NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Monroe
County, Florida, will hold a public hearing on November 21, 2000, at 3:00 PM, at the Key
Largo Library, Tradewinds Shopping Center, Key Largo, Florida, for the purpose of
determining whether or not the following streets, alley-ways, roads or highways shall be
abandoned:
THE WESTERLY 6.00 FEET OF LOT 6, BLOCK 5, LESS THE SOUTHERLY 12.00 FEET
THEREOF AND THE EASTERLY 6.00 FEET OF LOT 5, BLOCK 5, LESS THE SOUTHERLY
12.00 FEET THEREOF; "HARBOR COURSE SOUTH, SECTION ONE, OCEAN REEF PLAT NO.
14" ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 7, AT PAGE 9, OF
THE PUBLIC RECORDS OF MONROE COUNTY, FLORIDA.
Pursuant to Section 286.0105, Florida Statutes, notice is given that if a person
decided to appeal any decision made by the Board with respect to any matter considered
at such hearings or meetings, h~ will need a record of the proceedings, and that, for
such purpose, he may need to ensure that a verbatim record of the proceedings is made,
which record includes the testimony and evidence upon which the appeal is to be based.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, RENOUNCING AND DISCLAIMING ANY RIGHT OF
THE COUNTY AND THE PUBLIC IN AND TO THE UTILITY EASEMENT
BETWEEN LOTS 5 AND 6 MAHOGANY LANE, HARBOR COURSE SOUTH,
OCEAN REEF. KEY LARGO. MONROE COUNTY. FLORIDA
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter described
streets, alley-ways, easements, roads or highways, and
WHEREAS, due notice has been published and a public hearing has been held in accordance
with Chapter 336, Florida Statutes, and
WHEREAS, at said public hearing the Board considered the argument of all parties present
wishing to speak on the matter, and all premises considered concerning the renouncing and
disclaiming of any right of the County and the public in and to the hereinafter described streets,
alley-ways, easements, roads or highways as delineated on the hereinafter described map or plat,
and
WHEREAS, the Board has determined that vacation of the said easement is for the general
public welfare, and conforms to the requirement of Florida Statutes Sec. 336.09 and Sec. 336.10,
now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, that the Board hereby renounces and disclaims any right of the County and the public in
and to the following described streets, alley-ways, easements, roads or highways as delineated on
the hereinafter described map or plat, to-wit:

KEYS ELECTRIC COOPERATIVE ("Utility").

RECITALS
WHEREAS, the Plat of Harbor Course South, Section One, Ocean Reef Plat No. 14
according to the plat recorded in Plat Book 7, Page 9 of the Public Records of Monroe County,
Florida (the "Plat") provides for six foot utility easements along the sidelines oflots within the Plat;
and
WHEREAS, Utility provides services to the lots in the Plat; and
WHEREAS, lots 5 and 6 in Block 5 of the Plat are considered one lot pursuant to a unity of
title recorded in O.R. Book 1601 at Page 1196 of the Public Records of Monroe County, Florida;
and as a result of the combination of said lots, Utility desires to disclaim its rights to certain of the
sideline utility easements referred to in the Plat;
NOW, THEREFORE, for good and valuable consideration, the receipt of which is hereby
acknowledged, Utility agrees as follows:

James Murphy and Jeffrey Leggett have requested the abandonment of a
platted six (6) foot utility easement on the west side of Lot 6 and a platted
six (6) foot utility easement on the east side of Lot 5, Block 5, Harbor
Course South, Section One, Ocean Reef Plat 14, Key Largo, Florida.
The entire Harbor Course subdivision is In the Improved Subdivision (IS)
land use districl There is a single family home on Lot 6, Block 5. At
present, Lot 5, Block 5 Is not developed.
Easement Description
The easement which is the subject of the request for abandonment, was
included as a part of the original plat as shown In Plat Book 7, Page 9, of
the Public Records of Monroe County.
Use of the Easement
There is no current use of this easemenl
Development Potential
Lots 5 and 6 of Block 5 of Harbor Course South, Section One are zoned
Improved Subdivision (IS). Section 9.5-242 of the Monroe County Land
Development Regulations would allow the construction of a single family
home on each lol
There has been a Unity of Title for Lots 5 and 6 of Block 5, Harbor Course
South, Section One, filed and recorded on October 19, 1999 in the Public
Records of Monroe County, Florida on Page 1196, Book 1601. This Unity of

Title was filed In order to facilitate the construction of one (1) single family
residence that will straddle the property line where the easements are
located. An application to construct a single family home on the property
as Indicated by the application would require the demolition of the
residence currently located on Lot 6. Inasmuch as Section 9.5-262 of the
Monroe County Land Development Regulations (LORs) would allow the
development of only one single family residence on any platted lot
Shoreline Access
The utility easements being proposed for abandonment do not terminate
on open water.
Staff Review '
A review of the records and aerial photographs of the property revealed the
following:
1. The original plat recorded at Plat Book 7. Page 9. states: "The
utility easements. described as: A strip of land 10 feet In width
running along the street frontage. and a strip of land 6 feet In
width running along the sidelines of every lot In this
subdivision a~ hereby reserved for the Installation and
maintenance of utility distribution lines and shall be kept free
of permanent obstructions." The application for abandonment
does not request the abandonment of the 10 foot wide
easement running along the street frontage.
2. The applicants are the only adjacent property owners affected
by'the abandonment of the utility easement
3. The applicants have received letters of concurrency from the
Florida Keys Electric Cooperative Association. the North Key
Largo Utility Corporation. A T & T Cable Services. Bellsouth
Telecommunications. Inc. and the Florida Keys Aqueduct
Authority.
Conclusion
Staff recommends APPROVAL of the request by James Murphy and Jeffrey
Leggett for an abandonment of the utility easements between lots 5 and 6
of Block 5. Harbor Course South. Section One based on the following:
1. The utility easements proposed for abandonment serve only
the applicants. Therefore the request for abandonment meets
the requirement as outlined In Monroe County Code Section
16-1.
2. The easements do not terminate on a body of water. and the
abandonment Is consistent with goal 213 of the Monroe
County Year 2010 Comprehensive Plan
3. Based on the application and supporting documentation. the
abandonment will not impair the distribution of utilities In the
neighboring area.
