOCC ACTION: FKAA presented the preliminary results of the
Alternatives Analysis at the November 2008 BOCC meeting.

ITEM BACKGROUND: At the County's request, FKAA performed a wastewater conveyance alternatives analysis
and as a result, developed basic guidelines for extending central sewer to previously named "cold spot" areas.
FKAA, the County and the Monroe County Health Department are in the process of developing a plan to handle the
remaining on -site systems through an Interlocal Agreement. It is expected that the proposed ILA will be presented
to the Board at the February Board Meeting.
The FKAA and Monroe County held two meetings with the residents of the Cudjoe Regional wastewater district
in December 2008. Comments from the citizens have been considered and incorporated into the proposed 2009
changes to the Wastewater Plan.
PREVIOUS RELEVANT ACTION BY FKAA BOARD OF DIRECTORS: 10/08 Staff made presentation to the Board on
proposed implementation changes to the Wastewater Plan.
STAFF RECOMMENDATION (MOTION): Staff recommends the Board of Directors approve the 2009 Update to the
Monroe County Wastewater Plan:
- to provide for the inclusion of additional properties to the central wastewater system;
- to provide that properties that are located in the wastewater districts that will not be connected to central
wastewater systems receive funding equitable to properties connected to the central systems, and
- to authorize staff to present this item to the Monroe County BOCC for approval.

LOWER KEYS: WASTEWATER MASTER PLAN 2009 UPDATE
PROJECT HISTORY Recognizing that the economic health of Monroe County and its municipalities relies
largely on the environmental health of a unique marine ecosystem, the State of Florida mandated that
nutrient loading levels be reduced in the marine ecosystem of the Florida Keys. The Sanitary
Wastewater Master Plan (Master Plan) was finalized about 10 years ago with the goal of eliminating
approximately 23,000 private on -site wastewater systems by July 2010. Through interlocal agreement,
Monroe County has requested that the Florida Keys Aqueduct Authority (FKAA) design, build, and
operate County -owned infrastructure on behalf of the citizens in the Master -Plan prescribed service
areas.
The Master Plan identified certain "Hot Spots" (areas to be served by a regional sewer system) and
"Cold Spots" (areas that must employ on -site, BAT compliant technology), which became the primary
guide for wastewater conveyance design efforts. In early 2008 the Monroe County officials requested
that the FKAA revisit the Master Plan service areas, with the goal towards including more connections in
the regional system. In partnership with its consultant, Mathews Consulting Inc., FKAA performed an
analysis of alternative wastewater collection and conveyance systems and produced a draft report in
October 2008. In conjunction with a study of BAT compliant OWNRS systems, the costs associated with
serving additional areas not anticipated in the original Master Plan were looked at and a "Rule -of -
Thumb" was developed.
METHODOLOGY The "Rule -of -Thumb" is simple. If it is less expensive to connect a property to the
regional system using alternative conveyance technologies then it is to perform an on -site BAT
compliant conversion, then the property would be connected. This translates to connecting homes
equal to or less than approximately 500 feet from a regional "Hot Spot" connection point on a per EDU
basis. For example, if the furthest home of three homes on the same street were located 1200 feet from
a connection point, then all three would be connected, even if all three were more than 500 feet from
the nearest connection point.
Using this "Rule -of -Thumb", FKAA developed updated maps of the Cudjoe Regional Service Area (CRSA)
and developed a new category called "Warm Spots"; areas that could cost-effectively be tied into the
regional system utilizing alternative conveyance systems.
The FKAA Board heard the presentation in October 2008 and concurred with the methodology. FKAA
staff then presented to the Monroe County Commission in November 2008, and in December held two
public meetings to notify the public of the potential impact. Comments received were then incorporated
into the plan. FKAA staff now requests that the FKAA Board adopt the methodology and encourage the
staff to present same to the Monroe County Commissioners as soon as it can be scheduled so that the
Cudjoe Regional Service Area collection system design effort can commence.
EQUITY for all residents and businesses in the project area is an important criterion, whether they are
within the central wastewater collection area or not. FKAA and Department of Health are working
toward an interagency agreement with Monroe County to provide equitable assistance to the remaining
property owners with on -site systems. This program will be voluntary and allow owners to "opt out" of
the program and handle the requirements of on -site hook-up and maintenance on their own.

Dear Mayor Neugent and Fellow Monroe County Commissioners:
We are here today to ask for your help in trying to minimize future confusion over the issue of
wastewater "Cold Spot" and "Hot Spots" with regard to a planned connection to a central sewer
collection system or an onsite wastewater nutrient reduction system permitted by the State.
Monroe County Ordinance 031-1999 called for the establishment of wastewater "Hot Spots" and
defines "Hot Spots" as "those areaa that are anticipated to be served by central community
wastewater systems within the next io years or by year 2oto"; and, "that all areas not
designated as "Hot Spot Areas"are "Cold Spot Areas."
Page three of the back-IM materials for this agenda item, a copy of which was just given to each
Commissioner, describes wastewater "Cold Spots" as those "areas that must employ on -site BAT
compliant technology." Technically speaking, this is not an accurate statement.
As you know, there is nothing in the Master Plan that would prohibit an area designated as a
wastewater "Cold Spot" from being connected to a regional sewer system. In fact, Chapter 6 of
the Master Plan addresses this very issue on page 6-2 by stating, "as the year 20io approaches,
property owners with existing onsite system will opt for the lease expensive alternative for them
and the surrounding area, which would entail hooking up to a central collection and treatment
system."
Exhibit F t-B of the Wastewater Master Plan a copy of which was just given to each of
Commissioner, clearly show that all of No Name Key is a wastewater "Cold Spot Area." The fact
that No Name Key was designated by the Master Plan as a wastewater "Cold Spot" is undisputed
by this Commission, Growth Management and Planning staff, and needs to be understood by all.
Unfortunately. he map on page twelve of the back-up materials for this agenda item, a copy of
which was just given to each Commissioner, incorrectly shows two large portions of No Name
Key in RED color which are named "Original Regional System Connected Parcels" and would
signify areas the Master Plan originally defined as wastewater "Hot Spots", not "Cold Spots."
Also, we would like to point out that the two area on No Name Key currently shown in RED,
include undeveloped privately owned properties, conservation land owned by the Department of
Interior, conservation land owned by Monroe County; and, exclude one of 42 lawfully
established single family residential units that currently exist on No Name Key.
We realize our request to correct this FKAA map is picky and apologize in advance for that fact.
But, given the time and energy and money we have had to spend in the last year trying to correct
misinformation brought before this Board that unfortunately went unchallenged at the public
hearings, we feel the need to ask you to please ask FKAA to remove the RED shaded areas from
their map and correctly depict No Name Key as a wastewater "Cold Spot."
We would further ask that this FKAA planning map remain aligned with Monroe County
Sanitary Wastewater Master Plan's designation of No Name Key as a wastewater "Cold Spot"
until such time that a formal recommendation, based upon a full analysis of all of the alternative
has been made by the relevant agencies (FKAA, DOA and DCA)., is reviewed and adopted by this
Board of County Commissioners as the best technology for us to meet the Year 2010 wastewater
standards.
